A certain document, three copies of which are on file in the office of the Secretary of the Township of Robinson, being marked and designated as the International Fire Code, 2009 edition, including Appendix Chapters: A, Board of Appeals; and B, Fire-Flow Requirements for Buildings, only Sections B102, B103, B104 and B106; and D, Fire Apparatus Access Roads, excluding Section D107 One- or Two-Family Residential Developments; and H, Hazardous Materials Management Plan (HMMP) and Hazardous Materials Inventory Statement (HMIS) Instructions; and I, Fire Protection Systems, Noncompliant Conditions; and as published by the International Code Council, be and is hereby adopted as the Fire Code of the Township of Robinson, in the Commonwealth of Pennsylvania, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file in the office of the Township of Robinson are hereby referred to, adopted, and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in §
137-2 of this chapter.
The following sections are hereby revised:
A. Section 101.1. Insert: Township of Robinson.
B. Section 109.3. Insert:
(1) Offense: summary offense.
C. Section 111.4. Insert:
(1) Dollar amount in two locations: $500 and $500.
Any person appointed to the position of Fire Code Official shall
be certified as a Building Plans Examiner, Electrical Plans Examiner,
Building Inspector, Electrical Inspector and have a Fire Inspection
certification all from the International Code Council or shall have
equivalent qualifications in the reasonable determination of the Board
of Commissioners. Any person appointed to the position of or serving
in the capacity of a Fire Inspector shall have a fire inspection certification
issued by the International Code Council or shall have equivalent
qualifications in the reasonable determination of the Board of Commissioners.
In the event that any section of the 2009 International Fire
Code conflicts with any adopted and applicable provision of the Pennsylvania
Uniform Construction Code or Pennsylvania Code of Regulations adopted
thereunder, then the adopted and applicable provisions of the Pennsylvania
Uniform Construction Code or Pennsylvania Code of Regulations shall
supersede any conflicting provisions of the 2009 International Fire
Code.
Nothing in this chapter or in the Fire Code hereby adopted shall
be construed to affect any suit or proceeding impending in any court,
or any rights acquired, or liability incurred, or any cause or causes
of action acquired or existing, under any act or ordinance hereby
repealed, if any, nor shall any just or legal right or remedy of any
character be lost, impaired or affected by this chapter.
The Secretary of the Township of Robinson is hereby ordered
and directed to cause this chapter to be published.
This chapter and the rules, regulations, provisions, requirements,
orders and matters established and adopted hereby shall take effect
and be in full force and effect immediately from and after the date
of its final passage and adoption.
