At the general City election to be held the first Tuesday after the first Monday in April every four (4) years, the qualified voters of the City shall elect some suitable person as Mayor of the City, who shall be the Chief Executive Officer thereof and who shall hold office for four (4) years.

A. 
The Mayor shall have the powers and duties presented by Section 4.3 and other Sections of the City Charter.
B. 
The Mayor may attend all departmental meetings and participate in deliberations and discussions at those meetings.
C. 
The Mayor shall appoint and supervise the Director of Emergency Management and shall have such other powers and duties over the Office of Emergency Management as may be provided in Chapter 235 of this Code.
D. 
The Mayor shall report to the City Council all violations or neglect of duty on the part of any City Officer which shall come to his/her knowledge.

There shall be a City Clerk who shall be appointed and may be removed by the City Council as provided by Section 3.9 of the City Charter. The City Clerk shall have the powers and duties prescribed by Section 3.9 and other Sections of the City Charter and by ordinance.

A. 
The City Clerk shall have the custody of and safely keep the common Seal of the City, the public records, the originals of ordinances and resolutions of the City Council and such other records, documents and papers of a public nature as may be delivered into the Clerk's custody. The Clerk shall affix the common Seal of the City to all public instruments and official acts of the Mayor, which by law or ordinances are required to be so attested and countersign the same and affix the common Seal to and certify to any record, document, copies of papers or ordinances that may be required for evidence in any court of this State or the United States by any individual or that may be required for the use of any officer of the City and shall furnish to the City Attorney any record or document in the Clerk's office necessary to be used in any proceeding in court to which the City is a party. The Clerk shall attend all meetings of the City Council and keep a correct journal of its proceedings. The Clerk shall prepare all certificates of election, commissions, appointments and all other official documents required by ordinances to be issued or which the Mayor, in the discharge of his/her duty, is required to issue and countersign and affix the common Seal thereto and keep a record of all such certificates of elections, commissions, appointments and documents. The Clerk shall record the official bonds of all City Officers and the bonds of all other persons executed to the City placed in the Clerk's custody. The Clerk shall record all City ordinances passed and shall neatly label and file for safekeeping the original roll and all ordinances and resolutions of the City Council and such other vouchers, papers, records and documents that may be delivered into the Clerk's custody. The Clerk shall carefully and promptly execute every official act that may be required of the City Clerk by the laws of the State and the ordinances of the City. The Clerk shall keep a copy of all contracts approved by ordinance.
B. 
It shall be the duty of the City Clerk to serve as secretary of the standing committees of the City Council and he/she shall prepare such reports as may be necessary and required for the committees from time to time.

The City Clerk is authorized and empowered, subject to the approval of the City Council, to employ some suitable person as Assistant City Clerk; and further, to employ suitable persons as deputies and stenographers, in such number as may be approved by the City Council from time to time, to aid and assist the City Clerk in the duties of his/her office.

Whenever, for any reason, the City Clerk is unable to perform the duties of his/her office, the City Council may, by resolution, appoint a temporary Clerk who shall have all the power and perform all the duties of the regular Clerk and shall receive the same salary for the time he/she so acts.
