[CC 1989 §10-30]
For the purposes of this Code, the term "Fire Chief" shall be construed to mean the Chief of the Fire Department.

A. 
The Fire Department shall have complete control and authority at the scene of any fire, natural or manmade disaster within the City and at such other places as may be designated by this Code or other ordinance; and personnel of the Fire Department shall continuously be on the alert, vigilant and active in the prevention of fire and the violation of the law of this State and the provisions of this Code and other ordinances relating to fire protection.
B. 
The Fire Chief shall be the executive head and commanding officer of the Fire Department and shall be responsible for and have authority over all personnel of the department necessary to provide proper fire protection within the City and maintain a high standard of administration, training, discipline, morale and operations in the Fire Department.

The senior officer of the Fire Department present at the scene of any fire shall have the Police power authorized by law or ordinance and shall have full power and command over all persons whatsoever thereat and he/she shall direct and adopt any and all measures necessary for the extinguishment of such fire and for the care and protection of property endangered thereby; and he/she shall have power, if necessary, to summon any and all persons present to aid in the extinguishment of the fire or in moving or caring for personal property from any building endangered by fire.

A. 
The Fire Chief or assistant Fire Chief, if appointed, shall be responsible for receiving, processing and maintaining all Fire Department records.
B. 
The Fire Chief shall keep or cause to be kept in a suitable book a correct record of all fires that occur, showing the estimated value of the property placed at risk thereby, together with the supposed cause of the fire and the amount of insurance involved and the amount of loss incurred; and at the close of each month, he/she shall make a report to the Mayor and City Council giving a summary of the work done and the general condition of the Fire Department and the expenses incurred by it.

No Fire Department vehicle, hose or other property belonging to the Fire Department of this City shall be hired or loaned to any person whatever and it shall be unlawful for any officer or member of the Fire Department or any fire company to violate this Section.

A. 
No member of the Fire Department shall be permitted to engage in or receive compensation for any work, occupation or profession in addition to his/her duties as a member of the Fire Department except as may be approved by the Fire Chief. In case of small, temporary jobs the Fire Chief is hereby authorized to make a temporary approval.
B. 
Every member of the Fire Department shall, with the exception of the Fire Chief and Assistant Chief, appear in full uniform while on duty; and all members of the Fire Department when on duty shall at all times be immaculate, clean and presentable to the public.

The Fire Chief in the discharge of his/her duties shall be subject to the orders of the City Administrator. The Assistant Fire Chief, if appointed, and all other members of the Fire Department shall be subject to the orders of the City Administrator and their superiors in the Fire Department.

A. 
The regular hours of the Fire Chief shall be a forty (40) hour workweek.
B. 
In the event of a vacancy in the office of Fire Chief by reason of death, removal, resignation or other cause, the office shall be filled in the same manner as prescribed in Section 115.150 of this Code.

A. 
The Fire Chief shall have command of all fire companies of the City and shall exercise a constant supervision thereover, taking care that every member of such companies is properly trained and drilled in a manner to best discharge the work assigned to him/her. He/she shall make or cause to be made frequent inspections of all fire hydrants in the City and see that at all times they are kept in repair and ready for use. He/she shall in like manner inspect all fire apparatus under his/her control and everything connected with the Fire Department and see that they are carefully preserved and kept in good condition for use in case of fire. He/she shall have general charge of the fire stations of the City. He/she shall attend all fires within the City as far as practicable and all orders given by him/her to the Fire Department or any member thereof shall be promptly obeyed. He/she may order the removal of any building, structure or fence for the purpose of checking any fire. He/she shall have power to demolish or cause to be demolished any building or structure for the purpose of checking or extinguishing any fire. He/she may prescribe the limits, in the vicinity of any fire, within which no person except Firefighters or other authorized persons shall be permitted and it shall be the duty of the Chief of Police and every Policeman of the City to aid in carrying into effect the provisions of this Section.
B. 
Establishment Of Shift Schedules.
1. 
The Fire Chief shall be responsible for establishing and maintaining shift schedules for members of the Fire Department to insure adequate fire coverage for the citizens of the City.
2. 
All shift schedules established by the Fire Chief shall be approved by the City Council before being implemented.
3. 
Whenever possible, shifts shall be scheduled so as to provide six (6) Firefighters on duty.
4. 
The Fire Chief shall provide a minimum of five (5) Firefighters on duty at all times.
5. 
The Fire Chief or his/her successor shall be responsible for implementation of the provisions of this Section. If, in the opinion of the Fire Chief, abuses of the vacation or sick leave provisions occur, the Fire Chief shall have the power to suspend any member of the Fire Department without pay while an investigation of the abuses is being made. Upon satisfactory evidence of abuse, the member shall be dismissed permanently or suspended for a definite period, subject to the provisions of the Personnel Policy.

A. 
The Assistant Fire Chief, if appointed, shall assume the authority of the Fire Chief in the absence of the Fire Chief. In the event of the death, resignation or removal of the Fire Chief, the Assistant Fire Chief shall assume the duties and responsibilities of the Fire Chief until such time as a new Fire Chief shall be appointed pursuant to Section 115.150 of this Code.
B. 
The regular hours of the Assistant Fire Chief shall be a forty (40) hour workweek. The Assistant Fire Chief shall perform relief duty for the Fire Chief during his/her absence from duty.
C. 
The Assistant Fire Chief shall be responsible for the preparation and execution of a fire prevention and code enforcement program.

The Fire Department Captain, if appointed, shall have authority over the firefighters and shall be subject to the duties as shall be designated by his/her superior officers.

The Fire Chief shall adopt such systems as he/she may deem practicable for the examination of all buildings within the City, except residential occupancies so as to render the members of the Fire Department familiar at all times with the construction of internal arrangements of such buildings, the mode of ingress and egress and facilities in case of fire.
[CC 1989 §10-45]
The Fire Chief shall prepare and may from time to time amend rules and regulations not inconsistent with this Code or State law for the government of the Fire Department and the conduct of the members thereof. Such rules and regulations and amendments thereto, when approved by the Mayor and adopted by resolution of the City Council entered of record in the journal of the Council and placed on file in the office of the City Clerk, shall be binding on all members of the Fire Department and it shall be unlawful for any member of the Fire Department to violate or fail to comply with any such rule or regulation.

All fire hydrants in the City shall be located, installed, repaired, maintained, replaced and removed by order of the City, at the cost of the City and under its direction and supervision. The City shall consult the head of the City Fire Department regarding the location, installation and removal of fire hydrants.

There shall be no charge made for the duly authorized use of any City-owned or operated fire hydrant.
