The Board of Supervisors shall establish, by resolution, a schedule
of fees to be paid by the applicant to defray the application filing
procedures, engineering review and inspection during construction.
The following fees shall be paid by the applicant:
A. Application filing fee. The application filing fee shall be paid
by the applicant at the time of filing a sketch, preliminary, final,
preliminary/final or lot add-on plan. No plan shall be considered
by the Board of Supervisors or Planning Commission unless all Township
application filing fees are paid in full.
B. Review fees.
(1) Review fees shall include the reasonable and necessary charges by
the Township's professional consultants or engineer for the review
and report to Fairview Township. Such fees shall be reasonable and
in accordance with the ordinary and customary charges by the consultant
or Township Engineer for similar service in the Township, but in no
event shall the fees exceed the rate or cost charged by the consultant
or Township Engineer to the Township when fees are not reimbursed
or otherwise imposed on applicants.
(2) In the event the applicant disputes the amount of any such fees,
the applicant shall, within 10 days of the billing date, notify the
Township Secretary/Treasurer that such fees are disputed, in which
case the Township shall not delay or disapprove a subdivision or land
development application due to the applicant's request over disputed
fees.
(3) In the event that the Township and the applicant cannot agree on
the amount of review fees which are reasonable and necessary, then
the fees shall be recalculated and recertified by another professional
engineer licensed as such in this commonwealth or consultant and chosen
mutually by the Township and the applicant. The estimate certified
by the third engineer or consultant shall be presumed fair and reasonable
and shall be the final estimate. In the event a third engineer or
consultant is so chosen, fees for the services of said engineer or
consultant shall be paid equally by the Township and the applicant.
(4) Engineering bills for plan reviews shall be submitted to the Township
for processing no later than seven days from the date of plan approval.
C. Inspection fees. Inspection fees shall include reasonable and necessary expense incurred for the inspection of improvements (see Article
V, §
260-19).
D. Legal fees. The applicant, at the time of application, shall agree
to cover any legal fees incurred by the Board of Supervisors for the
preparation and/or review of agreements or other documents related
to a proposed subdivision or land development.

260-33 of this chapter.
The schedule of fees shall be available in the Township Office
and in such other places that the Township may designate.
