This application fee shall be nonrefundable, unless the applicant voluntarily withdraws the application within five days of filing and can demonstrate that it has not operated the business for which the application is pending during said five-day period, in which event $50 shall not be refundable. (a) 
The person applying for a dog license shall pay a fee of $17 for each dog. He shall also pay $1 for the registration tag for each dog. The same fees shall be charged for the annual renewal of each license and registration tag.
(b) 
Any resident of the Township who shall have attained the age of 65 years of age applying for a dog license shall pay a fee of $1 for each dog. He shall also pay $1 for the registration tag for each dog. The same fees shall be charged for the annual renewal of each license and registration tag.
(c) 
There shall be an additional fee of $3 payable annually, applicable to Subsection A(3)(a) and (b) above, for each dog which has not had its reproductive system surgically altered.
(d)

Impounded dogs. The fee for redemption of impounded dogs is $20 for picking up a dog, plus $4 per day for each day or fraction thereof that the dog has been in custody to cover maintenance (N.J.S.A. 4:19-15.16).

Impounded cats. The fee for redemption of impounded cats is $20 for picking up a cat, plus $4 per day for each day or fraction thereof that the cat has been in custody to cover maintenance (N.J.S.A. 4:19-15.16).

Impounded other animals. The fee for redemption of impounded other animals as defined in § 108-1 is $20 for picking up the other animal, plus $4 per day for each day or fraction thereof that the animal has been in custody to cover maintenance (N.J.S.A. 4:19-15.16).

(a) 
Rates of compensation; administrative fees; payment for services. Rates of compensation for contracting the services of off-duty Township police officers shall be as follows:
1. 
For all security and nontraffic assignments, the rate shall be $60 per hour, plus a $10 per hour administrative fee to the Township, and any administrative fees assessed by third parties.
2. 
For all construction project traffic assignments, the rate shall be $90 per hour, plus a $10 per hour administrative fee to the Township, and any administrative fees assessed by third parties.
3. 
Cancellation with less than 24 hours' notice will result in a payment of two hours at the appropriate rate.
4. 
Cancellation or early completion on the day scheduled for a construction project traffic assignment shall result in payment for the full time scheduled, except for cancellation after the start as a result of inclement weather, machinery and/or manpower issues, or improper construction plans, which will then result in a payment of four hours at the appropriate rate.
5. 
Payment for all assignments shall be in accordance with the requirements set forth in § 5-59.6.
(b) 
Use of marked police vehicles. In the event that a party or employer employs any off-duty Township police officer pursuant to this section, in addition to any compensation to be paid to the Township pursuant to the requirements herein, there shall also be a fee of $12 per hour per vehicle for the use of marked police vehicles.
B.

B. 
Division of Construction Inspections.
(1) 
Housing standards.
(a) 
Inspection fees. (§ 268-4)
1. 
For each initial inspection and one reinspection for all unit types, except Township registered rental units, the fee shall be $200.
2. 
For each additional reinspection beyond the first reinspection in all unit types, except Township registered rental units, the fee shall be $100.
3. 
For Township registered rental units, the fee for the initial inspections shall be $75.
4. 
For each additional reinspection of Township registered rental units, the fee shall be $100.
5. 
For each smoke detector, sewer or multifamily certification inspection, the fee shall be $50.
6. 
Should an inspector arrive for a scheduled inspection and no adult is present to grant access, the full amount of the inspection fee shall be charged and the landlord/owner will be required to reschedule the inspection at a fee of $75.
(b) 
Rental unit inspections. At the time of initial registration of a landlord, expiration of every five-year period as required under § 268-18B, or upon any change of occupancy of a rental unit, the landlord or agent thereof must pay a fee in accordance with the following schedule for the purpose of having the rental unit inspected by the Township: (§ 268-18)
1. 
Initial inspection fee: $50 per unit, collected in equal annual installments over a five-year period.
2. 
Upon initial registration of a landlord and when adding a rental unit or units to the registration a fee of $50 per rental unit shall be assessed, which includes an inspection and one subsequent reinspection (to be completed within 30 days of a failed initial inspection). Multiunit facilities containing four or more units shall be assessed a fee of $50 per unit collected in equal installments over a five-year period. Prepayment of this fee shall not be penalized.
3. 
Following the expiration of every five-year period a fee of $50 shall be assessed, which includes an inspection and one subsequent reinspection (to be completed within 30 days of a failed initial inspection). Multiunit facilities containing four or more units shall be assessed a fee of $50 per unit collected in equal installments over a five-year period. Prepayment of this fee shall not be penalized.
4. 
Any change of occupancy, except those changes of occupancies upon each subsequent five-year inspection, shall be assessed a fee of $75, which includes one inspection.
5. 
Any subsequent reinspection conducted in excess of those specified in Subsection B(1)(b)2, 3 and 4 above shall be assessed a fee of $100 (to be completed within 30 days of most recent reinspection).
6. 
Fee to reschedule an inspection if no adult is present to grant access to the rental unit: $75, plus the full amount of the inspection fee.
7. 
Late fee: $30 per month.
(c) 
Landlord registration. The landlord registration fee must be renewed every five years. (§ 268-18)
1. 
Landlord registration fee: $200.
2. 
Landlord registration fee for owner-occupied rental units containing four units or less: $75.
3. 
Reinstatement of landlord registration: $300 in addition to all other applicable landlord registration fees.
(2) 
Septic tank cleaners. The annual license fee for the issuance or renewal for a license to engage in the business of emptying or cleaning septic tanks, cesspools, privies or any place used for the reception or storage of human excrement is $20 per vehicle and conveyance. (§ 385-16)

A. 
The purpose of this section is to establish policies and procedures for the collection and distribution of fees associated with the performance of marriage ceremonies by the Mayor.
B. 
Amount of fees.
(1) 
A resident of the Township of Hamilton seeking to be married by the Mayor of the Township of Hamilton shall pay to the Township of Hamilton a fee of $100.
(2) 
A person who is not a resident of the Township of Hamilton, seeking to be married by the Mayor of the Township of Hamilton, shall pay to the Township of Hamilton a fee of $250.
C. 
Payment of fees; deposit. The Township fee shall be paid, pursuant to Subsection B above, for all weddings, by cash or check payable to the Township of Hamilton, prior to completion of any such wedding. At the time a marriage ceremony is scheduled, a deposit of $50 shall be made, which shall be credited towards the fee listed in Subsection B above. The deposit shall be nonrefundable if a marriage ceremony is cancelled by the resident within 48 hours of the scheduled ceremony. Fees collected shall be deposited into the Township's current fund.
D. 
The Township shall disburse to the Mayor's Recreation Trust Fund the full amount collected under Subsection B above through the appropriate budget line item and with appropriate authorization, on a monthly basis.

A. 
Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:
FOR-PROFIT ORGANIZATION OR GROUP
Any organization or group organized for profit.
GOVERNMENT ENTITY
A unit, subdivision or entity of the state, county or municipality, including an agency, department, board, commission, bureau, division or military or public safety organization.
LEASE
The use of Township property, for a public purpose as specified under N.J.S.A. 40A:12-15, by any organization on a permanent daily basis.[1]
NONPROFIT ORGANIZATION OR GROUP
Any organization or group not organized for profit and operated for the promotion of the social welfare.
PERMANENT DAILY BASIS
The permanent presence of an organization on Township property by virtue of a lease agreement, including the use of Township property as office space and for the storage of an organization's files.
RECREATIONAL ORGANIZATION OR GROUP
Any organization or group not organized for profit and operated exclusively for the promotion of the social welfare in a recreational manner, including but not limited to sporting teams, referee organizations, etc.
SEASONAL BASIS
The seasonal presence of a recreational organization on Township property that would otherwise require a lease under this section.
TEMPORARY BASIS
The nonpermanent or low-impact presence of a person or organization on Township property that would otherwise require a lease under this section. More than one usage per week or usage for more than four consecutive hours per week by an organization or group, with the exception of senior citizen groups, shall not be construed as temporary basis and will require the organization or group to execute a lease with the Township pursuant to Subsection B and satisfy all requirements thereof.

B. 
Permanent daily leases.
(1) 
Lease agreement. Notwithstanding any other requirement to the contrary, organizations wishing to lease any property owned by the Township of Hamilton, including, but not limited to, buildings and grounds, on a permanent daily basis shall be required to enter into a lease agreement with the Township, subject to approval of Council.
(2) 
Lease fees. The monthly lease fee shall be calculated on a lease-by-lease basis based upon the actual usage and costs to the Township to operate same.
(3) 
Eligible organizations. Only organizations having a Section 501(c)(3) designation under the Internal Revenue Code and designated as a nonprofit under New Jersey law shall be eligible to lease Township property on a permanent daily basis.
(4) 
Exempt organizations. Organizations leasing Township property at Veterans Park, Kuser Park and the Isaac Pearson Property on a permanent daily basis and are open to the public on a regular schedule are exempt from the lease fees established under this section.
(5) 
Lease terms. Any lease entered into pursuant to this section shall be subject, but not limited to, the following rules and regulations:
(a) 
No organization or member thereof subject to a lease under this section shall enter or occupy the leased property earlier than 7:00 a.m. or later than 10:00 p.m. unless prior written approval is received from the Department of Health, Recreation, Senior and Veterans Services.
(b) 
No alcoholic beverages shall be permitted in or on the premises of the leased Township property, except for the distribution and consumption of alcoholic beverages pursuant to a lawfully issued Township permit and/or State of New Jersey, Division of Alcohol Beverage Control permit allowing alcoholic beverages as maybe deemed necessary.
(c) 
Leased property shall not be used for the personal use of any person or member of an organization, including, but not limited to, parties of any kind.
(d) 
No smoking shall be permitted in any leased property.
(e) 
Use of space in or on a leased property shall be restricted only to that space designated in the lease. Use of outside areas of leased property shall be prohibited where such use adversely impacts other persons or organizations using the leased property or impedes other areas of the leased property, including, but not limited to, the driveway, parking lot, or playground. Any use of additional space, other than the designated space outlined in the lease for any purpose, must be approved in advance by the Department of Health, Recreation, Senior and Veterans Services.
(f) 
The fee for a lost key or key card shall be $100. Only authorized officials of the Township of Hamilton shall have the authority to make duplicate keys or key cards.
(g) 
Leases cannot be subleased, transferred or assigned.
(h) 
Any abuse of the terms of the lease shall be grounds to terminate the lease and evict the organization in violation thereof.
C. 
Temporary or seasonal rental.
(1) 
Certain property owned by the Township of Hamilton shall be available for rent on a temporary or seasonal basis.
(2) 
Any organization or group shall be permitted to rent certain designated Township property on either a temporary or a seasonal basis. Any recreational organization or group shall be permitted to rent certain designated Township property on a seasonal basis.
(3) 
The following policies shall apply when a rental agreement is entered into for certain designated Township property on a temporary or seasonal basis:
(a) 
An organization or group seeking to rent Township property under this section shall file an application, at least 14 days in advance, when practical, with the Department of Health, Recreation, Senior and Veterans Services, stating:
1. 
The name and address of the applicant. Applicant must be present at the site for the entire length of the event.
2. 
The name and address of the organization or group sponsoring the activity, if any.
3. 
The date(s) and hour for which the rental is desired.
4. 
The Township property or portion thereof for which such rental is desired.
5. 
An estimate of the anticipated attendance.
6. 
The type of activity to be conducted.
7. 
Whether the applicant is a resident or nonresident of the Township.
8. 
Any other information which the Department of Health, Recreation, Senior and Veterans Services shall find reasonably necessary to attain a fair determination as to whether a rental should be approved under this section.
9. 
Rentals cannot be transferred or assigned.
(b) 
Standards for issuance. Standards for approval of Township property rental by the Department of Health, Recreation, Senior and Veterans Services shall include the following findings:
1. 
That the rental of the Township property will not unreasonably interfere with or detract from the general public enjoyment of the property.
2. 
That the rental of the Township property will not unreasonably interfere with or detract from the promotion of public health, welfare, safety and recreation.
3. 
That the rental of the Township property will not include violence, crime or disorderly conduct.
4. 
That the rental of the Township property will not entail extraordinary or burdensome expense or police operation by the Township.
5. 
That the Township property desired has not been reserved for other use at the date and hour requested in the application.
6. 
Priority of applicants.
a. 
The affairs of the Township shall take precedence over all other users of the Township property.
b. 
Resident nonprofit and recreational applicants will be given priority over other users for the use of the Township property, based upon availability.
c. 
Resident for-profit applicants will be given priority over nonresident applicants for the use of the Township property, based upon availability.
d. 
Nonresident nonprofit and recreational applicants will be given priority over nonresident for-profit applicants for the use of the Township property, based upon availability.
e. 
Nonresident for-profit applicants will be given the lowest priority for the use of the Township property, based upon availability.
f. 
In the event of a conflict between requesting applicants, the request received earlier will be honored first.
(c) 
Appeal. Whenever in the opinion of the Director of Health, Recreation, Senior and Veterans Services the approval of a rental will violate any of the standards listed in Subsection C(3)(b) above, he or she shall refuse to approve the rental. Whenever the Director of Health, Recreation, Senior and Veterans Services has refused to approve a rental, the applicant may appeal from such determination in accordance with Chapter 285, Licenses and Permits.
(d) 
Rental of Township property or portion thereof shall be restricted to the property, areas, dates, and times expressly requested on the rental application. The organization or group renting the property must be present on site, with identification, at all times during the use of the rental.
(e) 
The organization or group renting the Township property shall be bound by all rules and regulations and all applicable ordinances fully as though the rules, regulations and ordinances were inserted in the rental agreements.
(f) 
The organization or group to whom rental is approved shall be liable for all loss, damage or injury sustained by any person whatever by reason of the negligence of the organization or group to whom such rental shall have been approved. The Department of Health, Recreation, Senior and Veterans Services shall have the right to require any renter to submit evidence of liability insurance covering injuries to members of the general public arising out of such permitted activities, in such amounts as may be from time to time determined by the Department of Health, Recreation, Senior and Veterans Services, prior to the commencement of any activity for which any rental is approved and shall also have the right to require that the certificate of insurance name the Township of Hamilton as an additional insured.
(g) 
The fee for Township property rental shall be as set forth in this section.
(h) 
There shall be a security deposit paid to the Township at the time of booking in the amount of $100 to assure that the property will be left in a clean, safe and sanitary condition and also to assure that the terms of the rental agreement are complied with. The Department of Health, Recreation, Senior and Veterans Services will examine the property following use by such renter and, upon determining that all of the rules, regulations and ordinances have been complied with, the deposit will be returned to the renter. If the rules have not been complied with, the deposit will be forfeited. If a renter is present in or on the property outside of the times approved in the rental agreement, the deposit will be forfeited.
(i) 
If a rental is cancelled by a renter prior to 10 days before the scheduled rental date the security deposit shall be refunded. If a rental is cancelled by a renter within and including 10 days before the scheduled rental date the security deposit will be forfeited.
(j) 
No alcoholic beverages shall be permitted in or on the premises of the Township property, except for the distribution and consumption of alcoholic beverages pursuant to a lawfully issued Township permit and/or State of New Jersey, Division of Alcohol Beverage Control permit allowing alcoholic beverages as may be deemed necessary.
(k) 
When required by the Department of Health, Recreation, Senior and Veterans Services due to the number of persons in attendance during a rental, the services of a law enforcement officer or officers shall be obtained to maintain order. The services of such officers shall be obtained pursuant to § 5-66, Employment of off-duty police officers, of the Township Code.
(l) 
The Department of Health, Recreation, Senior and Veterans Services shall have the authority to revoke a rental upon a finding of violation of any rule, regulation or ordinance or upon good cause shown, including, but not limited to, the falsification of any information required on the rental application.
(4) 
Rental terms. Any rental agreement entered into pursuant to this section shall be subject to, but not limited to, the following rules and regulations:
(a) 
No organization or group subject to a rental agreement under this section shall in any way enter or occupy property owned by the Township of Hamilton between the hours of 10:00 p.m. and 7:00 a.m., unless prior written approval is received from the Department of Health, Recreation, Senior and Veterans Services.
(b) 
Rented property shall not be used for the personal use of any person or member of an organization or group, including, but not limited to, parties of any kind.
(c) 
No smoking shall be permitted in any rented property.
(d) 
Use of space in or on a rented property shall be restricted only to that space designated in the rental agreement. Use of outside areas of rented property shall be prohibited where such use adversely impacts other persons or organizations using the rented property or impedes other areas of the rented property, including, but not limited to, the driveway, parking lot, or playground.
(e) 
There shall be no fee for a temporary rental of Township property pursuant to this section by nonprofit groups and organizations. However, temporary rental of a designated Township property on Saturday, Sunday or a Township designated holiday shall be subject to the payment of an amount based upon the actual usage and costs to the Township to operate same during the temporary rental.
(f) 
For-profit groups and organizations renting Township property on a temporary basis shall pay the following applicable fee:

A cleaning fee of $100 shall be assessed for any indoor rental property unless otherwise specified.

If a rental is cancelled by a renter prior to 10 days before the scheduled rental date the cleaning fee shall be refunded. If a rental is cancelled by a renter within and including 10 days before the scheduled rental date the cleaning fee will be forfeited.
(g) 
Recreational groups and organizations renting Township property on a seasonal basis shall pay the following applicable fee:

(h) 
Organizations or groups renting Township property on a temporary or seasonal basis may, with prior written approval from the Department of Health, Recreation, Senior and Veterans Services, maintain a low-impact permanent presence on the property. For purposes of this section, "low impact" means permanent use or location of a closet, cabinet, refrigerator, etc., during the term of the rental.
(i) 
Any abuse of the terms of the rental agreement shall be grounds to terminate the rental agreement.
D. 
Grafton House, Sayen House and Gardens, and Nottingham Ballroom rentals.
(1) 
Notwithstanding any other provision of this section, the following policies shall apply when a rental agreement is entered into for Grafton House, Sayen House and Gardens, and Nottingham Ballroom rentals.
(a) 
A person or organization seeking to rent Grafton House, Sayen House and Gardens, and Nottingham Ballroom rentals. shall file an application, at least 14 days in advance, when practical, with the Department of Health, Recreation, Senior and Veterans Services, stating:
1. 
The name and address of the applicant.
2. 
The name and address of the person sponsoring the activity, if any. Applicant must be present at the site for the entire length of the event.
3. 
The day and hours for which the rental is desired.
4. 
The facility or portion thereof for which such rental is desired.
5. 
An estimate of the anticipated attendance.
6. 
The type of activity to be conducted.
7. 
Whether the applicant is a resident or nonresident of the Township.
8. 
Any other information which the Department of Health, Recreation, Senior and Veterans Services shall find reasonably necessary to attain a fair determination as to whether a rental should be approved under this section.
9. 
Rentals cannot be transferred or assigned.
(b) 
Standards for issuance. Standards for approval of a facility rental by the Department of Health, Recreation, Senior and Veterans Services shall include the following findings:
1. 
That the rental of the facility will not unreasonably interfere with or detract from the general public enjoyment of the facility.
2. 
That the rental of the facility will not unreasonably interfere with or detract from the promotion of public health, welfare, safety and recreation.
3. 
That the rental of the facility will not include violence, crime or disorderly conduct.
4. 
That the rental of the facility will not entail extraordinary or burdensome expense or police operation by the Township.
5. 
That the facility desired has not been reserved for other use at the date and hour requested in the application.
6. 
Priority of applicants.
a. 
The affairs of the Township shall take precedence over all other users of the facility.
b. 
Resident applicants will be given priority over other users for the use of the facility, based upon availability.
c. 
Nonresident applicants will be given priority over commercial applicants for the use of the facility, based upon availability.
d. 
Commercial applicants will be given the lowest priority for the use of the facility, based upon availability.
e. 
In the event of a conflict between requesting applicants, the request received earlier will be honored first.
(c) 
Appeal. Whenever in the opinion of the Director of Health, Recreation, Senior and Veterans Services the approval of a rental will violate any of the standards listed in Subsection D(1)(b) above, he or she shall refuse to approve the rental. Whenever the Director of Health, Recreation, Senior and Veterans Services has refused to approve a rental, the applicant may appeal from such determination in accordance with Chapter 285, Licenses and Permits.
(d) 
Rental of a facility or portion thereof shall be restricted to the facility, areas, dates, and times expressly requested on the rental application. The person renting the facility must be present on site, with identification, at all times during the use of the rental.
(e) 
The person renting the facility shall be bound by all rules and regulations and all applicable ordinances fully as though the rules, regulations and ordinances were inserted in the rental agreements, and person renting the facility shall be present at all times during rental period.
(f) 
The person or organization to whom rental is approved shall be liable for all loss, damage or injury sustained by any person whatever by reason of the negligence of the person or organization to whom such rental shall have been approved. The Department of Health, Recreation, Senior and Veterans Services shall have the right to require any renter to submit evidence of liability insurance covering injuries to members of the general public arising out of such permitted activities, in such amounts as may be from time to time determined by the Department of Health, Recreation, Senior and Veterans Services, prior to the commencement of any activity for which any rental is approved and shall also have the right to require that the certificate of insurance name the Township of Hamilton as an additional insured.
(g) 
The fee for a rental of Grafton House, Sayen House and Gardens, and Nottingham Ballroom shall be as set forth in this section.
(h) 
There shall be a security deposit paid to the Township at the time of booking in the amount of $100 for the rental of Grafton House and Sayen House and Gardens to assure that the property will be left in a clean, safe and sanitary condition and also to assure that the terms of the rental agreement are complied with. The Department of Health, Recreation, Senior and Veterans Services will examine the property following use by such renter and, upon determining that all of the rules, regulations and ordinances have been complied with, the deposit will be returned to the renter. If the rules have not been complied with, the deposit will be forfeited. If a renter is present in or on the property outside of the times approved in the rental agreement, the deposit will be forfeited.
(i) 
There shall be a security deposit paid to the Township at the time of booking in the amount of $500 for the rental of Nottingham Ballroom to assure that the property will be left in a clean, safe and sanitary condition and also to assure that the terms of the rental agreement are complied with. The Department of Health, Recreation, Senior and Veterans Services or agent will examine the property following use by such renter and, upon determining that all of the rules, regulations and ordinances have been complied with, the deposit will be returned to the renter. If the rules have not been complied with, the deposit will be forfeited. If a renter is present in or on the property outside of the times approved in the rental agreement, the deposit will be forfeited.
(j) 
If a rental for the Sayen House and Gardens or the Grafton House is cancelled by a renter prior to 10 days before the scheduled rental date the security deposit shall be refunded. If a rental is cancelled by a renter within and including 10 days before the scheduled rental date the security deposit will be forfeited.
(k) 
If a rental for Nottingham Ballroom is cancelled by a renter prior to 60 days before the scheduled rental date the security deposit shall be refunded. If a rental is cancelled by a renter within and including 60 days before the scheduled rental date the security deposit will be forfeited.
(l) 
No alcoholic beverages shall be permitted in or on the premises of the facility, except for the distribution and consumption of alcoholic beverages pursuant to a lawfully issued Township permit and/or State of New Jersey, Division of Alcohol Beverage Control permit allowing alcoholic beverages as may be deemed necessary.
(m) 
When required by the Department of Health, Recreation, Senior and Veterans Services due to the number of persons and/or number of underage persons in attendance during a rental, the services of a law enforcement officer or officers shall be obtained to maintain order. The services of such officers shall be obtained pursuant to § 5-66, Employment of off-duty police officers, of the Township Code.
(n) 
The Department of Health, Recreation, Senior and Veterans Services shall have the authority to revoke a rental upon a finding of violation of any rule, regulation or ordinance or upon good cause shown, including, but not limited to, the falsification of any information required on the rental application.
(2) 
Notwithstanding any other provision of this section the following fees shall apply when a rental agreement is entered into for the Grafton House, Sayen House and Gardens, and Nottingham Ballroom.

Any department in the Township that offers electronic/online payment options for any fee or payment of any kind to Hamilton Township may assess an administrative fee to the payment. The payor must be provided with the following prior to payment:
(1) 
The fee will be automatically added to the payment.
(2) 
The amount of the fee will be calculated and added to the payment and disclosed to payor.
(3) 
Payor has the option of not paying electronically/online and will avoid paying the administrative fee by so doing.
B. 
The administrative fee shall be no more than is necessary to cover the cost to Hamilton Township for the service.

A. 
Cannabis establishment permit.

A. 
In addition to any parking fees, the fee to charge one's electric vehicle within the municipality at a municipal EVSE station shall be as follows for each hour that the electric vehicle is connected to the EVSE. Fees shall be inclusive of any administrative charges. Notwithstanding the chart below, the availability of an EVSE station for charging shall coincide with the location's designated open hours only.

Between the hours of 6:00 a.m. and 11:00 p.m., an electric vehicle may park and be charged by a municipal EVSE for no more than four hours. Between the hours of 11:00 p.m. and 6:00 a.m., and the municipal EVSE is in a location which is open to the public, an electric vehicle will not be limited to an amount of time it may use the EVSE.
B. 
Nothing in this section shall be deemed to preclude a private owner/designee of an EVSE from collecting a fee for the use of the EVSE, in accordance with applicable state and federal regulations. Fees shall be available on the EVSE or posted at or adjacent to the EVSE parking space.

A. 
Notwithstanding the provisions of any ordinance to the contrary, any resident of the Township who shall have attained the age of 65 years, or who is totally and permanently disabled as certified by the Social Security Administration or a physician, or who is a disabled veteran whose wartime service-connected disability is 100% total and permanent as declared by the United States Veterans Administration or its successor, shall not be required to pay the municipal fees listed in § 215-17C(1), C(2), C(6) and C(7), should all conditions therein be met.
B. 
All department directors and other municipal officials with responsibility for administration of fees shall establish procedures to implement this section.
C. 
The waiver of fees provided in this section is subject to the following general restrictions and conditions:
(1) 
Residential property permits.
(a) 
Fees will be waived for the following residential property permits only:
1. 
New roof.
2. 
New siding.
3. 
Water heaters and/or furnaces.
4. 
New electrical services up to 400 amps.
(b) 
The resident must own and occupy the property at the time of application.
(2) 
Fees for group activities are waived for groups which include only residents who are subject of this section.
(3) 
No fee imposed in connection with a penalty enforcement or judicial proceedings shall be waived.
(4) 
This section shall not apply to any bond or surety required to ensure the faithful performance of a public obligation or repair to a public facility.
(5) 
This section shall not apply to any commercial or business activity.
(6) 
This section shall not apply to any land use or development fee imposed in conjunction with a Planning Board or Board of Adjustment application, except with regards to the alteration of any existing residence within the Township owned and occupied by a resident covered by this section.
(7) 
Fees for inspections shall not be waived unless the resident owns and occupies the property being inspected at the time of the request.
D. 
All individuals covered by this section shall be entitled to obtain a Hamilton Township identification card which shall be presented at the time of payment to validate the entitlement to the fee waiver. The identification card shall remain the property of the Township and shall be subject to forfeiture in the event it is used or attempted to be used for any purpose in violation of this section.
E. 
Township-awarded vendors at Township-sponsored indoor events may be excluded from fees as enumerated in § 215-11C at the discretion of the Township Business Administrator or their designee.
