Goodwin Park shall be open to the public from 8:00 a.m. to 5:00 p.m. from November 1 through March 30 and from 8:00 a.m. until 7:00 p.m. from April 1 through October 31.
No one shall make use of the park after dark or for a function sponsored by a private or public organization unless special permission is granted by the City Administrator. Such special permission shall be in writing and shall specify the date and hours of permitted use.
A. 
No person, group, association, corporation, unincorporated entity or partnership shall use Goodwin Park for any organized event, social event or otherwise without having received from the City of Seat Pleasant a permit for the use of Goodwin Park.
B. 
Payment for such permit shall be made to the City of Seat Pleasant.
C. 
The permit shall identify the permit holder by name, address and telephone number.
D. 
Application for a permit shall be made upon a form prescribed by the City.
E. 
Permits for use of the park may be issued only to citizens or organizations in the City of Seat Pleasant. A separate fee for permit shall be charged to nonresidents.
F. 
The fee for the permit shall be established by the City Council, payable in advance and upon issuance of the permit.
G. 
The permit shall expire at sunset on the day of the scheduled event.
H. 
It shall be unlawful for anyone to use the park for any act which is prohibited by federal, state, county or municipal laws.
I. 
The park shall not be used for any commercial purpose or for any profit-generated activities.
J. 
The City Administrator may revoke a permit issued under this chapter for any violation listed above.
K. 
Any permit that is revoked may be appealed to the City Council within 10 days of the revocation.
L. 
Each permit holder shall be responsible for the disposal of trash, debris, garbage and other refuse.
M. 
The City reserves the right to charge the permit holder for the cost of cleanup in the event that the permit holder fails to clean the permit area. The cost for cleanup shall be in addition to any other remedy available to the City and in addition to any fine imposed on the permit holder.
N. 
Anyone who violates a provision of this section shall be deemed guilty of a misdemeanor and, upon conviction, shall be subject to a fine of not less than $500 and not more than $1,000 and/or imprisonment of not more than six months for each violation.

A. 
The following are adopted as additional rules and regulations applicable to Goodwin Park:
(1) 
Persons in and on park property shall comply with all official signs and shall comply with the directions of authorized City individuals.
(2) 
Fires are allowed only in connection with the use of grills and in fire pits. The use of oil fryers and steamers in Goodwin Park is specifically prohibited; except that oil fryers and steamers may be used by commercially licensed vendors in connection with City-sponsored events.
(3) 
No person shall leave a fire, hot grill or hot ashes unattended at any time. "Unattended" shall mean that there is no responsible person at least 18 years old within 10 feet of the fire, hot grill or hot ashes.
(4) 
All fires must be extinguished prior to departure.
(5) 
The consumption of alcoholic beverages in Goodwin Park is prohibited. The sale of alcoholic beverages in Goodwin Park is prohibited as well.
(6) 
All trash shall be placed in appropriate containers.
(7) 
Animals, except for those dogs trained to assist the physically handicapped, are not allowed in Goodwin Park.
(8) 
Drivers of all vehicles in or on park property shall drive in a safe and careful manner at all times and shall comply with the signals and directions of City staff and all posted traffic signs.
(9) 
Motor vehicles shall be parked in designated parking areas only. At no time shall vehicles be parked on the grass, except for the purpose of loading and unloading near the pavilion area.
(10) 
Live entertainment is prohibited in the park without a special permit issued by the City.
B. 
Violations of this section, except for Subsection A(5), are municipal infractions, subject to a fine of $100. A municipal infraction for a violation of this section may be issued upon the observation of circumstances constituting a violation of this section by a City Code Enforcement Officer or a City police officer, or upon the submission of written complaints to the City, on an affidavit form obtained from the City, by at least two witnesses residing in separate households, each of whom must be at least 18 years of age and have personal knowledge of the alleged violation. A violation of § 116-5A(5) is a misdemeanor, punishable by a fine not exceeding $500 or imprisonment for 30 days.

A. 
The following are adopted as the rules and regulations applicable to the Seat Pleasant, A City of Excellence Fit and Fun Park:
(1) 
It is strongly recommended that park patrons read all instructions before using fitness equipment to avoid injury.
(2) 
The City does not assume liability for injuries.
(3) 
Park patrons shall be courteous of others when using fitness equipment.
(4) 
All children under 12 must be supervised by an adult when using any park equipment.
(5) 
All food and beverages shall only be consumed at the picnic table.
(6) 
All trash shall be deposited in trash receptacles.
(7) 
No public restrooms shall be provided.
(8) 
The park opens at dawn and closes at dusk.
(9) 
The following are prohibited in the park:
(a) 
Smoking;
(b) 
The use or distribution of alcohol or drugs;
(c) 
Gambling;
(d) 
Animals;
(e) 
Vehicles, including motorcyles, bicycles, mopeds, scooters, and tricyles;
(f) 
Solicitation of any kind;
(g) 
The posting of banners, signs or flyers, except for the City of Seat Pleasant organized events;
(h) 
Organized sports activities other than those for which the park is intended and designed;
(i) 
The defacing or destruction of park equipment or of the park's natural features;
(j) 
Loud music;
(k) 
Obscene or profane language; and
(l) 
The disposal of anything beyond the fence.
B. 
The City Administrator or his/her designee is authorized and directed to place appropriate signage at the park regarding the rules and regulations set forth in Subsection A.
