All garbage or refuse picked up and transported within the City
for compensation shall be handled only by licensed collectors.

No provision of this Article shall be construed to prevent any
householder or business establishment from transporting or disposing
of refuse or garbage which may accumulate on his/her own premises
or in connection with his/her own business; provided that disposal
of garbage or refuse shall be made in accordance with provisions set
forth hereinafter; and provided that such transportation shall be
made in such a manner as not to create any pollution, contamination
or public nuisance. The Director is hereby authorized to order any
householder or business establishment to discontinue any practice
which in his/her opinion causes any such pollution, contamination
or nuisance.

A. All
vehicles and/or containers used by licensed collectors shall be approved
by the Director who shall be empowered to establish rules and regulations
governing this type of equipment and the regulations promulgated hereunder
give consideration to difference in the requirements as between equipment
used for collection of garbage, the collection of refuse or the collection
of garbage and refuse.
B. All
rules and regulations promulgated by the Director pertaining to type
of vehicles or containers required shall be subject to appeal to the
Board of Aldermen who may sustain, reverse or amend such rules and
regulations.

A. Licensed
collectors shall not make any collections in residential areas or
within two hundred (200) feet of a residence except between the hours
of 7:00 A.M. and 6:00 P.M. Mondays through Saturdays only. Collection
in commercial areas shall start no earlier than 2:00 A.M. Mondays
through Saturdays only. Collections in educational areas shall start
no earlier than 5:00 A.M. Mondays through Saturdays only.
B. "Residential areas" are defined as areas of single-family
homes, duplex homes, multi-family homes, apartments and nursing homes.

Licensed collectors shall respect all property rights of private
individuals and not unduly trespass upon their property. Further,
such collector shall park his/her vehicle on the side of the street
so as to avoid unduly interfering with the free flow of traffic.

Licensed collectors shall not dispose of garbage and/or refuse
within the City limits.

A licensed collector may establish within the City a disposal
collection container where persons who do not desire to have their
garbage and refuse picked up at their homes or places of business
may carry such garbage and refuse to such container and dispose of
the same for a small charge. No licensed collector shall establish
such a refuse container without the prior approval of the Director
and the refuse container, if allowed, shall be of a design which is
watertight, to prevent the admission of flies and the emission of
noxious odors. These containers and the charges for depositing garbage
or refuse in the same shall be approved by the Director.

The use of refuse containers of a one (1) cubic yard or greater
capacity shall be restricted to premises for which a valid building
or demolition permit is in effect or where a permit is issued by the
Director of Codes Administration for cleanup unrelated to a building
or demolition permit. A permit to allow such a container on premise
for which a valid building or demolition permit is not in effect shall
not exceed a period of thirty (30) days. Such refuse containers shall
not be so located as to obstruct a City sidewalk, street, alley or
right-of-way without special permission of the Police Chief. Furthermore,
such refuse containers shall not be so located as to restrict off-street
parking to less than two (2) spaces. For the purpose of this Section,
a "parking space" shall be defined as a paved driveway
surface or a garage or carport.

It shall be unlawful for any person to engage in business as
a licensed collector within the City without first obtaining a license
to do so.

The provisions of Chapter
605 of this Code, insofar as the same may be applicable and not in conflict, shall apply to and govern the issuance of any license under the provisions of this Article.

The Director shall approve all applications of licenses required
by the provisions of this Article prior to issuance.
