No driver of any vehicle, including motorcycles, all-terrain vehicles and bicycles, shall cause, by excessive and unnecessary acceleration, the tires of such vehicle or cycle to spin and emit loud noises or to unnecessarily throw stones or gravel; nor shall such driver cause to be made by excessive and unnecessary acceleration any loud noise as would disturb the public peace.
A. 
Obstruction of railroad crossings. No person shall leave standing or stop or permit or allow to stand or stop any railroad train, engine or car upon any street, alley or highway crossing within the Village so as to obstruct public travel for a greater period of time than 10 minutes without opening said street, alley or crossing for at least 10 minutes. Any conductor, engineer, fireman or brakeman on any train or locomotive so obstructing any street, alley or railroad crossing or any yard master, flagman, switchman or section hand who shall allow and be responsible for such obstruction shall be subject to a penalty as provided in § 468-36 of this Code. The corporation running or operating such train, engine or cars so obstructing any street or railroad crossing shall be subject to a forfeiture of not more than $500.[1]

B. 
Crossing warning by trains. No person shall operate or permit to be operated a locomotive, railway train, engine or railway car over any graded street or highway crossing within the limits of the Village unless a whistle or horn shall be blown 80 rods (1,320 feet) from said crossing and a bell run continuously until the crossing shall be reached. The blowing of a whistle or horn and the ringing of a bell shall not be necessary where gates are operated automatically or a flagman is stationed at such traveled grade crossing. Any person violating this section shall be subject to a forfeiture as provided in § 468-36 of this Code.
A. 
Pedestrian obedience to traffic control devices and regulations.
(1) 
Obedience to traffic control devices. No person shall fail to obey the instructions of any Uniform Traffic Control Device when traveling as a pedestrian on any highway within the Village of Trempealeau unless otherwise directed by a law enforcement officer.
(2) 
Crossing at crosswalks. No pedestrian shall cross at a crosswalk except on the right half thereof whenever practicable. Where sidewalks are provided, no pedestrian shall walk along and upon an adjacent roadway except when the sidewalk is visibly unsafe, obstructed or closed to public travel.
B. 
Prohibited pedestrian crossings. No pedestrian shall cross between adjacent intersections, unless such crossing is permitted by Official Traffic Control Devices.
No person shall operate or park any motor vehicle on any pedestrian way or pedestrian overpass within the Village of Trempealeau except municipal or county maintenance vehicles.
A. 
Purpose.
(1) 
The unauthorized off-road operation of motor vehicles has resulted in serious damage to public and private lands, including damage or destruction of vegetation, animal life and improvement to the lands;
(2) 
The unauthorized off-road operation of motor vehicles has resulted in the permanent scarring of land and an increase in both erosion and air pollution;
(3) 
The unauthorized off-road operation of motor vehicles has resulted in collisions and near collisions threatening the life and safety of the operators of such vehicles as well as of other persons; and
(4) 
The unauthorized off-road operation of motor vehicles has resulted in a loss of the privacy, quietude and serenity to which the owners and users of land are rightfully entitled.
B. 
Definitions. For purposes of this section, the terms below shall be defined as follows:
MOTOR VEHICLE
For purposes of this section, any vehicle which is self-propelled and shall include but not be limited to automobiles, trucks, jeeps, vans, motorcycles, motorbikes, go-karts, motorized three-wheeled vehicles, all-terrain vehicles, mopeds, snowmobiles, dune buggies and tractors. "Motor vehicle" shall not mean any airplane, railroad train, boat, wheelchair or bicycle. A vehicle which would otherwise be defined as a motor vehicle under this section shall not be so defined while:
(1) 
It is being operated solely for the purpose of construction or maintenance of an improvement to land or solely for access to construction or maintenance sites, provided such operation is by persons having legitimate business on such lands or sites;
(2) 
It is being operated by or at the direction of public employees or utility company employees as part of their employment duties;
(3) 
It is being operated by the holder of an easement or right of access on or over the land on which operation is occurring or the holder's employees or agents.
OFF-ROAD
Any location which:
(1) 
Is not a paved or maintained public street or alley;
(2) 
Is not used or maintained by the owner or lessee of land as a driveway, parking lot or other way for motor vehicles; or
(3) 
Is a private trail for use only by the owner or his permittees for recreational or other vehicular use. "Off-road" shall not include any creekbed, riverbed or lake; provided, however, that this section shall not apply to snowmobiles or other vehicles being operated on the ice covering such creekbed, riverbed or lake.
OPERATION
The physical manipulation or activation of any of the controls of a motor vehicle necessary to put it in motion.
UNAUTHORIZED
Without the express prior consent of the owner, lessee, manager or other person authorized to give consent by the owner or lessee of land. Authorization shall not be implied from a failure to post private or public land.
C. 
Unauthorized off-road operation prohibited.
(1) 
The unauthorized off-road operation of a motor vehicle is prohibited.
(2) 
Except for authorized maintenance vehicles and snowmobiles operating in authorized areas pursuant to Chapter 427, Snowmobiles, it shall be unlawful to operate any minibike, go-kart, all-terrain vehicle or any other motor-driven craft or vehicle principally manufactured for off-highway use on the Village streets, alleys, parks, sidewalks, bikeways, parking lots or on any public lands or private lands or parking lots held open to the public. The operator shall at all times have the consent of the owner before operation of such craft or vehicle on private lands.
D. 
Prohibited use of snowmobile trails. Except as provided in the definition of "motor vehicle" in Subsection B above, no person shall operate any motor vehicle other than a snowmobile on a snowmobile trail.

A. 
Purpose. This section is adopted to promote the public health, safety, and general welfare of people in the Village of Trempealeau operating vehicles on property held open to the public for use of motor vehicles and of people located in the vicinity of property held open to the public for use of motor vehicles.
B. 
Scope. This section shall apply to all premises held open to the public for use by motor vehicles, whether such premises are publicly or privately owned and whether or not a fee is charged for the use thereof.
C. 
Rules for operating motor vehicles. The operator of a motor vehicle operating on premises held open to the public for use by motor vehicles must obey the following traffic regulations. The operator shall:
(1) 
Not exceed the posted limit when signs indicating the speed limit are erected by the maintenance authority in charge of the premises.
(2) 
Obey all traffic control signs and signals.
(3) 
When approaching a traffic control stop sign at an intersection of a private road and one or more private roads, highways, or driveways, cause such vehicle to stop before entering the intersection and yield the right-of-way to other vehicles which have entered or are approaching the intersection upon a highway, private road or driveway that is not controlled by a traffic control sign or signal or by an official traffic sign or signal.
(4) 
Not participate in any race or speed or endurance contest upon any driveway or private road.
(5) 
Driving on the left and right side of the highway.
(a) 
Upon all roadways of sufficient width, drive on the right half of the roadway except:
[1] 
When making an approach for a left turn under circumstances in which the rules relating to left turns require driving on the left half of the roadway;
[2] 
When overtaking and passing under circumstances in which the rules relating to overtaking and passing permit or require driving on the left half of the roadway;
[3] 
When the right half of the roadway is closed to traffic while under construction or repair; or
[4] 
When overtaking and passing pedestrians, animals or obstructions on the right half of the roadway.
(b) 
When operating a motor vehicle on the left half of the roadway pursuant to one of the exceptions described above, the driver shall exercise great care.
(6) 
Upon the approach of any authorized emergency vehicle giving audible signal by siren, yield the right-of-way and immediately drive such vehicle to a position as near as possible and parallel to the right curb or the right-hand edge of the shoulder of the roadway or private drive, clear of any intersection. Unless otherwise directed by a traffic officer, the operator shall stop and remain standing in such position until the authorized emergency vehicle has passed. This Subsection C(6) does not relieve the operator of an authorized emergency vehicle from the duty to drive with due regard under the circumstances for the safety of all persons using the highway, driveway, or private road.
(7) 
Comply with any lawful order, signal or direction of a traffic officer and not disobey the instruction of any traffic sign or signal unless otherwise directed by a traffic officer. No operator of a vehicle shall, after having received a visual or audible signal from a traffic officer, or marked police vehicle, knowingly flee or attempt to elude any traffic officer by willful or wanton disregard of such signal so as to interfere with or endanger the operation of the police vehicle, or the traffic officer or other vehicles or pedestrians, nor shall he increase the speed of his vehicle or extinguish the lights of his vehicle in an attempt to elude or flee.
(8) 
Not follow an authorized emergency vehicle responding to a call or alarm closer than 500 feet or drive into or park his or her vehicle within the block where, or within 300 feet of the driveway entrance or similar point of access to a driveway or road on which fire apparatus has stopped in response to an alarm. The personal vehicles of members of an official public safety department answering the alarm are considered on official business and are not subject to the restrictions imposed by this Subsection C(8).
(9) 
Unless given consent by the fire department official in command, not drive a vehicle over any unprotected hose of a fire department when such hose is laid down on any street, private driveway, or private road.
(10) 
When approaching from the front or rear of any school bus which has stopped on a roadway or private road, when the bus is equipped according to Wis. Stats. § 347.25(2) and when it is displaying flashing red warning lights, stop the vehicle not less than 20 feet from the bus and remain stopped until the bus resumes motion or the operator extinguishes the flashing red warning lights. The operator of any school bus which approaches from the front or rear any school bus which has stopped and is displaying flashing red warning lights shall display its flashing red lights while stopped.
(11) 
Not drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard for the actual and potential hazards then existing. The speed of a vehicle shall be so controlled as may be necessary to avoid colliding with any object, person, vehicle, or other conveyance on or entering the driveway or private road in compliance with legal requirements and using due care.
(12) 
Consistent with the requirements of Subsection C(11), drive at an appropriate reduced speed when approaching and crossing an intersection or railway grade crossing, when approaching and going around a curve, when approaching a hill crest, when traveling upon any narrow or winding roadway, when passing school children, roadway construction or maintenance workers or other pedestrians, and when special hazard exists with regard to other traffic or by reason of weather or roadway conditions.
D. 
Applicability. Citations for violations of this section shall only be issued for offenses committed on premises not covered by the traffic code provisions of the Wisconsin Statutes or otherwise by the Village's Code.
E. 
Citations. All citations for violations of this section shall be written as Village of Trempealeau municipal ordinance citations.
F. 
Enforcement and penalties.
(1) 
People who violate this section shall be subject to penalty upon conviction therefor as follows:

(2) 
Together with all court costs, fees, assessments, and charges imposed by Wisconsin law for violations of analogous state statutes. In addition to any forfeiture imposed by the court under this subsection, the court shall assess the corresponding penalty assessment imposed by Wis. Stats. § 757.05, the jail assessment imposed by Wis. Stats. § 302.46(1), the crime lab and drug law enforcement assessment imposed by Wis. Stats. § 165.755, and court costs imposed by Wis. Stats. § 814.65. Nothing in this section shall preclude or affect the power of the sentencing court to exercise additional authority granted by Wisconsin Statutes.[1]

G. 
Definitions. For the purpose of this section, the following words shall mean:
HIGHWAY
All public ways and thoroughfares and bridges on the same. It includes the entire width between the boundary lines of every way open to the use of the public as a matter of right for the purposes of vehicular travel. It includes those roads or driveways in the state, county, or municipal parks which have been opened to the use of the public for the purpose of vehicular travel and roads or driveways upon grounds of public schools, as defined in Wis. Stats. § 115.01(1), and institutions under the jurisdiction of the county Board of Supervisors, but does not include private roads or driveways as defined below.
MAINTENANCE AUTHORITY
The person or legal entity with the legal authority to control the private road or driveway.
MOTOR VEHICLE
A vehicle, including a combination of two or more vehicles or an articulated vehicle, which is self-propelled, except a vehicle operated exclusively on a rail.
OPERATOR
A person who drives or is in actual physical control of a vehicle.
PRIVATE ROAD OR DRIVEWAY
Is every way or place in private ownership and used for vehicular travel only by the owner and those having express or implied permission from the owner § 340.01(46).
ROADWAY
That portion of a highway or private road or driveway between the regularly established curblines or that portion which is improved, designed or ordinarily used for vehicular travel, excluding the berm or shoulder. In a divided private road, the term "roadway" refers to each roadway separately but not to all such roadways collectively.
STREET
Every highway within the corporate limits of the Village, except alleys.
TRAFFIC CONTROL SIGN OR SIGNAL
A sign or signal erected by the maintenance authority in charge of the premises to control traffic on the premises.
Pursuant to § 349.215, Wis. Stats., those adult persons hired by the Police Department to act as "school crossing guards" shall have the authority to stop vehicular traffic and to keep it stopped as long as necessary at their respective school crossings for the purpose of permitting school children to cross the street.
A. 
Driving over curbing prohibited. It shall be unlawful for any motor vehicle to be driven or backed over any curbing in the Village of Trempealeau.
B. 
Driving over safety zones or islands prohibited. Whenever safety zones or safety islands are marked in accordance with the Wisconsin Uniform Traffic Control Device Manual, no operator of a vehicle shall at any time drive through or over a safety zone or safety island.

A. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
ATVS
Has the meaning given under § 340.01(2g), Wis. Stats.
AUTHORIZED VEHICLES
ATVs, UTVs, NEVs, and golf carts.
GOLF CARTS
Has the meaning given under § 23.33(1)(fm), Wis. Stats.
NEIGHBORHOOD ELECTRIC VEHICLES (NEVS)
A self-propelled, electrically powered motor vehicle that has successfully completed the Neighborhood Electric Vehicle America test program conducted by the Federal Department of Energy and that conforms to the definition and requirements for low-speed vehicles as adopted in the Federal Motor Vehicle Safety Standards for "low-speed vehicles" under 49 CFR 571.3(b) and 571.500. NEVs shall be four-wheeled and have a speed range of at least 20 miles per hour on a paved surface and have a gross vehicle weight at rest of less than 3,000 pounds. NEV does not include an electric golf cart. NEVs shall meet the general test conditions under 49 CFR 571.500 S6. NEVs shall be equipped with:
(1) 
Headlamps;
(2) 
Front and rear turn signals;
(3) 
Stop lamps;
(4) 
Reflex reflectors: one red on each side as far to the rear of the vehicle as practicable, and one red on the rear;
(5) 
An exterior mirror mounted on the driver's side and either an exterior mirror on the passenger side or an interior rearview mirror;
(6) 
Parking brake;
(7) 
A windshield that conforms to the requirements of the Federal Motor Vehicle Safety Standard on glazing materials (49 CFR 571.205);
(8) 
A vehicle identification number (VIN) that complies with 49 CFR 565; and
(9) 
A Type 1 or Type 2 seat belt assembly conforming to 49 CFR 571.209, and Federal Motor Safety Standard No. 209, for each designated seating position.
UTVS
UTV has the meaning given under § 23.33(1)(ng), Wis. Stats.
B. 
Permitted use of authorized vehicles on Village streets. Any individual may operate an authorized vehicle on Village streets, connecting highways, and state trunk highway intersections of the Village having a posted speed limit of 35 miles per hour or less. If vehicle specifications are less than 35 miles per hour, the applicant is required to place a slow-moving vehicle sign on the vehicle.
C. 
Permitted users of authorized vehicles. To use an authorized vehicle on streets as set forth in Subsection B above, the operator of the vehicle must have a valid driver's license.
D. 
Operation of authorized vehicles. The operation of authorized vehicles as permitted in this section shall comply in all respects with federal, state, and local laws, including but not limited to this chapter.
E. 
License. Except for golf carts, authorized vehicles shall be licensed by the Wisconsin Department of Transportation in accordance with appropriate Wisconsin statutes, as amended and superseded. The license shall be displayed in the rear window of the authorized vehicle and if no rear window, then in a clear plastic waterproof holder hung from the rear of the top of the authorized vehicle.
F. 
Title. Except for golf carts, authorized vehicle owners shall be required to obtain a certificate of title from the Wisconsin Department of Transportation for each authorized vehicle.
G. 
Enforcement. Unless otherwise provided by the Uniform State Traffic Deposit Schedule, the penalty for the unauthorized use of an authorized vehicle within the Village shall be $50 per occurrence, plus additional costs and penalties.
