A. A certain document, one (1) copy of which is on file in the office of the City Clerk of the City of Byrnes Mill, being marked and designated as the International Building Code, 2021 Edition, as published by the International Code Council Inc., is hereby adopted as the Building Code of the City of Byrnes Mill, Missouri, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code are hereby referred to, adopted and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes, if any, prescribed in Section
500.020 of this Article.
B. Penalty. Any person violating any of the provisions of the Code adopted
in this Section shall be deemed guilty of an ordinance violation and
upon conviction thereof shall be fined in an amount not exceeding
five hundred dollars ($500.00) or be imprisoned in the City or County
Jail for a period not exceeding ninety (90) days, or both such fine
and imprisonment. Each day such violation is committed or permitted
to continue shall constitute a separate offense and shall be punishable
as such hereunder.

A. The following Sections of the International Building Code, 2021 Edition,
are hereby revised as follows:
1. Section 101.4.6 Delete reference to the International Energy Code.
101.4.6 Energy. The provisions of the International Energy Conservation
Code shall apply to all matters governing the design and construction
of buildings for energy efficiency.
2. Section 105.2 Delete exception #2 and change to fences not over six
(6) feet tall.

3. Section 406.3.2.1 change to read 5/8-inch Gypsum Board Type X between
garage and building.
406.3.2.1 Dwelling unit separation. The private garage shall

gypsum board, not less than 1/2 inch (12.7 mm) in thickness, applied
to the garage side.

are hereby referred to, adopted and made a part hereof, as if fully
set out in this Section.
B. Penalty. Any person violating any of the provisions of the Code adopted
in this Section shall be deemed guilty of an ordinance violation and
upon conviction thereof shall be fined in an amount not exceeding
five hundred dollars ($500.00) or be imprisoned in the City or County
Jail for a period not exceeding ninety (90) days, or both such fine
and imprisonment. Each day such violation is committed or permitted
to continue shall constitute a separate offense and shall be punishable

are hereby revised as follows:

Section 114 Board of Appeals: Delete and reword to be the Board
of Alderpersons.
114.1 Membership of board. The board of appeals shall consist
of five members appointed by the chief appointing authority as follows:
one for 5 years; one for 4 years; one for 3 years; one for 2 years
and one for 1 year.
2.

500.065 of this Chapter.

in this Section shall be deemed guilty of an ordinance violation and

For the purpose of the protection of the public health, safety and welfare with respect to establishing minimum standards for buildings used for dwelling purposes, there is hereby adopted the International Property Maintenance Code, 2021 Edition, as published by the International Code Council Inc., and same is hereby adopted as the Property Maintenance Code of the City of Byrnes Mill, Missouri and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code are hereby referred to, adopted and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes, if any, prescribed in Section
500.073 of this Chapter. One (1) copy of the Property Maintenance Code adopted in this Section shall be on file in the office of the City Clerk of the City for public inspection.
B. Penalty. Any person violating any of the provisions of the Code adopted
in this Section shall be deemed guilty of an ordinance violation and
upon conviction thereof shall be fined in an amount not exceeding
five hundred dollars ($500.00) or be imprisoned in the City or County
Jail for a period not exceeding ninety (90) days, or both such fine

A. The
following Sections of the Property Maintenance Code, 2021 Edition,
are hereby revised as follows:
1. Section 302.4 Insert wording “in excess of nine (9) inches."
302.4 Weeds. Premises and exterior property shall be maintained
free from weeds or plant growth in excess of [JURISDICTION TO INSERT
HEIGHT IN INCHES]. Noxious weeds shall be prohibited. Weeds shall
be defined as all grasses, annual plants and vegetation, other than
trees or shrubs provided; however, this term shall not include cultivated
flowers and gardens. Upon failure of the owner or agent having charge
of a property to cut and destroy weeds after service of a notice of
violation, they shall be subject to prosecution in accordance with
Section 109.3 and as prescribed by the authority having jurisdiction.
Upon failure to comply with the notice of violation, any duly authorized
employee of the jurisdiction or contractor hired by the jurisdiction
shall be authorized to enter upon the property in violation and cut
and destroy the weeds growing thereon, and the costs of such removal
shall be paid by the owner or agent responsible for the property.

A certain document, one (1) copy of which is on file in the office of the City Clerk of the City of Byrnes Mill, being marked and designated as the International Fire Code, 2021 Edition, as published by the International Code Council Inc., is hereby adopted as the Fire Code of the City of Byrnes Mill, Missouri, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code are hereby referred to, adopted and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes, if any, prescribed in Subsection
(C) of this Section.
B. Penalty. Any person violating any of the provisions of the Code adopted
in this Section shall be deemed guilty of an ordinance violation and
upon conviction thereof shall be fined in an amount not exceeding
five hundred dollars ($500.00) or be imprisoned in the City or County
Jail for a period not exceeding ninety (90) days, or both such fine
and imprisonment. Each day such violation is committed or permitted
to continue shall constitute a separate offense and shall be punishable

C. Additions, Insertions, Deletions And Changes. The following Sections
of the International Fire Code, 2021 Edition, are hereby revised as
follows:

Section 101.1 Title: Insert the City name.
2.
Section 103 Code Compliance Agency. Delete in entirety.
3.
Section 104: Duties And Powers Of The Fire Code Official.
Rename: Duties and Powers of the Code Official (wherever the
wording Fire Code Official is found to be changed to Code Official).
4.
Section 105.1.2 Types of permits. Delete Operational Permit.
105.1.2 There shall be two types of permits as follows:
1. Operational permit. An operational permit allows the applicant
to conduct an operation or a business for which a permit is required
by Section 105.5 for either:
1.1. A prescribed period.
1.2. Until renewed or revoked.

Section 105.2.2 Inspections authorized: Delete in its entirety.
6.
Section 105.1.3 Permits for the same location: Delete in its
entirety.
7.
Sections 105.5 to section 106 Required operational permits:
Delete in its entirety.
8.
Section 111.1 Board of Appeals: Change to read:
The Board of Appeals shall consist of the Board of Adjustment as prescribed in Title IV, Chapter
400 Article
XXII of the Municipal Code of the City of Byrnes Mill.
9.
Section 112.4 Violation and Penalties: change to read:
Persons who shall violate a provision of this code or shall
fail to comply with any of the requirements thereof or who shall erect,
install, alter, repair or do work in violation of the approved construction
documents or directive of the code official, or of a permit or certificate
used under provisions of this code, shall be guilty of an ordinance
violation punishable by a fine of not more than five hundred dollars
($500.00) or by imprisonment not exceeding ninety (90) days in jail,
or both such fine and imprisonment. Each day that a violation continues
after due notice has been served shall be deemed a separate offense.
10.
Section 307.1 – 307.5 Open Burning: delete wording and
insert:
Open burning shall be conducted in accordance with the Missouri
Department of Resources 10CSR10-6.045.

Adoption of the Fire Prevention Code as set out in Section
500.080 will therefore join the City with the High Ridge Fire Protection District to allow their inspection of buildings within the City as needed for compliance with the IBC Codes.

The City does not issue building permits in relation to the
Fire Prevention Code; however, the City does hereby encourage all
its citizenry to comply with all codes required by the Fire Protection
District.

It shall be the policy of the City to work with the appropriate
Fire Protection District for the purpose of fire prevention.

The City shall not charge the Fire Protection District for any
water usage or cost of maintenance of City-owned fire hydrants in
its duties, excluding domestic water at the various stations, which
shall be charged at the normal rate as provided for by this Code,
and, in return, the Fire Protection District shall not charge the
City for any fire permits that may be needed within the City-owned
buildings or future buildings.
