[R.O. 2011 §700.440; Ord. No. 150-90 §X, 3-7-1990; Ord.
No. 406-97 §I, 3-5-1997; Ord. No. 937-21, 3-3-2021]
A. Upon
the permanent discontinuance of the use of the sewage system at any
premises, including discontinuance caused by abandonment of any premises,
tearing down of any building or any other cause, the property owner
shall cause the connection to the sewer main to be plugged in a manner
which will be strong enough to resist breakage and be water-tight
enough to prevent any leakage of any fluids. All such plugging shall
be subject to inspection and approval by the Code Enforcement Officer
of the City, the inspection fee being sixty-four dollars ($64.00).
B. If
the owner of the property fails to plug the sewer connection in a
satisfactory manner within thirty (30) days of the time the owner
is notified in writing by the Code Enforcement Officer to plug the
sewer service line, the City shall proceed to plug the service line
and bill the owner for the costs. The cost may be collected by the
City and a civil action filed in court. The collection of the costs
in a civil action shall not prevent the filing of an action for a
fine for violation of this Chapter.
