A. Definitions. As used herein, the following
terms shall have the following meanings:
CITY
The City of Battlefield, Missouri, acting through its Board
of Aldermen or its City Administrator.
CITY HALL
Includes that building, and those improvements, located at
5434 South Tower Drive, Battlefield, Missouri, including the Police
Department, community room, Municipal Court, municipal offices together
with all sidewalks, parking lots, other paved areas and other improvements
adjacent to and appurtenant to said building.
CITY PARK
Includes all of that area adjacent to City Hall which comprises
the City's park, including all unimproved areas, walking trails, tennis
courts, basketball courts, ballfields, apparatuses and items of personal
property located thereon or therein.
EPAMD
Any electrical personal assistive mobility device as may
be described or defined in Section 307.205 et seq., RSMo.
MOTORIZED PLAY VEHICLE
Includes any motorcycle, pocket bike, motorized scooter,
go-cart or other self-propelled vehicle equipped with an electric
motor or an internal combustion engine with piston disbursement of
less than fifty (50) cubic centimeters and which has two (2) or more
wheels and a seat or operating platform with a height of less than
twenty-seven (27) inches when measured from the lowest point of the
seat or operating platform and is otherwise ineligible for a State
certificate or title.
MUNICIPAL COMPLEX
Includes the City park and City Hall as those terms are herein
defined.
B. Hours Of Operation. Except as otherwise
may be authorized by the City, in writing, the hours of operation
of the City park shall be from 5:30 A.M. to 11:00 P.M. during the
months of March through October and from 6:00 A.M. to 9:00 P.M. during
the months of November through February. Anyone found within the City
park at any time other than during the hours of operation as set forth
herein may be charged with the offense of trespassing and, upon conviction,
shall be punished in accordance with the general penalty provision
of this Code of Ordinances.
C. Alcohol Use And Amplification Devices Prohibited
— Exceptions. Possession or the use of alcohol or the use of
an amplification device anywhere within the municipal complex is prohibited,
except that an amplification device may be used at specified locations
within the municipal complex if prior written approval has first been
obtained from the City. Persons convicted of violating the provisions
of this Subsection shall be punished in accordance with the general
penalty provision of this Code of Ordinances.
D. Use Of Skateboards, Skates, Etc. Prohibited
— Exceptions. The use of operation of skateboards, skates, roller
blades, bicycles, tricycles, motorized play vehicles or motor vehicles
of any kind upon any sidewalk within the municipal complex or anywhere
within the City park is prohibited; provided, however, that the provisions
of this Section shall not apply to any EPAMD, nor shall the provisions
hereof apply to the use or operation of any bicycle, tricycle or battery
powered play vehicle in the City park by a child under the age of
twelve (12) years, where such child is accompanied by a parent or
other adult supervisor. Persons violating the provisions of this Subsection
shall, upon conviction, be punished in accordance with the general
penalty provision of this Code of Ordinances.
