Upon failure of any property owner, agent, or assign to timely
complete work, the Borough may, at its option, cause the required
work to be done at the cost of the property owner, and the Borough
may collect the cost thereof plus 10%, together with all charges and
expenses, from such property owner and may file a municipal claim
therefor or collect the same by action in assumpsit pursuant to 8
Pa.C.S.A. § 101 et seq., as amended.
Curbs shall be formed to minimize small lengths. Any curb requiring
replacement shall be replaced in sections having a minimum length
of five feet, unless otherwise approved, in writing, by the Borough
official.
Where new work abuts existing work that does not conform to
the required slope or dimensional criteria set forth in this chapter,
the Borough official may require additional curb, sidewalk or apron
to be removed, so that a transition section can be installed between
the new work and existing feature. Where transitions are utilized,
expansion joint shall be placed on both sides of the transition to
facilitate future removal. Where a transition crosses a property line,
permission should be obtained from the adjacent property owner prior
to the commencement of work on the adjacent property. In the event
permission of the adjacent property owner cannot be obtained, and
the work is performed in a Borough right-of-way, the Borough official
shall establish the limits of work and line and grade requirements.
