Any condition of a curb, sidewalk or driveway apron, or portion
thereof, which, in the opinion of the Borough Code Official is rendered
unserviceable by virtue of its condition or presents a hazardous condition,
including, without limitation, the existence of any of the following
conditions, shall be reason for replacement:
A. Tripping hazard. Elevation (vertical) differences of 1/2 inch or
more.
B. Structural failure. Each of the following constitutes structural
failure: cracks over 1/4 inch wide; cracks over one foot in length;
or any section of a curb, sidewalk or driveway apron which is cracked
in three or more places.
C. Curb misalignment. Each of the following constitutes misalignment:
front face of curb misalignment by more than 1/2 inch at any point;
front face of a curb leaning into the cartway more than 1/2 inch at
any point; or any section of curb misaligned at the top of the curb
more than 1/2 inch at any joint.
D. Improper grade. Any sidewalk, driveway apron, curb or transition
point which is in a state of disrepair, settlement or heaved, which
impedes water from draining across the surface of the sidewalk, driveway
apron or curb, including, without limitation, uneven surfaces caused
by trees or tree roots.
E. Improper surface conditions. Any sidewalk or driveway apron where
40% or more of the surface area has deteriorated, or any curb where
25% or more of the surface area has deteriorated.
