A. 
City parks shall be open to the public every day of the year from dawn to dusk, subject to the following exceptions:
1. 
Park(s) may be closed during unusual and/or unforeseen emergencies.
2. 
Those sections or parts of parks declared closed to the public by the Chairman of the City Park and Recreation Board in accordance with Chapter 230 Article III of the Code.
3. 
Park hours may be extended as authorized by City Park and Recreation Board permit in accordance with Chapter 230 Article III of this Code.
4. 
Park hours may be extended for pavilion rentals, park rentals, festivals, events or other activities approved by the City Park and Recreation Board.
5. 
Park hours are extended until 11:00 P.M. daily at lighted sports courts in accordance with Chapter 230 Article III of this Code.
6. 
Fishing at West City Park in accordance with Chapter 230 Article III of this Code.
The opening and closing times for each individual park shall be posted therein for public information.

Any section or part of any park may be declared closed to the public by the Chairman of the Park Board at any time and for any interval of time, either temporarily or at regular and stated intervals (daily or otherwise) and either entirely or merely to certain hours, as the Chairman of the Park Board shall find reasonably necessary.

No person shall climb or be upon any building, shed, table, bench or other structure of any kind in any City park.

No person shall damage, deface or destroy any building, shed, table, bench, post, tree, shrub or any plant of any kind or character in any City park.

No person shall drive, operate or park any vehicle of any kind or character in, upon or across any part of any City park other than the roads or driveways provided and maintained in such part for the use of vehicles.

It shall be unlawful for any person to operate any kind of motor vehicle, including motorcycles and motor bicycles of any types, sizes and kinds, in any of the City parks or City park areas of the City, except on the main roads or roadways in such parks and park areas. All speed limits must be obeyed.

A. 
It shall be unlawful for any person, while in or about any City park, to:
1. 
To have or cause to be brought in keg or draught beer of any kind, with the exception of parties and functions specifically authorized by the Park Board and granted a permit under the provisions of this Chapter. The foregoing shall not apply to the licensed sale of five percent (5%) keg or draught beer by a concessionaire of the City operating under the supervision of the Festus Park Board.
2. 
Have a beverage cooler of any type at the West City Park baseball field complex at any time when the officially designated concession stand is open to the public.
3. 
Have entered or be under the influence of intoxicating liquor.
4. 
Drink or consume alcoholic beverages who has not attained the age of twenty-one (21) years of age.

A. 
Limitations On Fish. The limits on fish for the ponds located at West City Park shall be as follows:
1. 
Three (3) bass with a fifteen (15) inch minimum per fish.
2. 
Five (5) catfish.
3. 
Ten (10) fish total aggregate.
B. 
Hours. The hours allowed for fishing shall be twenty-four (24) hours per day so long as users park vehicles in designated parking spaces outside gates to the park.
C. 
State License Required. A State of Missouri fishing license is required.
D. 
Stocking Prohibited. There shall be no stocking of any kind of fish allowed in the ponds by private parties.
E. 
Bait And Tackle Restricted. There shall be no minnows used for bait while fishing in the ponds and there shall be rod and reel fishing only.

There shall be no littering in the water or grounds, no wading, no swimming, no ice skating, no boats or boating or any form of molesting wildlife allowed at the ponds at West City Park.

A. 
It shall be unlawful for any person to use or occupy the tennis courts located in Sunset Park for any purpose other than that of tennis-related activities.
B. 
Prohibited activities shall include baseball, corkball, roller hockey, in-line or roller skating and ice skating and any other activity which may result in damage to court surface and/or fencing.
C. 
Violation of this restriction may result in removal from park grounds or restriction of future use of park grounds.

A. 
It shall be unlawful for any person to use or occupy the basketball courts located in the Festus City parks for any purpose other than that of basketball-related activities.
B. 
Violation of this restriction may result in removal from the park grounds or restriction of future use of park grounds.

The City of Festus Park Board is hereby authorized to offer a one thousand dollar ($1,000.00) reward upon conviction of vandalism at any City park.

A. 
Safety Helmets Required. Operation of skateboards, roller skates, coasters, bicycles and any other similar device without special headgear (safety helmets) shall be an offense. All persons using the skatepark shall be required to wear safety helmets.
B. 
The Police Officers of the City are hereby authorized to impound skateboards, roller skates, coasters, bicycles and any other similar device used by any individual at the skatepark that is in violation of this Section and retain possession of same until such time as released by the City court or to the parent or guardian of the violator, when that parent or guardian shall appear at the Police Department and claim such.
C. 
Enforcement.
1. 
First (1st) offense. Twenty-five dollar ($25.00) fine and/or warning.
2. 
Second (2nd) offense.
a. 
One hundred dollar ($100.00) fine and/or ejection from the skatepark.
b. 
Impounding of skateboard, roller skates, coasters, bicycles or any other similar device used at the skatepark.
c. 
Banned from using skatepark for fourteen (14) days.
D. 
Minors Usage Of Skatepark. If a minor is in violation of this Section, then said minor's parent or guardian shall be notified and given a warning when they shall appear to retain said minor's skateboard, roller skates, coasters, bicycles or any other similar device used at the skatepark; that warning will include notice that any further violations by the minor will result in the parent or guardian being charged with the offense of endangering the welfare of a child pursuant to the Revised Ordinances of the City of Festus, Section 210.050.
