A. 
Any change in land use, division of land by sale, creation of an access serving more than one (1) parcel or general grading of an undeveloped tract in the preparation of a site for development that results in the alteration of the topography by one (1) foot or more for:
1. 
Any residentially zoned parcel of land;
2. 
Any non-residential use where the property is vacant or proposed for resubdivision;
3. 
Any resubdivision of a lot of record;
4. 
Any commercial or industrial leasehold of land involving improvements or structures.

A. 
The provision of these regulations do not apply and no plat is required in any of the following instances:
1. 
The sale of burial plots for cemetery usage;
2. 
The conveyance of parcels of land or interests therein for use as right-of-way for railroads, public utility facilities and pipelines, any of which do not involve any new streets or easements of access;
3. 
The conveyance of land for highway or other public purpose or grants or conveyances relating to the vacation of land impressed with a public use; or
4. 
Conveyances made to correct the description of prior conveyances.

Land unsuitable for subdivision or development due to drainage, flood hazard area, steep topography, geological formation and thus not capable of supporting the proposed development or any other physical conditions constituting significant danger to health, life, safety or property shall not be approved for subdivision and development unless the subdivider presents evidence satisfactory to the City establishing that the methods proposed to mitigate such conditions are adequate to avoid significant danger to health, life, safety or property.

The City may submit, or require the developer to submit, proposed plats to various selected agencies for review and comment. Comments from other reviewing agencies shall be part of the public record relating to the particular subdivision request.
