An "Economic Development Tax Board" for the City of Edmundson,
Missouri is hereby established as an advisory body to the Mayor and
the Board of Aldermen.

The Economic Development Tax Board shall be a volunteer board
and the members of which shall receive no compensation.

A. The
Economic Development Tax Board shall be considered an advisory body
to the Mayor and the Board of Aldermen; the Board shall have no authority
beyond the authority to consider and make recommendations regarding
certain matters which are specifically set forth in this Article or
in Section 67.1305, RSMo.
B. The
Board shall have no operating budget and shall have no authority with
regard to the final determination on the use and expenditure of any
funds of the City including revenue derived from the economic development
sales tax.

A. The
Board shall consist of five (5) voting members to be appointed as
follows:
1. One (1) member shall be appointed by the school districts included
within any economic development plan or area funded by the sales tax
authorized by and imposed under authority of Section 67.1305, RSMo.
Such member shall be appointed in any manner agreed upon by the affected
districts.
2. Three (3) members shall be appointed by the Mayor of Edmundson with
the consent of the majority of the Board of Aldermen.
3. One (1) member shall be appointed by the County Council of St. Louis
County.
B. In
order to stagger the terms of such members, three (3) members shall
be appointed for an initial term of two (2) years and while the remaining
two (2) members shall be appointed for an initial term of four (4)
years. Following the initial terms, the term of office for all members
shall be four (4) years. The two (2) members appointed by the school
district and the County and one (1) member appointed by the Mayor
shall serve an initial term of two (2) years. The remaining two (2)
members appointed by the Mayor shall serve an initial term of four
(4) years.

The Mayor and one (1) member of the Board of Aldermen, selected
by the Board of Aldermen, may sit with the Economic Development Tax
Board and participate with regard to consideration and review of matters
before the Board; however, neither the Mayor nor the member of the
Board of Aldermen shall have a vote in any matter before the Tax Board.

A. The
Economic Development Tax Board, subject to approval of the Board of
Aldermen and Mayor, shall consider economic development plans, economic
development projects, or designations of an economic development area.
B. In
conjunction with the Tax Board's consideration of such matters, the
Economic Development Tax Board shall hold public hearings and provide
notice to the public of any such hearings.
C. Within
thirty (30) days following completion of the hearing on any plan,
project or area designation, the Board shall vote on all proposed
economic development plans, economic development projects or designation
of an economic development area, and amendments thereto.
D. The
Tax Board shall make its recommendations to Board of Aldermen within
ninety (90) days of the public hearing concerning the adoption of
or amendment to economic development plans, economic development projects,
or designations of an economic development area.
E. The
Board of Aldermen shall have the final determination as to economic
development plans, economic development projects, designations of
economic development area, or the use and expenditure of any funds
received from the tax imposed by authority of Section 67.1305, RSMo.,
however, no funds imposed by authority of Section 67.1305, RSMo.,
shall be expended unless and until recommendation is first sought
from the Economic Development Tax Board and such expenditure has been
approved by the Governing Body of the City of Edmundson.
F. With
regard to consideration of plans, projects and areas before it, the
Economic Development Tax Board may consider plans, projects and areas
with include areas outside the boundaries of the City of Edmundson
only if:
1. The City of Edmundson will receives significant economic benefit
from the plan, project, or area designation; and
2. There has been established an agreement between the governing bodies
of each City and County in which the plan, project, or area designation
is located detailing the authority and responsibilities of each Governing
Body with regard to the plan, project or area designation.

The Economic Development Tax Board shall report at least annually
to the Mayor and Board of Aldermen on the use of the funds provided
under this Section and on the progress of any plan, project or designation
adopted by the Board of Aldermen and shall make such report available
to the public.
