As used in this Chapter, the following terms shall mean:
BICYCLE
Every vehicle propelled solely by human power upon which
any person may ride, having two (2) tandem wheels, or two (2) parallel
wheels and one (1) or two (2) forward or rear wheels, all of which
are more than fourteen (14) inches in diameter, except scooters and
similar devices.
MOTORIZED BICYCLE OR SCOOTER
Any two- or three-wheeled device having an automatic transmission
and a motor with a cylinder capacity of not more than fifty (50) cubic
centimeters, which produces less than three (3) gross brake horsepower
and is capable of propelling the device at a maximum speed of not
more than thirty (30) miles per hour on level ground. A motorized
bicycle shall be considered a motor vehicle for purposes of any homeowners'
or renters' insurance policy.
MOTORIZED PLAY VEHICLE
Includes mini-motorcycles, pocket bikes, and any other vehicle
that is capable of transporting a person or persons at a speed in
excess of five (5) miles per hour; that is self propelled by a motor
or engine and that is not otherwise defined by Missouri Statutes or
the Edmundson City Code as a motor vehicle, motorcycle, bicycle or
motorized bicycle.
VEHICLE
Any mechanical device on wheels designed primarily for use
or used on highways, except motorized bicycles, motorized scooters,
motorized play vehicles, vehicles propelled or drawn by horses or
human power, or vehicles used exclusively on fixed rails or tracks,
cotton trailers or motorized wheelchairs operated by handicapped persons.

No person shall ride on or operate a motorized scooter or motorized
play vehicle upon any street, highway, roadway or sidewalk with the
City of Edmundson. No person shall ride on or operate a motorized
scooter or motorized play vehicle upon any property or park land owned
or operated by the City of Edmundson.
Every bicycle and motorized bicycle shall be equipped with a
brake or brakes which will enable its driver to stop the bicycle or
motorized bicycle within twenty-five (25) feet from a speed of ten
(10) miles per hour on dry, level, clean pavement.
Every person riding a bicycle or motorized bicycle upon a street
or highway shall be granted all of the rights and shall be subject
to all of the duties applicable to the driver of a vehicle as provided
by Chapter 304, RSMo., and this Title, except as to special regulations
in this Chapter, and except as to those provisions of Chapter 304,
RSMo., and this Title, which by their nature can have no application.

Every person operating a bicycle or motorized bicycle at less
than the posted speed or slower than the flow of traffic upon a street
or highway may ride in the center of the right lane of travel or may
ride to the right side of the roadway; such person may move into the
left lane of travel only while in the process of making a left turn.
Every person operating a bicycle or motorized bicycle on a roadway
shall exercise due care when passing a standing vehicle or one proceeding
in the same direction, when making turns, and when streets or lanes
are too narrow to share with vehicles. Bicyclists may ride abreast
only when not impeding other vehicles.
The operator of a bicycle shall signal as required in Section
340.180 of this Title, except that a signal by the hand and arm need not be given continuously if the hand is needed to control or operate the bicycle. An operator of a bicycle intending to turn the bicycle to the right shall signal as indicated in Section
340.180 of this Title or by extending such operator's right arm in a horizontal position so that the same may be seen in front and in rear of the vehicle.
Any person seventeen (17) years of age or older who violates
any provision of this Chapter is guilty of an ordinance violation
and, upon conviction thereof, shall be punished by a fine of not less
than five dollars ($5.00) nor more than twenty-five dollars ($25.00).
If any person under seventeen (17) years of age violates any provision
of this Chapter in the presence of a Police Officer, said officer
may impound the bicycle or motorized bicycle involved for a period
not to exceed five (5) days upon issuance of a receipt to the child
riding it or to its owner.
No person shall operate a motorized bicycle on any highways,
streets or roads in this City unless it is equipped in accordance
with the minimum requirements for construction and equipment of MOPEDS,
Regulation VESC-17, approved July, 1977, as promulgated by the Vehicle
Equipment Safety Commission.

A. Definitions. As used in this Section, the following terms
shall have these prescribed meanings:
BICYCLE
Shall also mean "scooter" as it relates to this Section.
ROLLER BLADES
Skates worn on the feet propelled by a row of wheels (also
called in-line skates).
SCOOTER
A device that typically has one (1) front set and one (1)
rear set of wheels with a footboard between, steered by a handlebar
and propelled either by pushing one (1) foot against the ground while
resting the other foot on the footboard, or by a motor.
SKATEBOARD
A device that typically has one (1) front set and one (1)
rear set of wheels with a footboard between and is propelled by pushing
one (1) foot against the ground while resting the other foot on the
footboard.
B. Use Of Helmets. It shall be unlawful for a parent or guardian
to permit a child under the age of seventeen (17) to operate or be
a passenger on any bicycle, non-motorized scooter, roller blades,
roller skates or skateboard without protective headgear which properly
fits and is fastened securely upon the head of the operator or passenger.
Said headgear, also known as a bicycle helmet, shall meet or exceed
the impact standard for protective bicycle helmets or set by Safety
Commission, or The American National Standards Institute.
C. Motorized Scooters. The operation of non-licensed motorized
scooters on public streets and sidewalks within the City of Edmundson
is hereby prohibited.
D. Traffic Laws To Apply. Every person operating or riding
a bicycle, scooter, roller blades, roller skates and skateboards upon
a roadway, street or alleyway is granted all of the rights and is
subject to all of the duties applicable to the driver of a vehicle
by the laws of this State and City declaring rules of the road applicable
to the driver of a vehicle, except as to special regulations of this
Chapter, and except as to those permission of law and ordinance which
by their nature can have no application.
1. Any person operating a bicycle, scooter, roller blades, roller skates
or skateboard shall obey the instruction of official traffic control
devices applicable to vehicles, unless otherwise directed by a Police
Officer.
2. Every person operating or riding on a bicycle, scooter, roller blades,
roller skates or skateboard shall ride as near to the right side of
the roadway or street as practicable and shall exercise due care when
passing a standing vehicle or one proceeding in the same direction.
3. Persons riding bicycles, scooters, roller blades, roller skates or
skateboards upon a road or street shall not ride more than two (2)
abreast.
4. The operators of a bicycle, scooter, roller blades, rollerskates
or skateboard emerging from an alleyway, private roadway, driveway
or sidewalk shall, upon approaching a sidewalk, yield the right-of-way
to all pedestrians on the sidewalk or sidewalk area. Upon entering
a highway, roadway or street, the operator shall yield the right-of-way
to all vehicles approaching on the highway, roadway or street.
5. No person operating a bicycle or scooter shall carry any package,
bundle or article which prevents the rider from keeping at least one
(1) hand upon the handlebars.
E. Violation Procedure. Any person under the age of seventeen (17) violating any of the Subsections of this Section will receive a warning for the first (1st) violation and the parent or guardian will be notified in writing. The second (2nd) violation recorded will result in the skateboard, scooter or bicycle being confiscated and held at the Edmundson Police Department awaiting the redemption of said device by the parent or guardian on such terms as are ordered by the Municipal Court. The third (3rd) and subsequent violations will result in a summons being issued to the parent or guardian of the individual who has violated this Section for failure to comply with this Section. Any person over the age of seventeen (17) convicted of a violation of any provisions of this Section shall be subject to the penalties as prescribed in Section
100.220 of the Municipal Code of the City of Edmundson.
