For the purposes of this Chapter, the following words and phrases
shall have these meanings:
ADEQUATE CARE
Normal and prudent attention to the needs of an animal, including
wholesome food, clean water, shelter and health care as necessary
to maintain good health in a specific species of animal.
ADEQUATE CONTROL
To reasonably restrain or govern an animal so that the animal
does not injure itself, any person, any other animal or property.
ANIMAL CONTROL OFFICER
A person or agency designated by the City Administrator to
carry out the responsibilities of this Code from time to time.
AT LARGE (AS APPLIED TO ANIMALS)
Any animal shall be deemed at large when it is off the premises
of its owner's real property and not restrained by a competent person.
BOARDING KENNEL
A place or establishment, other than a pound or animal shelter,
where animals, not owned by the proprietor are sheltered, fed and
watered in return for a consideration; however, "boarding
kennel" shall not include hobby or show breeders who board
intact females for a period of time for the sole purpose of breeding
such intact females, and shall not include individuals who temporarily,
and not in the normal course of business, board or care for animals
owned by other individuals.
CAT
All domestic species or varieties of the Felis domesticus,
male or female, above the age of four (4) months.
CERTIFICATE
A certificate issued under the County Rabies Control Code
at the time of the vaccination of a dog or cat, bearing thereon the
signature of the vaccinator, the registration number, the name, color,
breed and sex of the dog or cat, the name and address of the person
responsible for the animal, the date of the vaccination and the type
of vaccine administered.
COMPETENT PERSON
A person who is capable of controlling and governing the
dog in question and to whose command the dog is obedient.
CONFINEMENT
The ten (10) day clinical observation period following a
bite incident during which an owner of an animal is to prevent contact
by such animal with humans or other animals. The animal may, at the
expense of the owner, be confined at the County impounding facility,
by a veterinarian or at the owner's residence with the approval of
the Director.
DIRECTOR
The Director of the St. Louis County Department of Health
or any person or agent employed by the County Department of Health
to enforce the County Rabies Control Code and the provisions of this
Chapter.
DOG
All domesticated members of the Canis familiarize, male or
female, four (4) months of age or older.
EXOTIC ANIMAL
Includes:

1.
Any mammal not generally accustomed to living in or near human
populations.
2.
Any mammal not considered to be a member of the class generally
referred to as domesticated animals.
3.
All animals listed on the endangered species list as designated
by the United States Department of Interior in the Endangered Species
Act of 1969.
4.
All animals protected from hunting and capture by Federal and
State law.
6.
Those animals declared inherently dangerous pursuant to Section
205.170(C).
EXPOSED TO RABIES
When bitten by, or fought with, or has come in close contact
with a dog or other animal shown to be infected with the rabies virus
as determined by standard laboratory testing.
FOAL
A horse under the age of one (1) year.
FOWL
Chicken roosters, ducks, geese, peacocks and pigeons.
GUARD DOG
A dog not owned by a governmental unit, which dog is used
to guard public or private property.
HARNESS
A combination of leather or nylon straps and buckles which,
when fitted around the neck and torso of the dog or cat, helps to
distribute the pulling force more evenly across the shoulders.
HEALTH DEPARTMENT, COMMISSIONER OR HEALTH COMMISSIONER
The Department of Public Health of St. Louis County, the
Commissioner of Public Health of St. Louis County or any person or
agent employed by the St. Louis County Health Commissioner to enforce
the County Rabies Control Code.
HOUSEHOLD
Those members of a family including servants and attendants
living in the same dwelling unit.
HUMANE EUTHANASIA
The act or practice of putting an animal to death in a humane
or instantaneous manner under guidelines and procedures established
by rules promulgated by the Director.
HUMANE KILLING
The destruction of an animal accomplished by a method approved
by the American Veterinary Medical Association's Panel on Euthanasia
(JAVMA 173: 59-72, 1978); or more recent editions, but animals in
accordance to local custom and practice killed during the feeding
of pet carnivores shall be considered humanely killed.
IMPOUND
To apprehend, catch, trap, net, tranquilize, confine any
animal by the authorization of the Director or his/her agent or by
any employee or agent of the City.
IMPOUNDING FACILITIES
Any premises designated by the City for the purpose of impounding
and caring for all animals in violation of this Chapter.
KITTEN
All domestic species or varieties of the Genus fells, male
or female, under the age of four (4) months.
OWNER
In addition to its ordinary meaning, any person who keeps
or harbors an animal or professes to be owning, keeping or harboring
an animal.
PUP OR PUPPY
All domesticated members of the Canis familiarize, male or
female, under four (4) months of age.
QUARANTINE
An order issued by the County Department of Health or the
County Council for a geographic area for the purpose of containing
and controlling the transmission of rabies.
SERVICE DOG
A dog that is being or has been specially trained to do work
or perform tasks which benefit a particular person with a disability.
Service dog includes:
1.
Guide dog: A dog that is being or has been
specially trained to assist a particular blind or visually impaired
person.
2.
Hearing dog: A dog that is being or has been
specially trained to assist a particular deaf or hearing-impaired
person.
3.
Medical alert or respond dog: A dog that is
being or has been trained to alert a person with a disability that
a particular medical event is about to occur or to respond to a medical
event that has occurred.
4.
Mobility dog: A dog that is being or has been
specially trained to assist a person with a disability caused by physical
impairments.
SEVERE INJURY
Any physical injury resulting directly from an animal's bite,
which results in broken bones, contusions or lacerations that require
medical treatment from a health care professional.
TAG
Any object regardless of shape, size and material which bears
a registration number and the words (or abbreviations) "rabies vaccination-registration"
and which is issued by the Director of the Department of Health. A
tag expires when the duration of the immunity noted on the registration
certificate is exceeded.
TETHERING
Attaching a dog or cat to a stationary object or pulley run
by means of a chain, rope, tether, cable or similar restraint. "Tethering"
does not include the use of a leash to walk a dog.
VACCINATE
The injection by a veterinarian or his/her authorized agent
of a specified dose of anti-rabies vaccine into the body of a dog
or cat.
VACCINATION REGISTRATION
The procedure of vaccinating for rabies and issuing an identification
number and an appropriate certificate under the County Rabies Control
Code. The words "vaccination" and "registration" shall be interchangeable.
VETERINARIAN
Any veterinarian holding a current State license and operating
on a participating basis with the Health Department as required by
and provided in the County Rabies Control Code.
