[Adopted 2-14-2011 by L.L. No. 1-2011]
In the Village of Ellenville, in the County of Ulster the provisions
of § 3 of the New York State Public Officers Law requiring
a person to be a resident of the political subdivision or municipal
corporation of the state for which he or she shall be chosen or within
which his or her official functions are required to be exercised shall
not prevent a person from holding the office of Treasurer or Court
Clerk of the Village of Ellenville, provided that such person resides
in the county in which such village is located or an adjoining county
within the State of New York.
[Adopted 11-13-2013 by L.L. No. 2-2013]
The Board of Trustees finds that, due to the relatively small
population of the Village of Ellenville, it is not always possible
to fill certain appointive offices and nonjudicial positions in Village
government requiring municipal, administrative or financial expertise
with Village residents who are duly qualified to hold such positions.
The Board further finds that it is authorized to appoint qualified
residents of Ulster County outside of the Village to said offices
pursuant to Sections 3 of the Village Law. The Board further finds
that it is authorized under said Sections 3 and 10 of the Municipal
Home Rule Law to expand such residency requirements to allow residents
of Ulster County to be eligible for appointment to said offices.
Notwithstanding any other general or special law, no person
shall be eligible to be appointed to or hold office of the Village
Manager in the Village of Ellenville unless such person is a resident
of Ulster County at the time of such appointment. A person shall be
eligible to be appointed to or hold the nonjudicial position of Village
Manager, provided such person is a resident of Ulster County at the
time of such appointment.
This article shall take effect immediately upon filing with
the Secretary of State of the State of New York and shall apply to
all persons currently holding the positions of Village Manager as
well as any persons hereafter appointed to fill such offices.
