The Mayor, with the consent and approval of the majority of the members of the Board of Aldermen, shall appoint an attorney licensed to practice law in the State of Missouri as the City Attorney. The City Attorney shall serve until he or she has been removed as provided by law.

A. 
The City Attorney shall be paid an amount as set by ordinance from time to time. The duties of the City Attorney shall be as follows:
1. 
Attendance at all meetings of the Board of Aldermen and attendance at all meetings of the Planning and Zoning Commission.
2. 
Advising the Mayor and Board of Aldermen and other City Officials on all legal matters connected to the City; to represent and advise the City and its officials in all other legal matters including, but not limited to, preparing opinion letters as requested by the Mayor and Aldermen.
3. 
Reviewing all ordinances and resolutions, drafted by the City Clerk, requested by the Mayor or Aldermen.
4. 
Reviewing contracts entered into by the City.
5. 
The City Attorney shall represent the City in all civil and criminal litigation matters as directed by the Mayor and Board of Aldermen in Federal and State courts and in and before State and Federal administrative agencies; and represent the City in special investigations and conducting legal research.

A. 
The Mayor, with the consent of the majority of the Board of Aldermen, shall appoint an attorney as Prosecuting Attorney, whose term of office and appointment shall terminate upon the termination of the term of office of the Mayor. The compensation to be paid to the Prosecuting Attorney shall be an amount as set by ordinance from time to time. The duties for which said retainer will be paid, on an annual basis in equal monthly installments, shall be as follows:
The Prosecuting Attorney shall represent the City:
1. 
In the City's Municipal Court in the prosecution of all violations of City ordinances; and
2. 
In the appeal to State court of all such prosecutions, except as otherwise directed by the Mayor and Board of Aldermen as to a particular appeal or appeals.

Nothing in this Article shall be construed as preventing the Mayor and the Board of Aldermen from employing any attorney as special counsel in any matters they deem necessary and paying reasonable compensation therefor.
