A. There is hereby adopted by the City Council of the City of Blue Springs, Missouri; the following Uniform Codes, subject to the exceptions set forth herein and in Section
500.020, for the purpose of prescribing, regulating and governing the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area, maintenance and all matters relating thereto for the prevention of conditions hazardous to life and property, and for the common welfare, protection and benefit of the residents of the City.

a.
Section 105.2 Work exempt from permit delete item number 9 and
include new item 9 as follows:
9.

Prefabricated swimming pools accessory to a Group R-3 occupancy
that are less than twenty-four (24) inches (610mm) deep."

CHAPTER 13, ENERGY EFFICIENCY, SECTION 1301, GENERAL, [E] 1301.1
Scope and [E] 1301.1.1 Criteria shall be amended to read as follows:
"[E] 1301.1 Scope. This Chapter governs the design and construction
of buildings for energy efficiency.
|
[E] 1301.1.1 Criteria. Buildings may be designed and constructed
in accordance with the International Energy Conservation Code."
|
2.
International Fire Code 2018, with a publication date of August
2017, except for the following modifications.
a.
Section 503.1.1 Buildings And Facilities. Approved fire apparatus
shall be provided for every facility, building or portion of a building
hereafter constructed or moved into or within the jurisdiction. The
fire apparatus access road shall comply with the requirements of this
Section and shall extend to within one hundred fifty (150) feet (45,720
mm) of all portions of the facility and all portions of the exterior
walls of the first story of the building as measured by an approved
route around the exterior of the building or facility. The approved
apparatus access road will be designed to withstand the weight of
a ninety thousand pounds (90,000) pound vehicle.
b.
Section 507.3 Fire-Flow. Fire-flow requirements for buildings
or portions of buildings and facilities shall be determined by using
the current adopted IFC code Appendix C.
c.
Section 507.5.1.2. Four (4) buildings equipped throughout with
an approved automatic sprinkler system installed in accordance with
Section 903.3.1.1 or 903.3.1.2, the distance requirement shall be
six hundred (600) feet (183 m). The minimum number of hydrants shall
be determined by using the current adopted IFC code Appendix C. Number
of hydrants can be reduced by the Fire Code Official if deemed appropriate.
Example: Building with automatic extinguishing system.
d.
Section 510.1.2 Emergency Responder Radio Coverage.
Any building meeting the following criteria will produce signal
strength test as described in IFC 510:

1.
|
Any structure with an overall square footage of twelve thousand
(12,000) square feet.
|
2.
|
Any structure with a height of thirty (30) feet or more above
grade level.
|
3.
|
Any structure with a level below grade.
|
4.
|
Any structure determined to be of concern of proper radio communication,
Central Jackson County Fire Protection District can request a signal
strength study to be completed.
|
If a signal strength test is required it shall not be performed
until all walls, roof, windows with glass, doors, and operational
equipment has been completed and in place.
|
A field test will be performed by Central Jackson County Fire
Protection District personnel at the time of Certificate of Occupancy
utilizing Central Jackson County Fire Protection District portable
two-way communications. If that test fails, a Temporary Certificate
of Occupancy may be signed with an obligation to enhance the emergency
radio communications coverage within six (6) months.
|
All other requirements for Emergency Responder Radio Coverage
will follow IFC 510, NFPA 72, NFPA 1221, and UL 2425 as written in
the current adopted code.
|
All BDA installations will include the following:
|
Cover 700 and 800 megahertz
|
Install an annunciator
|
Install a document box that contains installation
plans, and pre- and post-survey test results
|
A field test will be performed by Central Jackson County Fire
Protection District personnel at the time of Certificate of Occupancy
utilizing Central Jackson County Fire Protection District portable
two-way communications. If that test fails, a Temporary Certificate
of Occupancy may be signed with an obligation to enhance the emergency
radio communications coverage within six (6) months.

All other requirements for Emergency Responder Radio Coverage
will follow IFC 510 and NFPA 72 as written in the current adopted
code.

e.
Section 901.6.3.2 Records.
Contractors who perform inspection, testing and/or maintenance
service on fire and life safety systems must submit those records
of service to the Fire Code Official.
Records of all system inspections, tests, and maintenance (ITM)
of the following must be submitted electronically through Central
Jackson County Fire Protection District or the contractor it chooses
to collect and maintain ITM reports and track compliancy of the Fire
Code as it pertains to the following and the Compliance Engine Software
used by Central Jackson County Fire Protection District or its contractor
used to collect and maintain ITM reports and track compliancy of the
Fire Code as it pertains to the following:

f.
IFC Section 903.1 General. Automatic
sprinkler systems shall comply with this Section. Any building requiring
an automatic sprinkler system as required by IFC 903, which meets
the following criteria, must install a separate water flow switch
that is addressable through the fire alarm system.
1.
Any building that has an automatic sprinkler system with multiple
addresses or suites that is greater than two (2).
2.
Any building requiring an automatic sprinkler system as required
by IFC 903 shall have a permanent, maintained water source within
one hundred (100) feet of the Fire Department connection.
g.
Section 903.2 Where Required. Approved
automatic sprinkler systems in new buildings and structures shall
be provided in the locations described in Sections 903.2.1 through
903.2.12. Any building requiring an automatic sprinkler system as
required by IFC 903, which meets the following criteria, must install
a separate water flow switch that is addressable through the fire
alarm system.
1.
Any building that has an automatic sprinkler system with multiple
addresses or suites that is greater than two (2).
2.
Any building requiring an automatic sprinkler system as required
by IFC 903 shall have a permanent, maintained water source within
one hundred (100) feet of the Fire Department connection.
h.
Section 903.4.2 Alarms. An approved audible and visual device,
located on the exterior of the building in an approved location, shall
be connected to each automatic sprinkler system. Such sprinkler waterflow
alarm devices shall be activated by water flow equivalent to the flow
of a single sprinkler of the smallest orifice size installed in the
system. Where a fire alarm system is installed, actuation of the automatic
sprinkler systems shall actuate the building fire alarm system.
i.
Section 903.4.2.1 Notification
Devices. Where an automatic extinguishing system is installed in a
building, audible and visible notification appliances shall be installed
throughout the building as follows:
1.
Audible notification appliances shall be installed so as to
be audible at fifteen (15) dBa above average sound pressure level
throughout the building.
2.
Visible notification appliances shall be installed in all public
and common use areas, restrooms and corridors in accordance with the
spacing requirements of NFPA 72.
3.
Visible notification devices can be eliminated in normally unoccupied
portions of buildings where permitted by the Code Official.
Exception: The requirements of this Section do not apply to
Group R-3 occupancies.

j.
Section 904.5.1 System Test. Systems shall be inspected and
tested for proper operation following the recommended schedule shown
in NFPA 96. Tests shall include a check of the detection system, alarms
and releasing devices, including manual stations and other associated
equipment. Extinguishing system units shall be weighed, and the required
amount of agent verified. Stored pressure-type units shall be checked
for the required pressure. The cartridge of cartridge-operated units
shall be weighed and replaced at intervals indicated by the manufacturer.
k.
Section 907.6 Installation And Monitoring. A fire alarm system
shall be installed and monitored in accordance with Sections 907.6.1
through 907.6.6.2 and NFPA 72. Fire alarm systems required by the
International Fire Code or by the International Building Code shall
be monitored by a listed central station as defined in NFPA 72. A
certificate or placard shall be issued by a recognizing organization
that has listed the prime contractor for the newly installed fire
alarm systems in commercial occupancies in accordance with NFPA 72.
This regulation shall apply to all fire alarm systems that are newly
installed in commercial occupancies that reside within Central Jackson
County Fire Protection District boundaries on or after January 1,
2021. Any existing fire alarm system in a commercial occupancy wherein
the fire alarm control panel and/or alarm system components are to
be replaced shall be considered newly installed for the purpose of
this Section. Also, where there is reasonable cause due to non-compliance
or faulty conditions, the Fire Code Official may require an existing
fire alarm system meet the same requirements as a newly installed
system. Central station service in full compliance with the 2016 Edition
of NFPA 72, Chapter 26, shall be maintained at the protected property,
so long as the requirement for the fire alarm exists.

ICC Electrical Code (Administrative Provisions) 2006, with a
publication date of May 2009.
4.
National Electrical Code NFPA 70, 2017 Edition.
5.
International Plumbing Code 2018, with a publication date of
August 2017, except for the following modification to Section 607.2
of the International Plumbing Code 2012:
a.
Section 607.2 Hot Or Tempered Water Supply To Fixtures. The
developed length of hot or tempered water piping, from the source
of hot water to the fixtures that require hot or tempered water, shall
not exceed one hundred (100) feet (15,240 mm). Recirculating system
piping and heat-traced piping shall be considered to be sources of
hot or tempered water.
6.
International Mechanical Code 2018, with a publication date
of August 2017.
7.
International Fuel Gas Code 2018 with a publication date of
August 2017.
8.
International Residential Code 2018 (for One- and Two- Family
Dwellings) with a publication date of August 2017, except for the

revised to conform to the scope and application of this code. The
Section numbers appearing in parenthesis after each Section number
are the Section numbers of the corresponding text in the International
Energy Conservation Code — Residential Provisions."
d.
Part IV — Energy Conservation, CHAPTER 11 [RE], ENERGY,
EFFICIENCY, SECTION N1101, GENERAL, N1101.2 (R101.3) Intent is amended
to read:
"N1101.2 (R101.3) Intent. This Chapter may regulate the design
and construction of buildings for the effective use and conservation
of energy over the useful life of each building. This Chapter is intended
to provide flexibility to permit the use of innovative approaches
and techniques to achieve this objective. This Chapter is not intended
to abridge safety, health or environmental requirements contained
in other applicable codes or ordinances."
g.
E3901.9 Basements, Garages And Accessory Buildings. Not less
than one (1) receptacle outlet, in addition to any provided for specific
equipment, shall be installed in each separate unfinished portion
of a basement; in a vehicle bay not more than five and five-tenths
(5.5) feet (1,676 mm) above the floor in attached garages; in a vehicle
bay not more than five and five-tenths (5.5) feet (1,676 mm) above
the floor in detached garages that are provided with electric power
and in accessory buildings that are provided with electric power.
h.
E3902.2.1 Garage And Accessory Building Receptacles. 125-volt
single-phase, 15- or 20-ampere receptacles installed in garages and
grade-level portions of unfinished accessory buildings used for storage
or work areas shall have ground-fault circuit-interrupter protection
for personnel. With the exception of electrical receptacles dedicated
to serve refrigerators, freezers, alarm, garage door openers, sump
pumps, irrigation controls, to be non-GFCI.
i.
E3902.5 Exceptions: A receptacle supplying only a permanently
installed fire alarm, burglar alarm, or sump pump system. Receptacles
installed in accordance with this exception shall not be considered
as meeting the requirement of Section E3901.9.

A. The
following Sections of the 2018 International Building Code and related
codes are modified or amended in the following respects:
1. Chapter 1, Section 105, Permits, of the 2018 International Building
Code is amended as follows:
a.
Permits Required. Except as specified in Subsection
(b) of this section, no building or structure regulated by this chapter shall be erected, constructed, enlarged, altered, repaired, moved, improved, removed, converted or demolished unless a separate permit for each building or structure has first been obtained from the Community Development Department.
b.
Work Exempt From Permit. A building
permit shall not be required for the following:
(1) One-story detached accessory
buildings used as tool and storage sheds, playhouses and similar uses,
provided the projected floor area does not exceed two hundred fifty
(250) square feet.
(3) Movable cases, counters
and partitions not over five (5) feet nine (9) inches high.
(4) Retaining walls which
are not over four (4) feet in height measured from the bottom of the
footing to the top of the wall, unless supporting a surcharge or impounding
Class 1, 11 or 111A liquids.
(5) Platforms, decks and
walks without any overhead structure that are not more than thirty
(30) inches above grade and not over any basement or story below.
(6) Painting, papering and
similar finish work.
(7) Temporary motion picture,
television and theater stage sets and scenery.
(8) Window awnings supported
by an exterior wall of Group R, Division 3, and Group U Occupancies
when projecting not more than fifty-four (54) inches.
2. Section R313, Automatic Fire Sprinkler Systems, of the 2018 International
Residential Code is deleted in its entirety as required by Section
67.281, RSMo., and a builder of a one- or two-family dwelling or townhouse
shall offer to any purchaser on or before entering into the purchase
contract the option, at the purchaser's cost, to install or equip
fire sprinklers in the dwelling or townhouse.

A. Building permit fees for the Building Code
adopted by the City of Blue Springs shall be determined using the
Blue Springs Building Permit Fees Table.

B. The determination of value or valuation
under any of the provisions of this Code shall be made by the Building
Official.
C. Other inspections and fees shall be computed
and charged using that portion of the Blue Springs Building Permit
Fees Table denominated "Other Inspections and Fees," except that item
Number 3, "Inspections for which no fee is specifically indicated,"
will also include all miscellaneous permits for which no specific
fee is indicated, and the "minimum charge" provision thereof shall
not be applied.

D. The value to be used in computing the building
permit and building plan review fees shall be the total value of all
construction work for which the permit is issued, as well as all finish
work, painting, roofing, electrical, plumbing, heating, air conditioning,
elevators, fire extinguishing systems and any other permanent equipment.
E. Work Commencing Before Permit Issuance.
Any person who commences any work on a building, structure, electrical,
gas, mechanical or plumbing system before obtaining the necessary
permits shall be subject to a fee established by the Building Official
that shall be in addition to the required permit fee. An investigation
fee, in addition to the permit fee, shall be collected whether or
not a permit fee is then or subsequently issued. The investigation
fee shall be equal to the amount of the permit fee required by this
Code. The minimum investigation fee shall be the same as the minimum
fee set forth in the Blue Springs Building Permit Fees Table. The
payment of such investigation fee shall not exempt any person from
compliance with all other provisions of this Code nor from any penalty
prescribed by law.

B. There shall be allowed a credit on sewer system development charges
on parcels located within the South Area Neighborhood Improvement
District based upon the total amount assessed on each property.

It shall be unlawful for any person, firm, partnership or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use or occupy prior to passing a final inspection, or maintain any building or structure, or cause or permit the same to be done without first obtaining a valid, unrevoked construction permit and/or certificate of occupancy from the office of the Community Development Department, as provided in this Chapter, or to violate any other provision of this Chapter. Any person, firm, partnership, or corporation who violates any provision of this Article upon conviction thereof shall be punished by a fine of not more than that set out in Section
100.080(C) of this Code or by imprisonment not exceeding ninety (90) days, or both such fine and imprisonment, except that the court may not sentence a person to any confinement not exceeding a period of ninety (90) days unless it is a violation involving alcohol or a controlled substance, or a violation endangering the health or welfare of others, or a violation involving eluding or giving false information to a law enforcement officer. Each day upon which such a violation occurs shall constitute a separate violation.

A. There is hereby established within the
administrative structure of the City of Blue Springs, the position
of Codes Administrator. Said Codes Administrator shall also serve
as Chief Building Inspector and Deputy Zoning Administrator. Said
Codes Administrator shall also be the Building Official.
B. The Codes Administrator and their designees
shall have the duty and authority to enforce the Building Code of
the City, as well as other duties given them administratively or by
ordinance.
C. The Codes Administrator shall be appointed
by the City Administrator or their designee. They may in turn designate
other persons to make inspections. Neither formal appointment nor
designation is required to confer the authority granted.

The Building Inspector, or the person
designated by them to make inspection, must be well informed on the
International Building Code, International Mechanical Code, International
Fire Code, National Electrical Code and the International Plumbing
Code, as adopted by the City of Blue Springs, and have an intelligent
and constructive knowledge of the intent and literal interpretation
of the provisions thereof.

A. No person, firm or corporation shall perform
any electrical, mechanical, plumbing, heating and air conditioning
or foundation work or contracting in the City of Blue Springs, unless
a permit for such work has been obtained from the Community Development
Department. No person, firm or corporation shall cause any connection
to be made directly or indirectly with any water supply, electrical
supply company, or sewer without first obtaining a permit therefor
from the Community Development Department.
B. The Building Inspector shall provide an
inspection record card with each permit required by this Section.
No work requiring a building permit shall be commenced until such
permit and inspection record card have been posted in a conspicuous
place on the front of the premises. Said card shall be maintained
in such position by the permit holder until the certificate of occupancy
has been issued.
C. The cost of permits for electrical, mechanical, plumbing, heating and air conditioning, and foundation work shall be set forth in Section
500.030.
D. In addition to the inspections specified
in this Section, the Building Inspector may make or require any other
special inspections pursuant to the International Building Code and
State law of any construction work to ascertain compliance with the
provisions of this Code and other laws which are enforced by the Building
Inspector.

Whenever any of the Codes or standards adopted in this Chapter
500 shall provide an appeal to any person who is denied an application or a permit, or who claims the provisions of a Code contained herein do not apply, or that the true intent and meaning of the Code have been misconstrued or wrongly interpreted, or proposes alternate materials or methods of construction not permitted by the strict interpretation of these Codes, such application for appeal shall be to the Technical Review Committee of the City of Blue Springs, Missouri, or its successor if one be named and such Technical Review Committee shall conduct the appeal as provided in the International Codes herein adopted with the expressed intent of the City Council to substitute and define said Technical Review Committee in lieu of and notwithstanding any other description or provision contained within said Codes for the Appeal Board.
