This Chapter shall control all matters
concerning the water service provided by the City waterworks, except
such matters which are otherwise specifically provided for as exceptions
hereto by this Code or other ordinance. This Chapter shall be construed
to secure the expressed intent and ensure public safety, health and
welfare insofar as they are affected by the water service.

Water service shall be provided to
each approved applicant, hereinafter called "user", upon satisfactory
completion of the tap-on and subsequent inspection of the meter installation.

A. The City may provide water service to users
not within the corporate limits, provided, that the following considerations
are satisfied:
1.
The cost of any main extension and
the associated easements outside the corporate limits shall be borne
by the applicant. Maintenance of such main extension shall be in accordance
with the service extension agreement.
2.
In the event the corporate limits
are extended to include any portion of the main extension, etc., the
applicant shall agree to relinquish to the City all rights to that
portion within the corporate limits. The City will then be responsible
for maintenance of that portion of the installation.
3.
The applicant shall submit an application for out-of-City service to the City for approval by the Manager. Such application shall be accompanied by a tap-on fee in such amount as may be established in Chapter
700, Section
700.040(B). The application shall specify the additional service charges to be borne by the user.

A. Definitions. For purpose of this Section,
the following terms shall be deemed to have the meanings indicated:

REPAIR
Includes repair and/or replacement.
RESIDENTIAL PROPERTY
Real estate within the City of St. Peters, identified by
a single locator number in which the St. Charles County Assessor's
office classifies as: Class One —Single-Family Residence (r),
Class Thirteen — Duplex (r), Class Fourteen — Condo Residential
(r), and Class Thirty-One — Residential Triplex (r), excepting
therefrom any property identified by the City Administrator or his/her
designee as a residential property having more than four (4) dwelling
units and served by a single water meter.
WATER SERVICE LINE
That portion of a residential property's water service piping
that runs from the City water meter to the exterior foundation wall
of the dwelling unit. A water service line shall not include any portion
of water service piping on residential property that lies inside or
under any building or structure, through the residence foundation
or in the interior of the residence.
B. Water Service Line Repair Fee. There is
hereby levied and assessed against all residential property within
the City an annual fee of twelve dollars ($12.00) for the purposes
of paying for the costs of necessary water service line repairs.
C. Water Service Line Repair Fund. A special account shall be created and shall be known as the Water Service Line Repair Fund into which all monies collected pursuant to Subsection
(B) of this Section shall be deposited. All interest generated on deposited funds shall be accrued to the Water Service Line Repair Fund.
D. Collection. The fee levied pursuant to
this Section shall be added to the general tax levy bills of owners
of residential property within the City and may be collected in the
same manner and to the same extent as provided for the collection
of delinquent real estate taxes and bills. The St. Peters Director
of Finance shall administer and disburse funds from this fund upon
authorization of the City Administrator or his designee.
E. Availability Of Funds. Administration of
the Water Service Line Repair Program shall be subject to and contingent
upon the availability of funds collected or anticipated to be collected
pursuant to this Section at any given time.
F. Rules And Regulations. The City Administrator
shall promulgate rules and regulations to carry out the purpose and
intent of the Water Service Line Repair Program established pursuant
to this Section, to protect the public safety, health and welfare
of the residents of the City, and to administer the program in an
effective, efficient and timely manner.
