It is the purpose of this Article to regulate the depth at which
a human body may be buried in all cemeteries within the City limits
of the City of De Soto pursuant to authority granted to municipalities
of this State by House Bill No. 677, 83rd General Assembly.

At the time of a burial, the burial vault or the top of the
casket or the body, as the case may be, shall be placed a minimum
of twelve (12) inches below the surface of the existing ground.

It shall be the non-delegable duty of the cemetery owner and the cemetery operator of all cemeteries within the City limits of De Soto to bury at the minimum depth prescribed in Section
155.140.

The owner or operator of any cemetery within the City limits of De Soto that permits or allows burial to be less than the minimum depth required by Section
155.140 shall be deemed guilty of a misdemeanor and may be penalized in accordance with Section
100.090 of this Code or any subsequent general penalty provision.

A. It shall be unlawful for any person to engage in picketing or other
protest activities within three hundred (300) feet of or about any
location at which a funeral is held, within one (1) hour prior to
the commencement of any funeral and until one (1) hour following the
cessation of any funeral. Each day on which a violation occurs shall
constitute a separate offense.
B. For the purposes of this Section, "funeral" means the ceremonies,
processions and memorial services held in connection with the burial
or cremation of the dead.
