A. International
Building Code. A certain code, two (2) copies of which are on file
in the office of the City Clerk of the City of De Soto, Missouri,
being marked and designated as "The International Building Code, 2009
Edition" as published by the International Code Council is hereby
adopted as the Building Code of the City of De Soto, Missouri regulating
and governing the conditions and maintenance of all property, buildings
and structures; by providing the standards for supplied utilities
and facilities and other physical things and conditions essential
to ensure that structures are safe, sanitary and fit for occupation
and use; and the condemnation of buildings and structures unfit for
human occupancy and use and the demolition of such structures as herein
provided; providing for the issuance of permits and collection of
fees therefore; and each and all of the regulations, provisions, penalties,
conditions and terms of said Building Code on file in the office of
the City of De Soto are hereby referred to, adopted and made a part
hereof, as if fully set out in this Article.
B. Existing
Building Code. A certain code, one (1) copy of which is on file in
the office of the City Clerk of the City of De Soto, Missouri, being
marked and designated as "The International Existing Building Code,
2009 Edition," as published by the International Code Council, is
hereby adopted as the Existing Building Code of the City of De Soto,
Missouri, regulating and governing the repair, alteration, change
of occupancy, addition, and relocation of existing buildings, including
historic buildings, as herein provided; and each and all of the regulations,
provisions, conditions and terms of said Existing Building Code on
file in the office of the City of De Soto are hereby referred to,
adopted and made a part hereof, as if fully set out in this Article.
C. Residential
Code. A certain code, two (2) copies of which are on file in the office
of the City Clerk of the City of De Soto, Missouri, being marked and
designated as "The International Residential Code, 2009 Edition,"
including entire Appendix as published by the International Code Council,
is hereby adopted as the Residential Code of the City of De Soto,
Missouri, regulating and governing the construction, alteration, movement,
enlargement, replacement, repair, equipment, location, removal and
demolition of detached one- and two-family dwellings and multiple
single-family dwellings (town houses) not more than three (3) stories
in height with separate means of egress as herein provided; and each
and all of the regulations, provisions, conditions and terms of said
Residential Code on file in the office of the City of De Soto are
hereby referred to, adopted and made a part hereto, as if fully set
out in this Article.
D. Mechanical
Code. A certain code, one (1) copy of which is on file in the office
of the City Clerk of the City of De Soto, Missouri, being marked and
designated as "The International Mechanical Code, 2009 Edition," as
published by the International Code Council, is hereby adopted as
the Mechanical Code of the City of De Soto, Missouri, regulating and
governing the design, construction, quality of materials, erection,
installation, alteration, repair, location, relocation, replacement,
addition to, use or maintenance of mechanical systems as herein provided;
and each and all of the regulations, provisions, conditions and terms
of said Mechanical Code on file in the office of the City of De Soto
are hereby referred to, adopted and made a part hereto, as if fully
set out in this Article.
E. Plumbing
Code. A certain code, one (1) copy of which is on file in the office
of the City Clerk of the City of De Soto, Missouri, being marked and
designated as "The International Plumbing Code, 2009 Edition," as
published by the International Code Council, is hereby adopted as
the Plumbing Code of the City of De Soto, Missouri, regulating and
governing the design, construction, quality of materials, erection,
installation, alteration, repair, location, relocation, replacement,
addition to, use or maintenance of plumbing systems as herein provided;
and each and all of the regulations, provisions, conditions and terms
of said Plumbing Code on file in the office of the City of De Soto
are hereby referred to, adopted and made a part hereto, as if fully
set out in this Article.
F. Energy
Conservation Code. A certain code, one (1) copy of which is on file
in the office of the City Clerk of the City of De Soto, Missouri,
being marked and designated as "The International Energy Conservation
Code, 2003 Edition," as published by the International Code Council,
is hereby adopted as the International Energy Conservation Code of
the City of De Soto, Missouri, regulating and governing efficient
building envelopes and installation of energy efficient mechanical,
lighting and power systems as herein provided; and each and all of
the regulations, provisions, conditions and terms of said Energy Conservation
Code on file in the office of the City of De Soto are hereby referred
to, adopted and made a part hereto, as if fully set out in this Article.
G. Fuel
Gas Code. A certain code, one (1) copy of which is on file in the
office of the City Clerk of the City of De Soto, Missouri, being marked
and designated as "The International Fuel Gas Code, 2003 Edition,"
as published by the International Code Council, is hereby adopted
as the Fuel Gas Code of the City of De Soto, Missouri, regulating
and governing fuel gas systems and gas-fired appliances as herein
provided; and each and all of the regulations, provisions, conditions
and terms of said Fuel Gas Code on file in the office of the City
of De Soto are hereby referred to, adopted and made a part hereto,
as if fully set out in this Article.
H. Urban-Wildland
Interface Code. A certain code, one (1) copy of which is on file in
the office of the City Clerk of the City of De Soto, Missouri, being
marked and designated as "The International Urban-Wildland Code, 2003
Edition," as published by the International Code Council, is hereby
adopted as the Urban-Wildland Interface Code of the City of De Soto,
Missouri, regulating and governing the mitigation of hazard to life
and property from the intrusion of fire from wildland exposures, fire
from adjacent structures and prevention of structure fires from spreading
to wildland fuels as herein provided; and each and all of the regulations,
provisions, conditions and terms of said Urban-Wildland Interface
Code on file in the office of the City of De Soto are hereby referred
to, adopted and made a part hereto, as if fully set out in this Article.
I. Electrical
Code. A certain code, three (3) copies of which are on file in the
office of the City Clerk of the City of De Soto, Missouri, being marked
and designated as the "National Electrical Code, 2005 Edition," as
published by the National Fire Protection Association, is hereby adopted
as the Electrical Code of the City of De Soto, Missouri, to provide
for the regulation and control of design, construction, quality of
materials, erection, installation, alteration, repair, location, relocation,
replacement, addition to, use or maintenance of electrical systems
in the City of De Soto; and each and all of the regulations, provisions,
conditions and terms of said National Electrical Code, and the referenced
standards mentioned therein are hereby referred to, adopted and made
a part hereof, as if fully set out in this Article.
J. Property
Maintenance Code. A certain code, three (3) copies of which are on
file in the office of the City Clerk of the City of De Soto, Missouri,
being marked and designated as the "International Property Maintenance
Code, 2009 Edition," as published by the International Code Council,
is hereby adopted as the Property Maintenance Code of the City of
De Soto, Missouri, regulating and governing the maintenance of existing
buildings; and each and all of the regulations, provisions, penalties,
conditions and terms of said International Property Maintenance Code
on file in the office of the City of De Soto are hereby referred to,
adopted and made a part hereof, as if fully set out in this Article.

A. The
International Building Code is amended and changed in the following
respects:
CHAPTER 1 OF (THE INTERNATIONAL BUILDING CODE)
The following Sections of the International Building Code, 2009
Edition, are revised as follows:
1. Amend Section 101.1 Title: Insert "City of De Soto, Missouri."
2. Amend Section 101.2.1 Appendices to read: "Appendix H Signs is hereby
adopted."
3. Amend Subsection 101.4.3 Plumbing by replacing "International Private
Sewage Disposal Code" with "Jefferson County On-Site Sewage Treatment
Code" where it appears in the International Building Code 2009.
4. Amend Section 103.2 to read: "The Building Official, under the code,
shall be the City Manager or the duly authorized representative of
the City Manager."
5. Amend Section 105.1 by adding to the end of the paragraph: "A copy
of the real estate tax bill, from the prior year, must be accompanied
with the building permit application."
6. Amend Section 107.2.5 by adding to the end of the paragraph: "The
owner must have the corners of the property marked as well as the
proposed building staked as to position on the lot. The position of
the building on the property will be shown on a site plan submitted
prior to issue of a building permit."
7. Amend Section 109.2. Fee Schedule by adding schedule:
a. Residential And Commercial New Construction. The permit fee shall
be thirty cents ($0.30) per square foot from April 1, 2011 through
March 31, 2012. Thereafter, the fee will increase 3% annually on April
1st.
b. Remodeling Permit. Shall be the fee "times" the square footage divided
by two (2) or the number of times an inspection is needed, whichever
is less.
c. All other permits, or in the case where an area cannot be determined
or is impractical to be determined. The non-refundable permit fee
shall be thirty dollars ($30.00).
d. Payment. All permit fees shall be paid prior to construction.
e. Re-Inspections. Permit fees will cover up to ten (10) inspections.
After ten (10) inspections a fee of thirty dollars ($30.00) will be
charged for each inspection. This Section does not apply to commercial
inspections.
f. Property Maintenance/Occupancy Inspections. The permit fee for Property
Maintenance/Occupancy Inspections shall be thirty dollars ($30.00).
This permit fee will cover up to one (1) inspection and two (2) re-inspections.
All additional Property Maintenance/Occupancy re-inspections require
the payment of an additional fee of thirty dollars ($30.00) to be
paid prior to the time of re-inspection.
8. Amend Section 110.3.5 by replacing "Shall be made" with "may be made."
9.
Amend Section 113.
Board of Appeals by deleting Sections 113.1, 113.2, 113.3 and inserting
in lieu thereof the following:
SECTION 113. MEANS OF APPEAL.
SECTION 113. APPLICATION FOR APPEAL. (INTERNATIONAL BUILDING
CODE, INTERNATIONAL EXISTING BUILDING CODE, INTERNATIONAL RESIDENTIAL
CODE, INTERNATIONAL MECHANICAL CODE, INTERNATIONAL PLUMBING CODE,
INTERNATIONAL ENERGY CONSERVATION CODE, INTERNATIONAL FUEL GAS CODE,
INTERNATIONAL URBAN-WILDLAND INTERFACE CODE, NATIONAL ELECTRICAL CODE
AND INTERNATIONAL PROPERTY MAINTENANCE CODE).
A. Application. Any person aggrieved by a decision of the Code Official shall have the right to appeal that decision to the Board of Adjustment established in Section
405.410, De Soto Code. An application for appeal shall be based on a claim that the true intent of the International Building Code, International Existing Building Code, International Residential Code, International Mechanical Code, International Plumbing Code, International Energy Conservation Code, International Fuel Gas Code, International Urban-Wildland Interface Code, the National Electrical Code or the International Property Maintenance Code, or the rules legally adopted thereunder, have been incorrectly interpreted, the provisions of this code do not fully apply, or that the Code Official agrees that an equally good or better method of construction is used. The application shall be filed on a form obtained from the Code Official within (30) days after the notice was served or the decision made by filing the application with the Code Official and with the Board of Adjustment. The Code Official shall forthwith transmit to the Board of Adjustment all the papers constituting the record upon which the action appealed from is taken. The Board shall fix a reasonable time for hearing the appeal, provide reasonable notice to the parties and decide the same within a reasonable time. Meetings of the Board of Adjustment shall be held in compliance with Section
405.410, De Soto Code.
B. Meetings — Procedure. Meetings of the Board of Adjustment shall be held in compliance with Section
405.410, De Soto Code.
C. Resolution. The decision of the board shall be by resolution. Certified
copies shall be furnished to the applicant and to the Code Official.
D. Board Decision.
1. The Board of Adjustment may modify or reverse the decision of the
Code Official by the concurring vote of four (4) members of the Board
of Adjustment. Otherwise, the decision will be affirmed.
2. The Code Official shall take immediate action in accordance with
the decision of the Board of Adjustment.
E. Court Review. Appeals to the Circuit Court by any person aggrieved
by a decision of the Board of Adjustment shall be made in the manner
and time required by law following the issuance of the decision by
the Board of Adjustment.
F. Penalty For Violations (International Building Code, International
Existing Building Code, International Residential Code, International
Mechanical Code, International Plumbing Code, International Energy
Conservation Code, International Fuel Gas Code, International Urban-Wildland
Interface Code, National Electrical Code and International Property
Maintenance Code). Any person, firm or corporation who shall violate
any of the provisions of this Chapter or the codes herein adopted,
or who shall fail to comply with any of the requirements thereof,
or who shall fail to comply with any order issued pursuant to any
Section thereof shall be guilty of a misdemeanor, and upon conviction,
shall be punished by a fine not exceeding five hundred dollars ($500.00),
or by imprisonment for a period not to exceed three (3) months, or
by both such fine and imprisonment, and court costs for each such
offense. Each day a violation exists or continues to exist shall be
deemed a separate offense.
10. Amend Subsection 406.1.4 Separation #1 by replacing "½ inch"
with "5/8 inch," and by replacing "1 3/8 inch" with "1 ¾ inch."
11. Amend Section 1807.2.1 Retaining Walls to read: "Retaining walls
over six (6) feet shall be designed by an engineer to ensure stability
against overturning, sliding, excess foundation pressure and water
uplift. Retaining walls shall be designed for a safety factor of 1.5
against lateral sliding and overturning."
"Exception: Poured concrete and wood crafted retaining walls
not exceeding six (6) feet in height shall not require engineering
but shall meet all other design requirements. Pre-manufactured block
retaining system of a modular nature shall follow manufacturer's specifications.
Modular retaining wall systems over six (6) feet in height shall require
engineered design supervision. Retaining walls of wood construction
shall be preservative treated in accordance with Chapter 23 of the
International Building Code."

Subsection R309.5.1. Pre-Manufactured Accessory Structures Anchoring
System. Accessory structures must be anchored into the ground to sufficiently
withstand a 90 mph wind. There are three types of acceptable anchoring
systems other than a full foundation with frost-protected footing.
a. Slab. A minimum of four inch (4") concrete with
a four inch (4") subgrade of suitably compacted materials one-half
inch (½") anchor bolts placed six feet (6') on center with
three inch (3") minimum embedment in concrete.
b. Auger Tie Down. Similar to manufactured home tie
downs with a minimum of two per side — max spacing ten feet
(10') on center. See manufacturer's details on installation into the
ground.
c. Piers. Sheds built on 4 X 4 skids may be anchored
into a concrete pier system. Piers shall be 8" X 8" X 30" deep and
shall be spaced a maximum of eight feet (8') on center. Piers shall
be located directly under the structural floor frame of the shed.

located in accordance with the City of De Soto zoning regulations.

required if the air handler and most ducts are located within conditioned
space."

Tanks: Any system with a new or a replacement water heating apparatus
shall be provided with an approved, listed and adequately sized thermal
expansion device (expansion tank) installed within ten (10) feet of
and on the cold water supply to the water heater. The tank may be
installed in a vertical up, vertical down, or horizontal position
in accordance with the manufacturer's recommendation.
Exception:
1) Listed non-storage instantaneous heaters having an inside diameter
of not more than three (3") inches
2) Water heaters, 30 gallons or less, installed under counter or in
confined spaces in multi-family units, may use adequately sized mechanical
water hammer arrestors to provide for thermal expansion with the approval
of the authority having jurisdiction or his/her representative.
3) One- and two-family residences served by private well.

Appointment. The CODE OFFICIAL, under the Code, shall be the City

Amend Section 103.5 Fees by replacing "as indicated in the following schedule [JURISDICTION TO INSERT APPROPRIATE SCHEDULE.]" with "as set forth in Section
500.020 of the City's Code."

Amend Section 111 Means of appeal to read: "Any person aggrieved
by a decision of the Code Official shall have the right to appeal
that decision as set forth in Section 500.020.9 of the City's

Add Subsection 606.1.1 State certification. Any elevator, conveying
system or component for which a current State operating certificate
has been issued shall satisfy the requirements of this Section.

Add Subsection 606.1.2 Operation prohibited. The operation of
any elevator, conveying system or component for which a current State
operating certificate has not been issued shall be prohibited.
13.
Amend Chapter 8 to replace the term "International Zoning Code"
with "the Code of the City of DeSoto, Missouri."
14.
Add Subsection 605.2.1 Ground-fault circuit-interrupter protection.
Ground-fault circuit-interrupter protection shall meet the requirements
of the currently adopted National Electric Code.
15.
Add Subsection 703.3 Dwelling-garage fire separation. Where
a garage was built either attached to or under a dwelling and no fire
separation was required at the time of construction, the garage shall
meet one of the following options;
1. Meet the fire separation requirements of the
currently adopted International Residential Code.

2. Remove the garage door.

3. Install smoke alarms meeting the requirements
of new construction per the currently adopted International Residential
Code. Locations required shall include the garage area.

4. Install battery-powered wireless interconnected
smoke alarms in all locations required in Section 704.2, including
the garage area.

Add Section 310 CARBON MONOIXDE ALARMS.
17.
Add Subsection 310.1 Carbon monoxide alarms. An approved carbon
monoxide alarm shall be installed outside of each separate sleeping
area in the immediate vicinity of the bedrooms in dwelling units within
which fuel-fired appliances exist and in dwelling units that have
attached garages.
18.
Add Subsection 310.2 Alarm requirements. Single-station carbon
monoxide alarms shall be listed as complying with UL 2034 and shall
be installed in accordance with this Code and the manufacturer's
installation instructions.

A. Any
new construction or major structural renovation begun after January
1, 1991, all buildings for which leases are executed by political
subdivision of the State after January 1, 1994 and all buildings for
which leases are executed by the State or any institution of higher
education after January 1, 1994 shall comply with the standards for
seismic design and construction of the Building Officials and Code
Administrators Code or of the Uniform Building Code.
B. This
Section shall not apply to any building owned by the State, any institution
of higher education, any political subdivision upon which construction
was begun or finished before December 17, 1990, any private structure
with less than ten thousand (10,000) square feet in total area or
any single-family or duplex residence.
C. As
used in this Section, the term "major structural renovation" means any reconstruction, rehabilitation, addition or other improvement
of an existing structure, the cost of which equals or exceeds fifty
percent (50%) of the market value of the structure before the start
of construction of the major structural renovation.
