Any pool, above or below the ground surface, which is used or
intended to be used for swimming, bathing or wading, over twenty-four
(24) inches in depth and with a surface area of one hundred fifty
(150) feet or more, shall, for the purposes of this Chapter, be a
swimming pool.

A. Outdoor Private Swimming Pool. An outdoor private swimming
pool, including in-ground, above-ground or on-ground pools, hot tubs
or spas, shall be provided with a barrier which shall comply with
the following:
1. The
top of the barrier shall be at least forty-eight (48) inches (four
(4) feet) above finished ground level measured on the side of the
barrier which faces away from the swimming pool.
2. Access
gates shall be at least forty-eight (48) inches (four (4) feet) above
finished ground level measured on the top of gate and equipped to
accommodate a locking device.
3. Where
an above-ground pool structure is used as a barrier or where the barrier
is mounted on top of the pool structure, and the means of access is
a fixed or removable ladder or steps, the ladder or steps shall be
surrounded by a barrier which meets all requirements. A removable
ladder shall not constitute an acceptable alternative to enclosure
requirements.

No swimming pool shall be closer than ten (10) feet from existing
property lines.

A. Anyone
desiring to construct or erect a swimming pool in the City shall make
application for same on forms supplied by the City and shall accompany
such application with a copy of the site plan.
B. The permit
fee for swimming pools shall be twenty-five dollars ($25.00).
