The International Existing Building Code, 2012 Edition, published
by the International Code Council, including Appendix Chapters A and
B.

Any person violating any provision of such code shall be punished as provided in Section
100.100 of the Mission City Code.

For the purposes of the International Existing Building Code,
2012 Edition, as adopted, the following words and phrases shall have
the following meanings:
a) The
term "code official" shall in all instances mean the Building Code
Official.
b) The
term "Board of Appeals" shall in all instances mean the Board of Code
Review.

The following provisions shall be added:
a) Section 113.4 Violation Penalties. At the end of the paragraph add the following language: Violation of any provision of this code shall be an unlawful act. Each separate day or any portion thereof, during which any violation of this code occurs or continues, shall also be deemed to constitute a separate offense, and shall be punishable as provided in Municipal Code Section
100.100.

The following amendments shall be made:
a) Section 101.1 Title. Amend the paragraph to read: These
provisions shall be known as the Existing Building Code of the City
of Mission, and shall be cited as such and will be referred to herein
as "this code".
b) 105.5 Expiration. Amend the paragraph to read: "Every permit
issued by the Building Code Official under the provisions of this
code shall expire by limitation and become null and void if:
1. The building or work authorized by such permit is not commenced within
180 days from the date of such permit, or
2. The building or work authorized by such permit has not progressed
to the point of the next required inspection within 180 days of either
the issuance of the permit, or from the date of the last inspection.

Before such work can be recommenced, a new permit shall be first
obtained to do so, and the fee therefore shall be one-half the amount
required for a new permit for such work, provided no changes have
been made or will be made in the original plans and specifications
for such work; and provided further that the untimely progress has
not exceeded one year. In order to renew action on a permit that has
expired for a period exceeding one year, the permittee shall pay a
new full permit fee. The Building Code Official is authorized to grant,
in writing, one or more extensions of time, for periods not more than
180 days each. The extension shall be requested in writing and justifiable
cause demonstrated.

c) Section 108.2 Schedule of permit fees. Amend the paragraph
to read: On buildings, electrical, gas, mechanical and plumbing systems
or alterations requiring a permit, a fee for each permit shall be
paid as required in accordance with the schedule as adopted by resolution
of the City Council.
d) 113.3 Prosecution of violation. Amend the paragraph to read:
Any person failing to comply with a notice of violation or order shall
be deemed guilty of an unlawful act. If the notice of violation is
not complied with, the Building Code Official may request the legal
counsel of the jurisdiction to institute the appropriate proceeding
at law or in equity to restrain, correct or abate such violation,
or to require the removal or termination of the occupancy of the building
or structure in violation of the provisions of this code or of the
order or direction made pursuant thereto.
e) Section 113.4 Violation Penalties. At the end of the paragraph add the following language: Violation of any provision of this code shall be an unlawful act. Each separate day or any portion thereof, during which any violation of this code occurs or continues, shall also be deemed to constitute a separate offense, and shall be punishable as provided in Municipal Code Section
