Out of concern for the health, safety and welfare of the residents,
guests and travelers on Village streets in the Village of Castleton-on-Hudson,
and so as to locate all applicable Village vehicle and traffic laws
within a single, concise local law, pursuant to the provisions of
the New York State Vehicle and Traffic Law and the New York State
Village Law, the Village of Castleton-on-Hudson Board of Trustees
does hereby enact this chapter superseding all prior local laws, regulations
and ordinances relative to vehicular traffic and parking on Village
streets.
Pursuant to this chapter, the following rules and regulations
shall apply to all vehicular traffic on Village streets.
Vehicular traffic shall not proceed at a speed faster than 30
miles per hour on any Village street unless otherwise posted, and
not faster than 20 miles per hour in a school zone.
No one shall obstruct any Village street so as to prevent the
passage of vehicles and/or pedestrians.
It shall be unlawful to make repairs to any vehicle in any Village
street except in an emergency.
No persons shall place or deposit any ashes or other rubbish
in or upon any street, except for the purpose of removal, and in that
case, the same must be removed within 24 hours after it is so placed;
nor shall snow be placed or deposited in or upon any street.
There shall be no parking where indicated by appropriately posted
signs in the Village of Castleton-on-Hudson; or as directed by the
Mayor during declared public emergencies.
Bicycles or similar vehicles, or any motorized vehicle, shall
be operated on Village streets only in accordance with the rules and
regulations set forth in or derived from the New York State Vehicle
and Traffic Law.
All provisions of the New York State Vehicle and Traffic Law
relative to stop and yield signs shall be applicable on Village streets
and intersections, as well as the provisions of New York State Vehicle
and Traffic Law relative to electronic traffic control devices.
The streets of the Village of Castleton-on-Hudson hereafter
named are hereby designated as main arteries of travel, and all vehicles
approaching such streets shall, before entering, come to a full stop,
unless otherwise directed by the police or traffic signal:

The Superintendent of Public Works shall install and maintain
traffic control devices and/or signs when and as required under the
provisions of this chapter, to make effective the provisions of said
chapter, and may install and maintain such additional traffic control
devices and/or signs as may be deemed necessary to regulate, warn
or guide traffic, under this chapter, subject to the provisions of
§§ 1682 and 1684 of the New York State Vehicle and
Traffic Law, and subject to the directions of the Village Board of
Trustees.
The parking of vehicles is hereby prohibited in any of the following

The parking, standing or stopping of vehicles is hereby prohibited
in the fire lanes in the Village of Castleton-on-Hudson and subject
to approval of the Village Board of Trustees.
A.
First Street shall be a one-way street in the following locations:
(1)
Northerly from Scott Avenue to Seaman Avenue and southerly from Scott
Avenue to Stimpson Avenue.
B.
Vehicular traffic shall proceed one way only on Green Avenue in a
general easterly direction from the east side of the firehouse to
the intersection of Green Avenue with Van Buren Avenue and Hudson
Street.
C.
Second Street shall be a one-way street in a northerly direction.

The Village of Castleton-on-Hudson Superintendent of Public
Works is hereby empowered to place emergency no parking signs throughout
the Village of Castleton-on-Hudson so as to protect the interests
of the public safety and health during any emergency situation, including
but not limited to snow or flood emergencies.
No vehicle shall be operated on any Village street except in
accordance with the tonnage limitations set forth in the New York
State Vehicle and Traffic Law, and any and all rules and regulations
derived therefrom.
A.
The parking of vehicles in the Village of Castleton-on-Hudson on
the west side of South Main Street (Route 9J) in front of the Post
Office Building shall be limited to no more than 15 minutes during
the hours of 7:00 a.m. and 5:00 p.m,. Monday through Friday, postal
holidays excepted.
B.
The parking of vehicles in the Village of Castleton-on-Hudson on
the west side of South Main Street (Route 9J) between Scott Avenue
and the north side of the United States Post Office Building located
at 108 South Main Street for a period longer than two hours between
the hours of 7:00 a.m. and 6:00 p.m., Sundays and holidays excepted,
is hereby prohibited.
C.
Parking shall be prohibited, and signs may be posted accordingly,
on the north side of Stimpson Avenue from First Street to South Main
Street, between 8:30 a.m. and 8:30 p.m., Monday through Friday, with
the exception of holidays. These parking areas are for Village business
and the Library during these hours.

All of the provisions of the New York State Vehicle and Traffic
Law, and any and all rules and regulations derived therefrom, not
hereinbefore specifically stated, are nonetheless incorporated herein
by reference and made applicable on all streets in the Village of
Castleton-on-Hudson.
As used in this chapter, the following terms shall have the
meanings indicated:
Includes all streets, avenues, lanes, highways, roadways,
surfaces and alleys located within the Village of Castleton-on-Hudson
dedicated and accepted by the Village Board of Trustees, excepting
therefrom state highways and county routes unless specifically included
herein.
Blocking of Village streets so as to prevent the passage of
emergency or maintenance vehicles is strictly prohibited, and any
such improperly parked vehicle may be towed pursuant to the direction
of the Village, with any costs attendant to towing and storage to
be borne by the owner of the improperly parked vehicle and paid prior
to release of such vehicle.

A.
The Code Enforcement Officer shall have the power and authority to
provide for the removal, immobilization and storage of vehicles parked
in violation of any statute, ordinance, rule or regulation and of
vehicles on which there are outstanding traffic warrants or fines
for parking violations.
B.
Such vehicles may be removed, immobilized and stored by or under
the direction of the Code Enforcement Officer by means of towing or
other means of removal, securing by use of a wheel lock or other immobilization
device, and storage at a public or private impound lot as shall be
designated by the Code Enforcement Officer.
C.
Such removal, immobilization and storage shall be at the expense
and risk of the owner of the vehicle.

When an immobilization device is used, the Code Enforcement
Officer shall attach to the vehicle a notice containing the following
information:
A.
The location and identifying characteristics of the vehicle.
B.
Date and time of placement of the device and signature of the installer.
C.
Notice that further parking restrictions will be waived during the
immobilization period.
D.
Notice that any person tampering with the device or the vehicle will
be subject to prosecution and liable for any loss to the Village.
E.
The steps which the owner must take to obtain release of the vehicle.
F.
Such other information, statements, notices and warnings as the Code
Enforcement Officer shall from time to time determine.

Any attempt by any person to tamper with, deface, remove or
destroy an immobilization device or to move by any means a vehicle
towed or secured as herein provided may result in the prosecution
of such person for any offense separate from and in addition to the
parking violations; in addition, such person shall be liable for any
loss suffered by the Village due to any such attempt.

A.
Any vehicle removed, immobilized or stored as herein provided shall
be promptly released to its owner upon the payment of outstanding
parking fines, the satisfaction of outstanding traffic warrants and
the administrative costs authorized herein.
B.
While a vehicle is immobilized as herein provided, parking restrictions
to which such vehicle may be subject shall be suspended during such
immobilization period.

If any provision of this chapter or the application thereof
to any person or circumstances is held invalid, the validity of the
remainder of this chapter and of the application of such chapter to
other persons and circumstances shall not be affected thereby.

This chapter shall supersede any and all the provisions of ordinances,
rules or regulations previously enacted or promulgated which are inconsistent
with the provisions of this chapter.

Any amendments to this chapter shall take effect immediately
upon the filing of the amendments with the New York Secretary of State.

The following streets are to be used for local traffic only:
A.
Second Street.

Every person convicted of a traffic infraction for a violation
of any provision of this chapter which is not a violation of the Vehicle
and Traffic Law of the State of New York shall, for a first conviction
thereof, be punished by a fine of not more than $150 or by imprisonment
for not more than 15 days, or by both such fine and imprisonment;
for a second such violation within 18 months thereafter, such person
shall be punished by a fine of not more than $300 or by imprisonment
for not more than 45 days, or by both such fine and imprisonment;
upon a third or subsequent conviction within 18 months after the first
conviction, such person shall be punished by a fine of not more than
$450 or by imprisonment for not more than 90 days, or by both such
fine and imprisonment.
