A. 
Definition. As used in this Section, the term "feral cat" means any cat of any breed that is or becomes undomesticated, untamed and wild or is not a pet.
B. 
Feeding Of Feral Cats Or Feral Cat Colony Without A Permit. No person or organization or entity shall provide food, water or forms of substance to a feral cat colony or individual feral cat without a feral cat colony caretaker permit issued by the City.
C. 
Obtaining Feral Cat Colony Caretaker Permit. Any individual who is a legal resident of the City of Platte City over the age of eighteen (18) may submit an application with the City Clerk for a feral cat colony caretaker permit. Only nine (9) permits will be issued at one (1) period of time. The Board of Aldermen may when necessary issue additional permits. On an annual basis, the City Board of Aldermen will set the application and permit fee for a feral cat colony caretaker permit. The application shall be on a written form provided by the City Clerk and shall provide the following information:
1. 
The name, address and other contact information for the applicant and any other personal information of the applicant that may be required by the City.
2. 
A detailed description of the feral cat colony and its location including the address of the private property where the colony will be maintained.
3. 
Written permission from the private property owner to house and maintain the feral cat colony at the address.
4. 
Written permission from the property owners in the area within two hundred (200) feet from each property line where the feral cat colony is located. If applicant is the leasee of said property, written permission from the property owner is required.
5. 
Maintain proof that the feral cats in the colony have been neutered or spayed and vaccinated against rabies or actively being trapped to perform the neutering or spaying and vaccination against rabies.
D. 
Term Of Permit. Feral cat colony caretaker permits shall be issued for a period of one (1) year and any subsequent permit by the same applicant will require a new application.
E. 
Inspections. An Animal Control Officer employed by the City or as an agent of the City in cooperation with another agency may inspect the private property where the feral cat colony will be maintained or is being maintained at any time during the permit term.
F. 
Prohibited On Public Property. No feral cat colony caretaker permit shall be issued for a feral cat colony located on public property.
G. 
Revocation — When. The City of Platte City may at its own recommendation or that by the City of Platte City Police Department revoke a feral cat colony permit for one (1) or more of the following reasons set forth in Section 205.315 below.

A. 
Upon three (3) days' written notice sent by regular first class mail to the address of record, the City may revoke a feral cat colony permit of any permit holder for any one of the reasons below:
1. 
Conviction of any violation of this Section or any other animal State, Federal or local ordinance involving animals or any City of Platte City Code regarding animals.
2. 
Failure by the permit holder or private property owner to permit an Animal Control Officer or any other agent of the City of Platte City to inspect the private property at which the feral cat colony is located.
3. 
Failure of the permit holder to provide care to the feral cat colony as required below.
4. 
If the size of the feral cat colony increases from that size as originally represented to the City in the application process such that colony is a health hazard to the permit holder, or any other individual, or otherwise interferes with the peace and quiet enjoyment of any Platte City residence.
5. 
Within sixty (60) calendar days of notification of the permit revocation, the permit holder shall relocate the colony to the care of one (1) or more feral cat colony permit holders, at the permit holder's sole expense.

A. 
Regularly feed the cat colony including weekends and holidays.
B. 
Trap each cat over the age of eight (8) weeks in order to comply with requirements Subsections (C) through (F) below.
C. 
All cats must be spayed or neutered and vaccinated for rabies.
D. 
All cats must be tested for feline leukemia and feline immune deficiency virus. Those cats testing positive must be humanely euthanized or isolated indoors immediately after receipt of a positive test result.
E. 
Identify all trapped cats by tipping their left ear.
F. 
Have all cats vaccinated for rabies in addition to any other vaccinations or immunization requirement imposed by the State of Missouri, County of Platte or City of Platte City.
G. 
Maintain records on the location and size of the colony(s) as well as the vaccination, ear-tipping and spay and neuter records of colony cats.
H. 
Take all reasonable steps to remove kittens from the colony after they have been weaned, place kittens in with an organization or foster care. Capture/trap and spay the mother cat.
I. 
Obtain medical attention for any colony cat exhibiting illness, signs of rabies, distress or other unusual behavior and immediately remove that cat from the colony to prevent disease or injury to other cats in the colony or citizens of the City of the City Platte City, Missouri.
J. 
When possible, report the number of cats dying or otherwise ceasing to be part of the colony to the City Clerk in writing and the number of cats placed in animal shelters or permanent homes as companion cats.
K. 
All structures, pens, coops or yards where animals are kept or permitted to be shall be maintained in a clean and sanitary condition at all times devoid of all rodents and vermin and free from offensive, disagreeable or noxious smells or odors to the injury, annoyance or inconvenience of any person. Any all enclosed areas of any structure shall be constructed in such a way as to be dry at all times in the inside. The City Health Officer, Animal Control Officer, or any other agent of the City of Platte City may inspect, or cause to be inspected, any structure or premises and issue any such order as may be necessary to carry out the provisions of this Section.
L. 
Permit holders shall not allow any food to remain available and accessible for animal feeding for more than one (1) hour.
M. 
Permit holders shall list one (1) alternative individual for feeding and emergency care only. Alternate person may not be the record holder or the individual responsible for TNR services.

Any violation of this Article shall be punishable under Code Section 100.100 of the City Code. Each day that a violation of this Article continues is a separate offense.
