This article shall be known as the "Local Law Providing for
the Appointment and Compensation of the Deputy Town Clerk." This article
shall govern the appointment, job duties, and compensation of the
Deputy Town Clerk of the Town of Hartford.
The increased work load being required of the Town Clerk has
made it necessary to enable him or her the power to appoint a number
of Deputy Town Clerks. In accordance with § 10 of the New
York State Municipal Home Rule Law, § 30 of the New York
State Town Law, and § 27 of the New York State Town Law,
the Town of Hartford has the authority to create the position and
implement provisions for compensation. It is the intent to create
the position to serve at the pleasure of the Town Clerk, with compensation
being based on hourly wages for time worked.
The Town Clerk of the Town of Hartford shall have such powers
and duties as are set forth in the New York State Town Law § 30,
as amended. The position of Deputy Town Clerk is hereby established.
Said Town Clerk is permitted to employ not more than three deputies,
each of whom shall serve under the supervision and direction of the
Town Clerk and shall exercise the duties and responsibilities as assigned
by said Town Clerk. It is intended that this position shall be an
exempt position under the Civil Service Law and regulations. The person
appointed to this position shall be appointed by the Town Clerk and
shall serve at the pleasure of the Town Clerk. The position shall
be either a full-time or part-time position, as determined by resolution
of the Town Board. Compensation shall be established by the Town Board.
Pursuant to New York State Town Law § 27, entitled
"Compensation of Town officers and employees," it is hereby established
that the Town Clerk is permitted to employ not more than three deputies,
each of whom will be paid an hourly compensation to be determined
by the Town Board. When determined by the Town Clerk, one deputy will
have the authority to act for and in place of the Town Clerk in his
or her absence.
