Anyone, including any person, entity, public utility contractor
or homeowner who engages in any repair work, improvements, excavation,
digging of any kind in any street, avenue, road, alley, highway or
other public place located within the Borough, for a distance of 50
linear feet or greater, shall be required to restore the roadway consistent
with design and construction practices promulgated by the Pennsylvania
Department of Transportation, specifically Publication 408, inclusive of updates. A written plan that
includes the means and methods of trench restoration shall be submitted
to and approved by Greenville Borough prior to any work commencing.
In addition to restoration, all asphalt-covered roadways to which
this section applies shall be milled a minimum depth of 1 1/2
inches, resurfaced from face of curb to face of curb, where concrete
curbing is present, across the entire width of roadway along the entire
length of the excavation, including all restored trench areas. The
result shall be a seamless roadway surface pavement overlay with sealed,
keyed or saw-cut edges along the entire length of the excavation.
In addition, should any excavation or construction disturb a section
of sidewalk, the Borough Manager is hereby authorized to require a
complete, whole or in part, replacement of the sidewalk within the
area of disturbance or limits of construction.
Excavated areas affecting brick roadways (streets with partial
or full exposed brick cross section) shall be restored to a condition
equal or better than the condition of the roadway prior to the occurrence
of the excavation. Brick streets shall not be covered with asphalt
wearing surface. Said method of brick restoration shall be submitted
in writing to and approved by the Borough of Greenville prior to any
work commencing.

two or more openings in the street, avenue, road, alley, highway or
other public street or place any distance of 40 linear feet or less
of each other, shall be required to restore the roadway consistent
with design and construction practices promulgated by the Pennsylvania
Department of Transportation, specifically Publication 408, inclusive
of updates. A written plan that includes the means and methods of
trench restoration shall be submitted to and approved by Greenville
Borough prior to any work commencing. In addition to restoration,

shall be a continuous, seamless roadway surface pavement overlay with

In addition, should any excavation or construction disturb a section
of sidewalk, the Borough Manager is hereby authorized to require a
complete, whole or in part, replacement of the sidewalk within the
area of disturbance or limits of construction.
A two-year bond shall be required in an amount equal to the
restoration costs to the Borough should any restoration fail structurally.
The bond shall be submitted to the Borough prior to the approval of
any work commencing.
It is hereby authorized that if anyone so aggrieved by the requirements
of this article shall have the right to appeal in writing on a form
to be provided by the Borough of Greenville. Said appeal shall be
heard by the Street Committee. Any determination made by the Street
Committee shall be final and binding on the party believed to be aggrieved.
Any person or persons, firm or corporation violating any of
the provisions of this article, shall, upon conviction thereof, be
sentenced to pay a fine of not less than $100 nor more than $600 for
each day that the construction, excavation or repairs are not complete
in accord with the provisions of this article.
