There is hereby created a permanent Cemetery Fund to be set
apart and known as the "Perpetual Care Cemetery Fund of the City of
Warrenton, Missouri," which for brevity may be referred to as the
"Cemetery Fund."

The Finance Officer of the City of Warrenton and his/her successor
or successors in said office is hereby designated and appointed Ex-Officio
Trustee and/or Custodian of the said "Perpetual Care Cemetery Fund
of the City of Warrenton, Missouri."

Any money paid to the Warrenton Cemetery Fund, or any other
organization designated by the City of Warrenton or to the City of
Warrenton, Missouri, intended for the perpetual care of any lot, part
of lot or grave, if the sum is in compliance with this Article, will
be accepted by the City of Warrenton and turned over to the Finance
Officer to be made a part of the Cemetery Fund of the City of Warrenton,
Missouri.

All sums of money prior to August 6, 1946, paid to the City
of Warrenton, or some organization designated by it for the perpetual
care of any lot or grave, will be made a part of the Cemetery Fund
of the City of Warrenton, Missouri.

The income from the Cemetery Fund shall be expended by the City
of Warrenton for the preservation, care, upkeep and adornment of such
cemetery, for the repurchasing of cemetery lots previously sold or
for no other purpose.

The principal from the Cemetery Fund shall not be encroached
upon for any purpose whatsoever and no money shall be transferred
out of such Cemetery Fund except for the purpose of being reinvested
as provided for in this Section and for the repurchasing of cemetery
lots previously sold.

A. The
unsold cemetery lots and graves contained in the cemetery donated
by the Warrenton Cemetery Association to the City of Warrenton by
virtue of a resolution of said association bearing the date of the
twenty-sixth (26th) day of May, 1931, and in pursuance of which this
Chapter is adopted, shall from time to time be sold to such persons.
The City Clerk shall cause to be executed and delivered to such purchaser
a proper cemetery deed covering such lot or grave, which said deed
shall be signed by the Mayor of the City of Warrenton and attested
by the City Clerk and the Seal of said City of Warrenton shall be
thereunto affixed.
B. The
Mayor of the City of Warrenton, when his/her signature is duly attested
by the City Clerk of said City, is hereby designated to be the proper
official to sign such cemetery deed and thereby convey the title to
any lot or grave in such deed described to the purchaser thereof.
All such title, however, shall be subject to all appropriate rules
and regulations which are now in force or which may from time to time
hereafter be adopted relating to the proper care, maintenance and
beautification of the said cemetery by the said City of Warrenton
or caretaker duly designated by the Board of Aldermen of the City
of Warrenton from time to time to have charge of the said cemetery.
C. Previously
purchased cemetery lots in the Warrenton City Cemetery can be sold
back to the City of Warrenton for one hundred dollars ($100.00) per
lot. Either the original deed reflecting ownership by the individual
selling the lot or documentation acceptable to the City establishing
ownership must be presented at the time of the request for purchase.
A deed reflecting the change of ownership back to the City will be
prepared by the City and must be executed by the seller.
D. All
deeds issued for the sale of lots in the Warrenton City Cemetery will
be recorded at the Warren County Recorder's office by the City. When
lots are sold by the City, the cost of the recording fee will be added
to the cost to be paid by the purchaser at the time the cemetery lot
is purchased. When lots are purchased by the City, the cost of the
recording fee will be paid by the City.

Upon the sale of any cemetery lot, the City shall set aside
and deposit in the endowed care fund fifteen percent (15%) of the
gross sales price, or twenty dollars ($20.00), whichever is greater,
for each grave space sold.

The title to said cemetery of the said Warrenton Cemetery Association
shall, when and as the same is conveyed to the said City by the proper
officers of the said Warrenton Cemetery Association described as follows
to wit:
A certain tract or parcel of land consisting of twenty-four
and one half (24½) acres, described substantially as follows:
Bounded on the west by the present City Cemetery of the City of Warrenton,
Warren County, Missouri; on the North by the right-of-way of the Wabash
Railroad Company; on the East by the Warrenton and Truxton Public
Road and on the South by the lands of Hollman and Mech, situated in
the Southeast quarter (¼) of Section Twenty (20), Township
Forty-Seven (47), Range Two (2) West, in Warren County, Missouri.
forever remain vested in the said City and at no time disposed
of by sale or otherwise. Neither shall the Board of Aldermen of the
said City at any time abdicate or delegate to any society the absolute
and unrestrained management thereof, but any delegation of the care,
maintenance or beautification of the said cemetery shall at all times
be upon condition that such delegation may when deemed prudent by
the Board of Aldermen and the welfare, security and proper care of
said cemetery so demand be revoked with or without notice as the exigencies
of the occasion may to said Board's sole discretion seem proper.

The care, maintenance, management and beautification of said
cemetery shall be delegated only to such persons or society of persons
whose responsibility and prudence shall to the said Board of Aldermen
seem unquestioned and only for such time as such persons or society
of persons shall demonstrate a capacity for the proper care, maintenance,
management and beautification thereof.

No part of the annual interest accruing from the investment
of the capital or principal sum of said Cemetery Fund shall be paid
over to any person, persons, or society of persons, who do not first
furnish proper evidence that the person, agent, or officer proposed
to receive the same shall have given sufficient bond guaranteeing
the proper, prudent and faithful disbursement thereof for the sole
purpose of the care, maintenance and beautification of the said cemetery.

Subject to the provisions of this Article, the proposed donation of the said cemetery and all other assets of the Warrenton Cemetery Association of Warrenton, Missouri, is hereby accepted. Said cemetery being the premises described in Section
145.090 of this Article and said other assets are hereby acknowledged to be the sum of eight hundred dollars ($800.00) in cash which said sum is hereby accepted and set apart as a Perpetual Care Cemetery Fund to be known as the "Permanent Cemetery Fund of the City of Warrenton, Missouri," and to be forever preserved and kept intact and to be added to by proceeds from the sale of cemetery lots as hereinbefore and hereinafter set forth and provided.

In addition to the proceeds of the sale of lots hereinbefore
declared a part of the said capital or principal sum of the said Cemetery
Fund the said Trustee and/or Custodian may and, when offered, shall
accept donations to said fund from any source and give his/her receipt
therefor and such donations shall be promptly turned over to the Finance
Officer for deposit.

B. Pricing
for non-residents shall be as follows:
1. The price of graves and lots in the cemetery of the City of Warrenton,
Missouri, sold to persons who are neither residents nor owners of
real property in the City of Warrenton, Missouri, but are residents
of, or owners of, real property in the County of Warren, Missouri,
shall be double the amounts herein above set out.
2. The price of graves and lots in the cemetery of the City of Warrenton,
Missouri, sold to persons who are neither residents nor owners of
real property in the County of Warren, Missouri, shall be four (4)
times the amounts herein above set out.
C. Residency
status will be verified by City staff and the purchaser shall present
one (1) of the following indicating residency or property ownership
within the City of Warrenton or Warren County: State-issued photo
ID, a passport, utility bills, voter registration card, bank statement,
property tax receipt, mortgage or lease documents, insurance policy
or card, W-2, 1099 Form, educational transcripts, or a letter from
a government agency.
D. The
burial of cremated human remains shall be permitted in the City Cemetery
subject to any policy of the City. Burial of cremated human remains
shall receive the prior approval of the City's designee. A grave site
owner(s) is allowed to bury up to two (2) cremated human remains on
a single grave site. Burial of cremated human remains shall be on
a site purchased by the deceased or on a site on which a notarized
affidavit consenting to such burial has been obtained from the owner(s)
thereof. Cremated human remains buried in the City Cemetery shall
be contained in a non-biodegradable, solid material container and
buried at the head-end of the grave site. If a second (2nd) container
of human remains is buried on a single grave site, said human remains
shall be contained in a non-biodegradable solid material container
and buried at the foot-end of the grave site.
E. All
burials, except the burials of the ashes of cremated bodies, shall
be in vaults or concrete boxes.
F. All
lot corner markers and all grave borders shall be flush with the ground
and are subject to the approval of the Grounds and Maintenance Director.
Concrete or brick walls are not permitted in marking plots.
G. Internment
of a body other than the documented owner of the cemetery lot or person
previously designated by the documented owner shall require written
consent for such burial from the lot owners.

All graves or lots sold shall be subject to the regulations
now of record or hereafter provided by City ordinance, as to type
of markers, shrubbery, and other regulations affecting graves or lots
in the City Cemetery of the City of Warrenton, Missouri. All recordkeeping
shall be in accordance with Section 214.040, RSMo.

A. Henceforth
all monuments and grave markers erected in the City Cemetery of the
City of Warrenton shall be installed on a concrete base not less than
eighteen (18) inches deep and extend four (4) inches beyond the base
of the marker or monument in all four (4) directions and the top of
said base shall be flush with ground level. In the event any person
or persons fails to comply with this Article, the Chief of Police
is hereby authorized and empowered to remove any marker or monument
erected in violation of this Chapter. The City of Warrenton shall
have the authority to move any marker incorrectly placed.

At all times except as specified artificial flowers or similar
decorations may be placed upon or maintained upon a grave in the cemetery
of the City of Warrenton, Missouri. Said arrangement must be placed
next to the headstone so that it will not interfere with the mowing
of said cemetery. Additional decorations may be maintained at Christmas
and continuing thereafter until February first (1st). The caretaker
of said cemetery is hereby authorized and empowered to remove artificial
flowers or other similar decorations in poor condition and to dispose
of them forthwith if they are placed on the graves in violation of
the above regulations.

A. No
person, persons, firms or corporation shall use said cemetery for
any purpose other than the burying of dead, visiting and maintaining
the graves and for any other proper cemetery purposes.
1. Loitering shall not be permitted in said cemetery.
2. Any person, persons, firm or corporation violating the provisions
of this Article shall be deemed guilty of a misdemeanor.

No shrubbery or other plants shall be planted in the City Cemetery
of the City of Warrenton by any person except authorized employees
of the City of Warrenton.

No obstructions such as trees, statuary, benches, etc., shall
be placed on or around the graves without the approval of the City
of Warrenton, Missouri pursuant to City policy.

No glass containers or figurines of ceramic, plastic, metal,
porcelain or similar material will be allowed in the cemetery and
will be removed for the safety of the caretakers, employees of the
City of Warrenton, Missouri, and the public.
