There is hereby created and established a Police Board for the
City of Plattsburg. The Police Board shall be a permanent subcommittee
of the Board of Aldermen.

At the first (1st) meeting of the Board of Aldermen after the
annual general election, the Mayor shall, with the concurrence of
the Board of Aldermen, appoint a Police Committee of three (3) voting
members which shall be composed of one (1) Aldermen from each ward,
one (1) of whom the Mayor shall designate as Chairman of the Police
Board. The Chief of Police and the City Administrator shall be non-voting,
ex officio members of the Police Board.

A. The
duties, responsibilities and authority of the Police Board be as follows:
1. Provide advice and recommendations to the Mayor and Board of Aldermen
on policy, proposed public safety ordinances, public safety staffing
and equipment levels, public safety program development, Police Department
structure and organization and other issues relating to the Police
Department, animal control, emergency management and other public
safety policy areas.
2. Review and comment on public safety policy issues and programs prior
to their presentation to the full Board of Aldermen.
3. Review and approve Police Department personnel search and applicant
review criteria on an as-needed basis.
4. Provide guidance and direction to the Chief of Police and City Administrator
regarding the development and implementation of long-range plans,
policies and studies related to public safety.
5. Provide advice and recommendations to the Mayor and City Administrator
regarding the recruitment, selection, retention or termination of
the Chief of Police.

A. The
Police Board shall serve as an appeal board to which citizens may
appeal administrative decisions related to public safety issues, Police
activities or misconduct by City public safety employees. The City
Administrator and the Chief of Police may attend meetings of the Police
Board acting as an appeals board but shall not be ex officio members
of the Board during the citizen appeals process.
B. Except
in exceptional circumstances, the Police Board shall not accept such
appeals unless the appellant has first attempted to resolve the problem
through the City administrative and management system.
C. The
City administrative and management appeals process to the Police Board
shall be as follows:
1. Initial complaint is addressed by the Chief of Police (or if the
complaint is against the Chief of Police to the City Administrator).
2. Police Chief attempts to resolve issue.
3. Appellant may verbally appeal to the City Administrator in the event
the Chief of Police does not satisfactorily resolve the complaint.
4. The appellant may appeal in writing to the Police Board in the event
that the City Administrator does not satisfactorily resolve the complaint.
5. The appellant may appeal to the full Board of Aldermen in the event
that their complaint is not satisfactorily resolved by the Police
Board.
