As used in this chapter, the following terms shall have the
meanings indicated:
MOTOR-DRIVEN VEHICLE
Any vehicle designed for the transportation of persons or
property and propelled by an internal-combustion engine or other type
of engine, and shall include, without being limited to:

Minibikes, motor scooters, motorbikes, dune buggies, trail bikes,
all-terrain vehicles, go-carts, and other vehicles not capable of
being registered under Title 39 of the New Jersey statutes.
PUBLIC PROPERTY
Any land, premises, right-of-way, easement or other estate
or property right, other than streets, roads and highways governed
by Title 39 of the New Jersey statutes, owned by the Borough of Buena
or any agency or instrumentality thereof and shall include, without
being limited to, parks, recreation areas, ball parks, sidewalks,
school grounds and parking areas.

A. It shall be unlawful for any person to operate or permit another
person to operate any motor-driven vehicle, as defined herein, on
any public property in the Borough of Buena, and on private property
in the Borough of Buena without first securing the written consent
of the landowner, his duly authorized representative or a person who
has a contractual right to use such property:
(1) In a careless, reckless or negligent manner so as to endanger or
be likely to endanger the safety or property of any person.
(2) In such a manner as to create loud, offensive, unnecessary or unusual
noises so as to disturb or interfere with the peace and quiet of other
persons within the municipality.
B. It shall be unlawful for any person to continue to operate or permit another person to continue to operate any motor-driven vehicle, as defined herein, within the Borough of Buena on any private property after the written consent, as provided in Subsection
A above, has been withdrawn.
C. The prohibition provided for in Subsection
A. of this section shall not apply to the operation of motor-driven vehicles on public streets, roads and highways which are governed by Title 39 of the New Jersey statutes. Motor-driven vehicles operated on any public street, road or highway shall be governed solely by the provisions of Title 39.

Any person who violates any provision of this chapter shall be subject to such penalties as set forth in Chapter
1, General Provisions, Article
III.
