This chapter shall be known as the "Perkiomen Township Park
and Open Space Rules and Regulations Ordinance."
This chapter shall regulate the activities of persons in any
park and/or open space property owned and maintained by Perkiomen
Township.
The Township parks and open space areas shall be open from sunrise
to sunset, unless special permission is granted in advance by the
Perkiomen Township Board of Supervisors.
Any person or persons, firm, corporation or other legal entity
who suspects or knows of a violation of this chapter should file a
written citizen's complaint with the Perkiomen Township Code
Enforcement Officer. The Township Code Enforcement Officer shall investigate
all complaints. If as result of the investigation the Township Code
Enforcement Officer determines that a violation of this chapter has
occurred, he/she shall issue a written warning to the person(s) responsible
for the violation or, in his/her sole discretion, issue a summary
nontraffic citation to the person(s) responsible for the violation.
Any person or persons, firm, corporation or other legal entity
who shall violate or permit a violation of this chapter, upon being
found guilty in a summary proceeding before the Magisterial District
Judge having jurisdiction pursuant to the Pennsylvania Rules of Criminal
Procedure, shall pay a fine or not more than $1,000 plus court costs
for each and every offense and, on default of payment of fine and
costs, be liable to imprisonment for not more than 90 days.
In addition to any enforcement or penalty referred to above,
any individual, firm, corporation or other legal entity who causes
damage to any park or open space area, or to any furniture, utility,
receptacle, equipment, fixture, structure or other public property
or amenity, shall reimburse Perkiomen Township for the full cost thereof,
including the cost of labor to repair and/or replace said damage.
