There is hereby established the office of Court Clerk for the
City of Ozark Municipal Division of the Christian County Circuit Court.

The City Administrator, with the advice and consent of the Municipal
Court Judge, shall employ a Municipal Court Clerk along with such
Deputy Clerks as may be necessary for the efficient operation of the
Municipal Court. The Deputy Clerk or Clerks shall have authority co-extensive
with the Clerk subject to the supervision and direction of the Clerk.
The Municipal Court Clerk and any Deputies so employed shall serve
in accordance with the City's personnel system regulations.
The Court Clerk shall attend all sessions of the Ozark Municipal
Division of the 38th Judicial Circuit Court and may be required to
be present at the Ozark City Hall to perform the duties of the office
at such additional times as the Mayor or Board of Aldermen may specify.
Compensation for the Court Clerk shall be established by ordinance
from time to time.

A. The
duties of the Clerk and deputies shall be as follows:
1. To collect such fines for violations of such offenses as may be prescribed
and the Court costs thereof;
2. To take oaths and affirmations;
3. To accept signed complaints and allow same to be signed, sworn to
or affirmed before him/her;
4. Sign and issue subpoenas and/or subpoenas duces tecum requiring the
attendance of witnesses and production of documents;
5. Accept the appearance, waiver of trial and pleas of guilty and payment
of fine and costs in Traffic Violations Bureau cases as directed by
the Municipal Judge; generally act as Clerk of the Traffic Violations
Bureau;
6. Perform all duties as provided for by ordinance, by rules of practice
and procedure adopted by the Municipal Judge, Supreme Court Rules
and by Statute;
7. Maintain, properly certified by the City Clerk, a complete copy of
the ordinances of the City which shall constitute prima facia evidence
of such ordinance before the Court. Further, to maintain a similar
certified copy on file with the Clerks serving the Circuit Courts
of this County;
8. Maintain permanent files and records of the Municipal Court proceedings
and to have the care and custody of the same;
9. Prepare, under the supervision of the Municipal Judge, all reports
required of the Municipal Judge or of the Municipal Court by State
Statutes, this Chapter or other City ordinances;
10. Keep complete records regarding fines, penalties, costs and any other
charges arising out of any action in the Municipal Court; and
11. Tax all costs, make out all bills and executions and make out and
issue all processes of the Municipal Court.
Within fifteen (15) days after appointment and before entering
upon the discharge of the above-described duties of office, the Court
Clerk and any deputy court clerks shall give bond to the City in an
amount as set by administrative policy from time to time, conditioned
upon the faithful performance of said duties and the said Court Clerk
will pay over all monies belonging to the City, as provided by law,
that may come into the Court Clerk's hands.
