The purpose of the provisions of this article is to provide
for the curtailment of water usage through voluntary or mandatory
restrictions or reductions in water usage during a water supply shortage
affecting the City and its adjacent service areas.

The City Council, after consultation with the City Manager and the Director of Public Works concerning the condition of the City's water supply and the possibility or probability of any shortage therein, may declare a Stage I, II or III water shortage as set forth below in §§
30-102,
30-103 and
30-104.

The City Manager shall give public notice of restrictions on
water usage or reductions in water supply by having printed a notice
of same in a newspaper having general circulation in the City and
by having broadcast a notice of same on a radio serving the City.
Such restrictions in water usage or reductions in water supply shall
become effective on the date of first written publication thereof.

In the event that the City Manager orders a reduction in water supply and a person uses an amount in excess of the amount allotted to such user, then such person shall pay a surcharge of $5 per 1,000 gallons or any portion thereof used in excess of such allotment. In addition, the City Manager may terminate such person's water service for the duration of the water shortage, and such person shall be subject to the penalties set forth in §
30-108.

Any person may apply to the City Council for an exception from
the restrictions on water usage or the reductions in water supply
ordered by the City Manager. City Council will consider such applications
on a case by case method and will balance the economic or other hardship
to the applicant against the individual and cumulative impact on the
water supply resulting from the granting of such exception(s).

Any person violating any of the provisions of this article or any order of the City Manager made pursuant to §
30-104 or
30-105 shall be guilty of a Class 3 misdemeanor.

The City Manager may issue an order rescinding a previous order restricting water use or reducing the water supply and shall give public notice thereof as set forth in §
30-105 above. In addition, such order of rescission shall be reported to the City Council at its next scheduled meeting.
