A. Any
person desiring to operate a home occupation, as defined herein, shall
before doing so obtain a license from the City. Application for such
license shall be filed with the City Collector of said City. Said
application shall be accompanied by the appropriate license fee set
out in City licensing ordinances.
B. No
application for the issuance of a home occupation license shall be
considered or approved and no such license shall be granted or issued
until the owners of all real estate located within three hundred (300)
feet of the premises of the proposed location of the home occupation
have been given written notice of said application and an opportunity
to express to the City Council their approval of or objections to
said application and their reasons therefor. The City Council shall
consider the opinions of said property owners and all other relevant
factors before making its decision to approve or reject such applications.
Accordingly, the City Manager shall, upon receipt of an application
for a home occupation license, cause written notice of said application
to be sent by ordinary mail to the owners of all real estate located
within three hundred (300) feet of the premises upon which the proposed
home occupation is to be located, said distance to be measured from
property line to property line. The notice shall include the following:
1. The name of the applicant;
2. The location of the proposed home occupation;
3. The time and date the City Council will consider the license application;
and
4. A response form on which the property owner may indicate approval
or disapproval of the application and his/her reasons therefor.
C. The
application shall be reviewed by the City Manager to determine that
the applicant has complied or will comply with all of the application
regulations of the City. If the City Manager finds that the applicant
has complied or is prepared to comply with all applicable City regulations
and ordinances, he/she shall present the application to the City Council
for consideration. Whereupon, the City Council shall consider the
application, together with the aforesaid opinions of neighboring property
owners and all other relevant factors before making its decision to
approve or reject such application. If the application and the proposed
location of the home occupation is approved by the City Council, then
the City Collector shall be directed to issue the appropriate license
and the applicant may proceed to operate said home occupation.

All home occupation licenses shall be issued for a period ending
July 1 following the date of approval of application, subject to renewal
annually upon the filing of a new application for license and payment
of the appropriate renewal fee.

Any resident desiring to carry on a home occupation shall use
no sign other than a nameplate which shall be no larger than twelve
(12) inches by twenty-four (24) inches.
