A. There are hereby established two (2) cemeteries
in the City of Park Hills, Missouri, of which:
1. One (1) shall be known as the "City of Park Hills Cemetery," being
described as follows: lot 18, 19, 20, Block 46 of St. Joseph Lead
Company's first addition to the Town of St. Francois, as shown on
the plat of St. Joseph Lead Company's first addition to the Town of
St. Francois recorded in plat book #9 at page 17 in the Recorder's
Office of St. Francois County, Missouri; and
2. The other shall be known as "Hampton Cemetery," this cemetery is
at max capacity, being described as follows: ENT Elvins, Lot 3, Block
8.
B. Said cemeteries are hereby declared to
be a legal and proper place for the interment of persons who may die
in the said City of Park Hills or who may be brought into said City
for burial.

A. The City Administrator shall appoint a
Caretaker of the cemeteries and he/she shall report to the City Administrator.
B. It is hereby declared to be the duty of
the Caretaker to be at all times in readiness, either by himself/herself
or some competent person under his/her direction and responsible to
him/her, to perform the duties of his/her office, as hereinafter set
out, and any failure to perform the duties enjoined upon him/her shall
be cause for removal by the City Administrator.
C. It shall be the duty of the Caretaker to
open or cause to be opened any grave in said Cemetery as may be required;
to tend to the interment of all bodies of deceased persons; to fill
up and keep in good order all graves in said Cemetery and report the
conditions thereof to the City Administrator. It shall be the duty
of said Caretaker to tend the grounds, fences, gates, and all other
property of said Cemetery and the graves therein contained, and to
preserve same in good order, and to report to the City Administrator
all necessary repairs and all other matters touching the maintenance
of said Cemetery.

A burial permit must be obtained
from the Community Development Department prior to interment of any
deceased person.

All streets, avenues, walks, commons,
and lots of the Hampton Cemetery shall be known and recognized as
shown by the official map or plat of said Cemetery now on file with
the Community Development Department; and all lots sold shall be described
by numbers, blocks, streets, avenues, walks, or commons as same are
designated in said plat.

A. After application to the Community Development
Department, the Mayor shall make and deliver to the purchaser a certificate
of ownership, which shall be signed by the Mayor and countersigned
by the Community Development Department, and shall bear the Seal of
the City; said certificate shall be in the following form:

The City of Park Hills, by the Mayor,
certifies that _______________ of _______________ is the owner of
Lot No. _____ of Block No. _____ in the Hampton Cemetery/City of Park
Hills Cemetery of the City of Park Hills, County of St. Francois,
and State of Missouri, as shown by the official plat or map of said
Cemetery, filed with the Community Development Department, and duly
recorded in the Recorder's Office of said County for which said _______________
and _______________ heirs and assigns are entitled to the use of said
lot, in fee simple, for the purpose of sepulchre alone, subject at
all times to the rules and regulations which may be made by the Mayor
and City Council of the City of Park Hills in reference thereto.

IN TESTIMONY WHEREOF, the Mayor of
the City of Park Hills has signed this certificate and caused the
same to be countersigned by the Community Development Department,
with the Seal of the City thereto attached, this the _____ day of
_______________, A.D. 20_____.

B. The Community Development Department is
required to keep a full and complete record of all sales of lots,
and of each burial in a well bound book, to be kept for that purpose.
Such records shall be made within ten (10) days after the interment,
and the Clerk shall record the name of the deceased person, the date
of interment, the age, sex, color, nativity, locality of the death,
the disease of which said person died, the name and residence of the
attending physician, and the number of the lot and the exact place
in said lot, if said lot shall be more than a one (1) grave lot, of
such person interred.
C. The Caretaker shall give to the said Community
Development Department all information necessary to compile or complete
said record.
D. No grave in said Cemetery shall be less
than the following depths: For an adult, each grave shall be at least
five (5) feet six (6) inches deep, and for a child each grave shall
be at least five (5) feet deep.

All indigent persons, that is to
say, persons who have no funds and no relatives able and willing to
purchase a lot for them, shall be buried in the commons, if there
is sufficient ground.

No shrubbery, florals, greenery or
trees shall be planted in the Hampton Cemetery except with the written
consent of the City Administrator and the greenery is enclosed in
a pot that can be easily removed. Anyone violating this provision
shall be required to remove or transplant such shrubbery at his/her
expense, upon notice to do so. Upon failure to remove or so transplant
such shrubbery upon receipt of notice, the Caretaker shall remove
said shrubbery at the cost of the lot owner or owners.

It shall be unlawful for any person
to erect, construct, or build around or upon any grave-lot or lots
in the City, any curb, coping or wall.

Before any person, firm or corporation
shall be permitted to place foundations, monuments, or markers in
any Cemetery in the City, a permit shall be obtained from the Community
Development Department. Said permit may be obtained by making a request
to the City of Park Hills. Two (2) copies of the permit shall be given
to the person, firm or corporation and the said person, firm or corporation
shall give one (1) copy to the Caretaker before work is begun in placing
a foundation monument or marker.

A. All monuments or markers placed in the
Cemetery shall be placed in accordance to the following requirements:
1.
Park Hills Cemetery. All monuments
or markers placed in the Cemetery shall be placed on a foundation
in accordance with the following direction: Concrete for any foundation
on which a monument or marker is placed shall be mixed in not less
than one (1) part Portland cement, two (2) parts sand, four (4) parts
crushed stone or clean gravel and enough water that will provide a
plastic or workable concrete mix. The above proportions of cement,
sand, crushed stone or clean gravel shall be thoroughly mixed in a
mixer or container, then enough clean water added to make a plastic
or workable concrete before placing in place for the foundation.
2.
The foundation shall be of sufficient
size and depth to withstand the weight of the monument or marker.
The foundation shall extend four (4) inches out from the monument
or marker. The foundation shall be one (1) inch higher at the monument
or marker and sloping to ground level. The monument or marker shall
not be placed on foundation until the concrete has cured enough to
withstand the weight of the monument or marker.
B. Hampton Cemetery. All monuments or markers
placed in this Cemetery shall be consistent with the placement size,
foundation that has been used in the past. The Caretaker shall approve
or disapprove on a case-by-case basis.
C. The Caretaker shall be present at the time
the foundation and monument or marker is placed. Copies of this Section
of this Chapter shall be printed and given with each permit obtained
from the Community Development Department.

The violation of any provision of
this Chapter shall be deemed an ordinance violation, and upon conviction
thereof, the person so violating said provision of this Chapter, shall
be fined not more than five hundred dollars ($500.00), or imprisoned
in the City or County Jail for a term of not more than ninety (90)
days; provided, further, that anyone willfully defacing any gravestone,
tombstone, marker, monument or any ornamentation of any lot or grave
or willfully injuring or destroying any shrubbery, trees or herbage
or other property of said Cemetery shall be deemed guilty of an ordinance
violation and fined not more than five hundred dollars ($500.00),
or imprisoned in the County or City Jail not more than ninety (90)
days, or both such fine and imprisonment.
