In order to protect property owners, residents and persons lawfully and peacefully using the public ways, places and sidewalks in the village and, further, to prevent vandalism and criminal acts, the Board of Trustees does hereby enact the following curfew regulations pursuant to its police power and statutory power to protect and promote the public health, welfare and safety of the inhabitants of the village.
No person 17 years of age or younger shall be permitted to be upon any sidewalk or other public way or place within the Village of Chatham, whether in a vehicle or on foot, during the following hours unless said person is in the company of his parent or legal guardian:
A. 
Monday through Friday: 12:00 midnight to 5:00 a.m.
B. 
Saturday and Sunday: 1:00 a.m. to 5:00 a.m.
A. 
The provisions of this chapter shall not be applicable to any minor under the age of 17 years during the time necessarily required for such minor to travel to his residency from the following if the minor shall be in attendance:
(1) 
A place of employment at which the minor may be gainfully employed.
(2) 
A school or place of instruction at which the minor may be in bona fide attendance.
(3) 
A place at which a function may be held that shall be or had been sponsored by a religious, school or civic organization.
B. 
Should an emergency arise necessitating a minor child under the age of 17 years to be dispatched upon an errand requiring his presence in or upon a street or automobile or in any public or quasi-public place during the curfew hours, he shall have in his possession a note signed by the parent, guardian or other person having custody, care or control of such minor child, stating the nature of the errand, the necessity therefor and place to which he is to go, the time the note was issued and the time required for the errand. The abuse of the provisions of this section shall constitute a violation of the provisions of this chapter.

Any person who shall violate any of the provisions of this chapter shall be subject to a civil fine in an amount not to exceed $50 for the first violation and $250 for each additional violation.
