The purpose of this article is to protect the health, safety, and welfare of residents of the Village of Chatham and to protect the diverse building structures in the Village of Chatham from deterioration, and to accomplish the foregoing at the lowest cost to property owners and occupants.
The Village Board finds and declares that the registration of rental property is intended to and will ensure the protection of persons and property in all existing rental structures and on all structures required to be registered under this article of the Village Code and ensure that rental property owners and prospective rental property owners are informed of and adhere to the Code provisions.
This article of the Village Code shall apply to every rental structure, including dwellings, dwelling units, and units used for commercial enterprise that are leased, rented, let, assigned, or otherwise classified as rental property, with or without valuable consideration, by an owner-occupant, an absentee owner, or legal agent on behalf of the owner.
As used in this article, the following terms shall have the meanings indicated:
ADMINISTRATOR
The Building Inspector or his designee.
AGENT
Any person who has charge, care, or control of a building or any part thereof.
ENFORCEMENT AGENCY
The Village of Chatham Police Department shall enforce the provisions of this article.
OWNER
Any person or entity who, alone or with others, has fee title or an equitable interest in real property.
OWNER-OCCUPIED STRUCTURE
A structure occupied by its owner or by members of his or her family on a nonrental basis.
PROPERTY
Any structure which is wholly or partly used or intended to be used as habitable space for human occupants or used for commercial enterprise.
A. 
Registry of rental property. All rental property shall be registered with the Village by the owner as required herein.
B. 
All rental property existing as of the effective date of this article shall be registered on or before 60 days after the effective date of this article.
C. 
The owner of new rental property or property that is newly converted to rental property shall register the rental property prior to allowing occupancy.
D. 
The owner of any rental property already registered with the Village shall reregister within 30 days after any change occurs in registration information. A new owner of a registered property shall reregister the property within 60 days of assuming ownership.
E. 
The Village shall maintain a registry of all rental properties containing the following information, which shall be provided by the owner on forms available from the Clerk of the Village of Chatham:
(1) 
The name, legal residence address, and telephone number of the owner and any agent in control of the rental property, and in the event the owner or agent is not a natural person, then the owner information shall be that of the president, general manager, or other chief executive officer of the organization. Where more than one natural person has an ownership interest, the required information shall be included for each owner, agent, and/or responsible person who may be reached day and night by appropriate authorities of the Village of Chatham.
(2) 
The number and type of rental units on the rental property.
(3) 
The address of the rental property.
(4) 
The employer identification number in the event that the rental property is owned by a corporation or other business entity.
It shall be a violation of this article for an owner or a responsible person to provide inaccurate information for the registry of rental property or to fail to provide the information required herein for the registry.
An owner who fails to register, reregister, or otherwise comply with the provisions of this article shall, upon conviction, be subject to a fine not exceeding $250 or to imprisonment for not more than seven days, or both, for each violation.
