The purpose of this chapter is to promote the public health, welfare and safety of the residents of the Village of Chatham by regulating the dumping and depositing of solid waste and by providing for and financing the cost of the collection of residential waste within the Village of Chatham.
As used in this chapter, the following words shall have the following meanings:
RECYCLABLES
Those waste materials which are acceptable to the Columbia County Solid Waste Department for receipt and processing by the Columbia County solid waste recycling program.
RESIDENT
A person who maintains a fixed, permanent and principal home within the corporate limits of the Village of Chatham to which such person, wherever temporarily located, always intends to return. The ownership of commercial property or other real property which is not improved and occupied as a home shall not constitute a "residence" for purposes of this chapter.
SOLID WASTE
Shall consist of the following:
A. 
GARBAGEAll waste, vegetable, animal or other matter, liquid or solid, likely to ferment or decompose, produce noxious odors or become injurious to the public health.
B. 
REFUSETrash and litter, whether or not combustible, consisting of but not limited to paper and paper products, wood products, ashes, dust and dirt and plastic residential containers and materials.
C. 
CONSTRUCTION DEBRISAny scrap lumber, metal, earth, sand, brick, stone, plaster, roofing and siding material or other debris of a similar nature, which accumulates or is incidental to the construction or renovation of homes, buildings, public works or other projects.
D. 
BULK ITEMSAny large, heavy and/or bulky household appliances, furniture or furnishings.
Residential garbage and refuse collection service shall be provided only to residents of the Village of Chatham and only in accordance with the strict compliance with the provisions of this chapter.
A. 
No person, other than a resident of the Village of Chatham, shall dump, place or cause to be placed for collection within the Village of Chatham any solid waste material.
B. 
No resident of the Village of Chatham shall dump, place or cause to be placed for collection by the Village of Chatham or its agents or employees any garbage or refuse unless there is affixed to each bag of such garbage and/or refuse a duly authorized waste sticker as hereinafter provided for under § 58-5 of this chapter.
C. 
No person, whether a resident of the Village of Chatham or otherwise, shall dump, place or cause to be placed for collection within the Village of Chatham any construction debris or bulk items.
D. 
All resident garbage and refuse which is placed out for collection by the Village of Chatham or its agents or employees shall be placed in individual plastic storage bags having a capacity not to exceed 35 gallons.
E. 
The transportation of solid waste upon the streets and highways located within the Village of Chatham in open or uncovered trucks or other vehicles is expressly prohibited. The provisions of this subsection shall not pertain to vehicles which are used for the collection and/or transportation of recyclables under the Columbia County solid waste recycling program.
There is hereby established a garbage/refuse collection/tipping fee system within the Village of Chatham as follows:
A. 
Each bag of garbage and/or refuse which is placed for collection by the Village of Chatham or its agents or employees must have affixed thereto an official Village of Chatham garbage/refuse collection sticker.
B. 
Village garbage/refuse collection stickers may be purchased at the office of the Village Clerk/Treasurer. The cost of the garbage/refuse stickers shall be at the rate established, from time to time, by resolution of the Board of Trustees.
C. 
Garbage and/or refuse which is placed for collection by the Village of Chatham or its agents or employees without the required garbage/refuse sticker will not be picked up.
D. 
The placing of garbage and/or refuse for collection without the required garbage/refuse sticker shall constitute a violation of the this chapter and shall subject such person to the penalties hereinafter provided for.
Recyclables shall be exempt from the provisions of this chapter, provided that the same are properly separated and packaged in accordance with the requirements of the Columbia County solid waste recycling program. Recyclables which are not properly separated and packaged will not be picked up. The placing of recyclables which are not properly separated and packaged for collection by the Village of Chatham or its agents or employees shall constitute a violation of this chapter and shall subject such person to the penalties hereinafter provided for.
Any person who violates any provision of this chapter shall be guilty of a violation and, upon conviction thereof, shall be subject to a fine of not less than $50 nor more than $250 or imprisonment for not more than 15 days, or both.
