A. 
Every person convicted of a traffic infraction for a violation of any provision of this chapter which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York shall, for a first conviction thereof, be punished by a fine of not more than $50 or by imprisonment for not more than 15 days, or by both such fine and imprisonment; for a second such conviction within 18 months thereafter, such person shall be punished by a fine of not more than $100 or by imprisonment for not more than 45 days, or by both such fine and imprisonment; upon a third or subsequent conviction within 18 months after the first conviction, such person shall be punished by a fine of not more than $250 or by imprisonment for not more than 90 days, or by both such fine and imprisonment.
B. 
Pursuant to Article 14-B of the General Municipal Law of the State of New York, the Village Clerk of the Village of Chatham is hereby designated the Traffic Violations Bureau of the Village of Chatham and is authorized to accept the fines for parking violations as established under Subsection C of this section, if such payments are received on or before the return date of the parking summons.
C. 
[Amended 7-22-1999 by L.L. No. 1-1999] The following fines are hereby established for violations of the parking provisions of this chapter:
(1) 
Overtime parking: $10.
(2) 
Parking in a prohibited area: $25.
(3) 
Parking in front of a fire hydrant: $50.
(4) 
Double parking: $20.
(5) 
Parking in emergency access area: $50.
(6) 
Overnight parking: $15.
(7) 
Other parking: $10.
(8) 
Snow emergency street parking violation: $25.
(9) 
Temporary snow removal parking violation: $15.
(10) 
Parking without permit: $50 plus cost of towing.
D. 
If any person shall fail to appear in Village Justice Court on or before the return date of the parking summons or shall fail to voluntarily pay the fines provided for under Subsection C of this section to the Village Clerk as authorized by Subsection B of this section, the fines provided for under Subsection C of this section shall be doubled as of the return date, and the continued nonappearance and/or payment of such fines thereafter shall subject a person to the penalties provided for under Subsection A of this section.
E. 
The Community Service Officer of the Village of Chatham is hereby authorized to enforce and issue summonses for violations of Article III of Chapter 99 of the Code of the Village of Chatham.

A. 
Except those parts, if any, which are subject to approval under § 1684 of the Vehicle and Traffic Law of the State of New York, this chapter and any regulations adopted hereunder shall take effect as provided by law.
B. 
Any part or parts of this chapter and any regulations adopted hereunder which are subject to approval under § 1684 of the Vehicle and Traffic Law of the State of New York shall take effect from and after the day on which approval in writing is received from the New York State Department of Transportation.
If any article, section, subsection, paragraph, sentence, clause or provision of this chapter shall be adjudged by any court of competent jurisdiction to be invalid, such adjudication shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the Article, section, subsection, paragraph, sentence, clause or provision thereof directly involved in the controversy in which such judgment shall have been rendered.
All prior ordinances, regulations and rules, or parts thereof, of this village regulating traffic and parking are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance, regulation or rule hereby repealed prior to the taking effect of this chapter.
