[Adopted 4-23-2009 by Ord. No. 03:05-09; amended in its entirety at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]
For the purpose of this article, the following words and phrases shall have the meanings respectfully ascribed to them by this section:
ALUMINUM
All products made of aluminum, including aluminum cans.
BRICKS and CONCRETE
All building, or decorative, sidewalk and similar materials which are brick or concrete.
GLASS
All products made from silica or sand, soda ash and limestone, the product being transparent or translucent and being used for packaging or bottling of various matter, or other material commonly known as "glass"; excluding, however, plate glass and blue and flat glass commonly known as "window glass."
METAL
All products made of metal exclusive of aluminum, including washers, dryers, refrigerators, stoves, hot-water heaters, tire rims, springs, bicycles, tin cans or scrap metal.
MISCELLANEOUS RECYCLABLES
Items such as vacuum cleaners, computer monitors and other electronics.
PAPER
All uncontaminated used newspaper, magazines, books and cardboard.
YARD AND TREE REFUSE
All grass clippings, lawn thatching, limbs, branches, brush, small trees, and bushes.
YARD WASTE REFUSE
Leaves.
A. 
Mandatory separation of solid waste, refuse, garbage and trash from recyclable items must be made. Recyclable items are as set forth above.
B. 
All homeowners, tenants of single- or two-family homes, and owners of multifamily rental units who utilize the Borough of Bellmawr or its authorized agent for the collection of solid waste, refuse, garbage and trash shall separate from it all recyclable items and shall place them in the appropriate containers and places in accordance with §§ 382-23 and 382-26. The Borough of Bellmawr is not required to collect solid waste, refuse, garbage and trash from any occupant or owner who includes recyclable items with the solid waste, refuse, garbage and trash or who does not place recyclable items for collection in accordance with this article.
It shall be unlawful for any person to place or cause or suffer to be placed upon any vacant lot, alley, street, driveway, sidewalk, curbing, areaway or any other public place any recyclable material as herein defined or to distribute such material when properly placed as herein defined except in compliance with the provisions of this article.
A. 
Single stream shall be contained in a reusable metal or plastic occupant- or owner-supplied container. The Borough of Bellmawr, on occasion, will supply residents with recycling containers. If replacement of a Borough-supplied container is required, the resident is to return the broken receptacle and be supplied with a new container. No recyclables in paper or plastic bags outside of the above referenced will be collected, and their use will be considered a violation of this article.
B. 
Metal items, such as water heaters, appliances, including washers, dryers, refrigerators, stoves and dishwashers, cast iron, and the like, shall be placed at the curbside after the homeowner has arranged with the Department of Public Works for a specific time and date for collection.
C. 
Yard waste refuse and leaves shall be placed in open containers separate from solid waste, except between October 15 and December 15 in the fall and between March 15 and April 1 in the spring, when a separate leaf pickup will take place with the leaves being placed along the curbline in front of each property.
D. 
Tree waste, limbs, branches, small trees and bushes shall be placed neatly at the curbline for easy disposal. The homeowner must arrange with the Department of Public Works for a specific time and date for collection.
From the time of placement at local drop-off points, items shall be and shall become the property of the Borough of Bellmawr or its authorized agents. It shall be a violation of this article for any person unauthorized by the Borough of Bellmawr to collect or pick up or cause to be collected or picked up any such items. Any such collection or removal in violation hereof shall constitute a separate and distinct offense punishable as herein provided. It is understood that the specific intent of this provision is to prevent scavenging of any such items, whether for personal use, sale or otherwise.
The collection, removal and disposal of aluminum, glass, metals, paper, tree and yard refuse shall be supervised by the Director of the Department of Public Works of the Borough of Bellmawr. He shall have the power to establish, with the consent of Borough Council, the time, method and routes of service. Said Director, with the consent of the Borough Council, may promulgate rules and regulations in accordance with the terms of this article in order to effect the purpose of this article.
All receptacles required herein shall be supplied by the homeowners, tenants of single- or two-family homes, and owners of multifamily rental units who utilize the Borough of Bellmawr or its authorized agent for the collection of solid waste. The container shall be placed prior to collection between the curb and sidewalk where it shall be readily accessible to the collector. All receptacles must be placed no closer than five feet to property limits. The occupant, resident or owner shall keep all receptacles clean and in condition for safe handling. Receptacles in excess of 32 gallons in capacity shall not be subject to collection and shall be the responsibility of the occupant, resident or owner of said premises for disposal. Receptacles or other items to be disposed of shall be placed outside at the designated area after 6:00 p.m. of the day preceding the day of collection and no later than 6:00 a.m. of the day of collection. After collection, any empty containers shall be removed from the curbside promptly, but no later than 7:00 p.m. of the day of collection.
Any homeowners, tenants of single- or two-family homes and owners of multifamily rental units, stores or other buildings who utilize the Borough of Bellmawr or its authorized agent for the collection of solid waste that violate or neglect to comply with any provision of this article or any regulation promulgated pursuant thereto shall, upon conviction of said violation, be fined the sum of $500 for each violation.
