A. Declaration. The City Administrator shall declare a snow
emergency whenever he determines that falling snow, sleet, or freezing
rain, or the reasonable threat of the same, may cause hazardous or
dangerous driving conditions upon the streets within the City. Such
snow emergency shall remain in effect until terminated in accordance
with this Section.
B. Automatic Declaration. Notwithstanding any other provision
of this Section, and between the hours of 6:00 A.M. and 10:00 P.M.
of any day, a snow emergency shall automatically go into effect on
any part of any snow emergency route on which there is an accumulation
of snow of two (2) inches or more or an accumulation of ice of one-fourth
(¼) of an inch or more, and where either such accumulation
has been present for an hour or more.
C. Broadcast Of Declaration. The City Administrator shall distribute
each declaration made by him pursuant to this Section to local radio
and television stations (and local newspaper(s), when practicable)
so that the declaration may be publicly announced via such stations'
broadcasting system. The City Administrator shall include in each
such declaration:
1. That a snow emergency is in effect;
2. That parking on emergency snow routes is prohibited during such emergency;
3. That all vehicles traveling during such emergency should have proper
snow tires; and
4. The time that such snow emergency became or will become effective.
However, such declaration shall not take effect until at least one
(1) hour after the first (1st) announcement.
D. Termination. Whenever the City Administrator shall find
that some or all of the conditions that gave rise to the snow emergency
no longer exist, he may declare the emergency terminated in the same
manner prescribed by this Section for declaration.

Each street designated by this Chapter as a snow emergency route
shall be posted at intervals not exceeding seven hundred fifty (750)
feet with signs stating: "Snow Emergency Route. No Parking During
Emergency. Tow Away Zone."
The following streets are hereby established as emergency snow
routes within the City:

When a snow emergency is in effect, no owner or operator of
a motor vehicle shall park or allow to remain parked any vehicle on
any portion of a snow emergency route.

A. Definition — Effective Tires. For purposes of this
Section, "effective tires" shall mean radial, all-season
and/or tires that are designed to give effective traction on snow,
mud, or ice covered streets by means of extra heavy-duty treads with
special high traction patterns (such tires often bear the designation
"MS", "M&S" or the words "MUD AND SNOW"); except that no tire
so defined shall be construed to be a snow tire if it is damaged or
worn to the extent that its performance would be substantially impaired.
B. It
shall be a violation of this Chapter for any person to operate any
vehicle on any street, alleyway, highway, or other public roadway
of the City without effective tires on all wheels of the operated
vehicle during a snow emergency if such operation impedes or obstructs
traffic.

No person or persons engaged in the removal of snow or ice from
driveways, parking lots, sidewalks, or other private property shall
deposit such snow or ice in the streets or any public way designated
for vehicular or pedestrian traffic.

A. Members
of the Police Department or the Public Works Director (or either of
their designated representatives) are hereby authorized to remove
or cause to be removed a vehicle from a snow emergency route during
a snow emergency when a vehicle is:
2. Parked in violation of any parking ordinance or provision of law
and is interfering or about to interfere with snow removal operations;
or
3. Stalled thereon and the person who is or was operating such vehicle
does not reasonably appear to be taking immediate action to safely
remove the vehicle from said route.

The removal, impounding, and return of a vehicle pursuant to the Section shall be in accordance with Chapter 367 of the Municipal Code, and the owner of such vehicle shall be liable for the reasonable costs incurred in the removal, storage, and return of such vehicle. Such cost shall not constitute a penalty or fine.

In any prosecution with regard to a vehicle parked or left in
a place or in a condition in violation of any provision of this Chapter,
proof that the particular vehicle described in the complaint was parked
or left in violation of a provision of this Chapter, together with
proof that the defendant named in the complaint was at the time of
the violation the registered owner of such vehicle, shall constitute
prima facie evidence that the defendant was the person who parked
or left the vehicle in violation of this Chapter.
