A Planning and Zoning Commission is hereby created for the City of Oak Grove and hereinafter referred to as the "Commission".
There is hereby established within and for the City a Planning and Zoning Commission which shall consist of not more than fifteen (15) nor less than seven (7) members, including the Mayor, if the Mayor chooses to be a member; a member of the Board of Aldermen selected by the Board, if the Board chooses to have a member serve on the Commission; and not more than fifteen (15) nor less than five (5) citizens appointed by the Mayor and approved by the Board of Aldermen. The term of each of the citizen members shall be for four (4) years, except that the terms of the citizen members first (1st) appointed shall be for varying periods so that succeeding terms will be staggered. Any vacancy in a membership shall be filled for the unexpired term by appointment as aforesaid. The Board of Aldermen may remove any citizen member for cause stated in writing and after public hearing.

The term of the citizen members shall be for four (4) years but the terms of the first (1st) members shall be varied so that succeeding terms will be staggered. There shall be no compensation for the members of the Commission. A citizen member may be removed by the Board of Aldermen for cause after a public hearing. Any citizen member facing removal shall be advised by mail at least five (5) days prior to any public hearing. Removal of a member of the Commission shall be upon a two-thirds (⅔) vote of the Board of Aldermen.

The Commission shall elect a Chairman and a Secretary for one (1) year terms with no restriction on the number of terms. The Mayor and the member of the Board of Aldermen are ineligible for office on the Commission.

The Commission shall adopt rules of procedure, provide for holding regular and special meetings and maintain a record of its transactions and meetings which will be public.

The Commission shall not authorize expenditures that exceed the amounts appropriated by the Board of Aldermen.

The Commission:
Shall make and adopt a City plan for the physical development of the municipality. The plan shall be made with the general purpose of guiding and accomplishing a coordinated development of the municipality which will, in accordance with existing and future needs, best promote the general welfare, as well as efficiency and economy in the process of development.
Shall, after the adoption of a major street plan, prepare and recommend that the Board of Aldermen adopt regulations governing the subdivision of land. After adoption of a major street plan, the Commission must act on all proposed plats.
May prepare proposed zoning regulations, hold hearings, and recommend zoning regulations to the Board of Aldermen for adoption.
Shall, after adoption of the City plan or part thereof, approve or disapprove all proposed public improvements whose location, character and extent are included in the plan.
Shall, in general, have the power necessary to enable it to perform its functions and promote municipal planning.
Shall make careful and comprehensive surveys and studies of the existing conditions and probably future growth of the municipality.
May take recommendations on the development of the municipality to public officials and agencies; public utility companies; civic, educational, professional and other organizations; and citizens.
Shall appoint employees and staff necessary to accomplish its work.
May contract with planners and other consultants for services the Commission may require and all public officials, upon request, shall furnish such information as the Commission may require.

The City plan shall include the maps, charts, plats and descriptive matter explaining the Commission's recommendations for the City's physical development and uses of land.
When the Commission adopts a plan which includes at least a major street plan, it shall:
Prepare recommended subdivision regulations.
Approve recommended maps showing setback lines on major streets before the Board of Aldermen is authorized to enforce setback regulations.
The plan may include:
The general location, character and extent of streets, public ways, grounds, places and spaces, terminals and public utilities.
The general character, extent and layout of the replanning of blighted districts and slum area.
A recommended zoning plan.
Recommendations for public improvements and their financing.
The Commission may adopt the plan as a whole or it may adopt separate parts of the plan. It may subsequently amend or extend the adopted plan.
Before adopting the plan or any part thereof, the Commission shall hold a public hearing on the plan.
Notice of the hearing shall be placed in a newspaper having general circulation in the municipality fifteen (15) days prior to the hearing. The hearing may be adjourned from time to time.
After the public hearing, the Commission may adopt the plan by a resolution which refers expressly to the written and graphic materials which make up the plan. Adopting resolutions shall be carried by a majority vote of the full membership of the Commission. Action taken shall be recorded on the adopted plan with the identifying signature of the Secretary of the Commission.
A copy of the adopted plan or part thereof shall be certified to the Board of Aldermen and the Municipal Clerk. A copy shall be recorded by the County Recorder of Deeds.
After the plan or part thereof is adopted, no public improvement which has been included in the plan shall be constructed or authorized until the planned improvement has been submitted to and approved by the Commission.
Approval shall not be required if the Commission fails to act within sixty (60) days after receiving the plans for the proposed improvement.
Disapproval by the Commission may be overruled by not less than a two-thirds (⅔) vote of the entire membership of the Board of Aldermen.
After a major street plan and subdivision regulation have been adopted, no street shall be accomplished nor shall a building permit be issued for land abutting a street unless:
The street had legal status prior to the adoption of the plan.
The street is shown on an approved plat.
The street is shown on a street plan adopted by the Commission.
Other streets may be located and constructed if the Board of Aldermen first submits the proposed street to the Commission for its approval. Disapproval by the Commission may be overruled by not less than a two-thirds (⅔) vote of the entire membership of the Board of Aldermen.
