A. Any
person, firm, partnership, corporation, association, co-partnership
or trust, prior to commencing any private work on public works projects
in the City of Oak Grove, Missouri, shall comply with the following
regulations and provisions:
1. Plans and specifications for the private construction of public works projects, including, but not limited to, streets, sidewalks, storm drainage systems, sanitary sewers, water lines, and appurtenances to be maintained by the City of Oak Grove, Missouri, shall be submitted to the City Engineer for approval. Prior to review of the plans by the City Engineer, the applicant shall submit a partial fee of two hundred fifty dollars ($250.00) to the City Clerk for review of the plans by the City Engineer. The remainder of the fee shall be determined as described in Subsection
(3) below.
2. A public works permit shall be obtained from the City authorizing
the construction mentioned as set forth in the approved plans and
specifications.
3. The public works permit fee shall include costs incurred by the City
for review of the plans by the City Engineer and the estimated cost
of inspection and laboratory testing done by the City of Oak Grove
during construction for quality control. No permit shall be issued
by the City unless the applicant submits payment of a fee to the City
Clerk equal to actual costs for review incurred by the City, less
the initial review fee, and an amount equal to one and one-fourth
percent (1.25%) of the estimated cost of project for storm and sanitary
sewers; one and one-fourth percent (1.25%) of the estimated cost of
project for water lines and two percent (2%) of the estimated cost
for street projects. For purposes of this Section, the following schedule
of construction costs shall be used to determine the estimated cost
of the project:

4. No construction shall be accomplished and the public works permit
provided for herein shall not be issued until a performance and maintenance
bond satisfactory to the City Attorney in an amount equal to one-half
(½) the cost of construction and shall be posted with the City,
guaranteeing against defects in the construction of streets, sanitary
sewers, storm sewers, water lines and appurtenances for the period
of one (1) year following the date of written acceptance of such improvements
by the City, as well as guaranteeing the complete performance of the
contemplated construction for which the permit herein provided for
is issued, and further guaranteeing and ensuring that such construction
shall be accomplished in a workmanlike manner, and further protecting
the City of Oak Grove, Missouri, and ensuring said City from any loss
or damage.
5. Following the issuance of the public works permit provided for herein,
construction shall not be started until the City Inspector has been
notified as to the time, location and scope of the construction.
6. No construction work shall be commenced until the public works permit
provided for has been issued and a written notice to proceed shall
have been issued by the City Inspector.
7. All construction work may be stopped at any time by the City Inspector
or his/her agent when, in the opinion of the City Inspector, the workmanship
materials used or procedures of work do not meet the requirements
or comply with the City codes, ordinances, specifications and procedures
for such work.
8. All work, accomplished by means of a public works permit issued under
this Chapter, shall be subject to final inspection for City maintenance
by the City Inspector and his/her recommendation shall be made to
and written acceptance made thereon by the Mayor and Board of Aldermen.

A. Sidewalks
shall be constructed in locations as noted on the approved public
works plans and specified on the building permit.
1. Sidewalks for non-residential development shall be constructed by
the developer or builder prior to issuance of the occupancy permit
by the City.
2. Sidewalks for residential development shall be constructed by the
homebuilder prior to issuance of the occupancy permit by the City.
3. Residential developers shall post a performance bond with the City
for a period of two (2) years following the termination date of their
initial public works maintenance bond, guaranteeing the construction
of approved plan sidewalks on their remaining subdivision lots by
the end of the guarantee period. Form of the bond shall be satisfactory
to the City Attorney. Amount of the bond shall be equal to the cost
of construction of the remaining sidewalks at the beginning of the
bond period. Construction cost used to determine the bond amount shall
be thirteen dollars ($13.00) per linear foot.

A. Grading And Subgrade Preparation.
1. Grading and site preparation shall be done in accordance with Section
2100 Kansas City Metropolitan Chapter, American Public Works Association
(APWA) Street Construction and Material Specifications.
2.
Subgrade preparation shall be done in accordance with Section
2200 APWA Street Construction and Material Specifications as modified
by the City's Technical Specifications and Design Criteria for
Utility and Street Construction.

B. Curb And Gutter. All curb and gutter shall be twenty-four (24) inches
wide. Portland cement concrete and constructed as specified in Section
2209 APWA Street Construction and Material Specifications as modified
by the City's Technical Specifications and Design Criteria for
Utility and Street Construction. Integral curb and gutter shall be
used in Portland cement concrete pavement as specified in Section
2208 APWA Street Construction and Material Specifications.

Construction specification shall be the APWA Street Construction
and Material Specifications. Asphaltic concrete surface and base per
Section 2205 as modified by the City's Technical Specifications
and Design Criteria for Utility and Street Construction. Portland
cement concrete alternate per Section 2208. Use of stabilized aggregate
base alternate construction is not permitted.

D. Sidewalks. Sidewalks shall be constructed in accordance
with Section 2301 APWA Street Construction and Material Specifications.
Expansion joints shall be placed at one hundred (100) foot centers
and as noted on Standard Drawing SW-2. Contraction joints shall be
placed at four (4) foot centers.
E. Storm Sewers. All construction of storm sewers and appurtenances
shall conform to Section 2600 APWA Storm Sewer Construction and Material
Specifications as modified by the City's Technical Specifications
and Design Criteria for Utility and Street Construction.

F. Sanitary Sewers. All construction of sanitary sewers and appurtenances
shall conform to City ordinances, Section 2500 APWA Sanitary Sewer
Construction and Material Specifications as modified by the City's
Technical Specifications and Design Criteria for Utility and Street
Construction and regulations of the State of Missouri.

G. Water Lines. All construction of water mains and appurtenances shall
conform to City ordinances, Section 2900 APWA Water Lines Construction
and Material Specifications as modified by the City's Technical
Specifications and Design Criteria for Utility and Street Construction
and regulations of the State of Missouri.

Any person who violates any provision of this Chapter shall
be subject to punishment not to exceed ninety (90) days in jail and/or
five hundred dollars ($500.00) fine for each offense. Each day of
violation shall constitute a separate offense.
