A. Every
user of water from the municipal water system of the City of Rogersville,
Missouri, shall use said water only after it has been metered in a
water meter to be furnished, installed, regulated and controlled by
said City and the application for each meter, or someone for him/her
or her, shall pay for said water used at the following monthly rate:
1. For the first one thousand (1,000) gallons used in each month, the
rate shall be nine dollars ($9.00) for all users within the City limits
of Rogersville. For each and every additional gallon, the rate shall
be $0.0050 per gallon.
2. Water metered and/or sold outside the City limits will be one and
one-half (1½) times the above rates, namely thirteen dollars
fifty cents ($13.50) for the first one thousand (1,000) gallons used
in each month. For each and every additional gallon, the rate shall
be $0.0075 per gallon.

In the event less than one thousand (1,000) gallons is used
in any one (1) month, the minimum rate of nine dollars ($9.00) shall
be charged and paid for users inside the City limits and thirteen
dollars fifty cents ($13.50) for users outside the City limits.

A. All
meters shall be read by the City on the fifteenth (15th) and sixteenth
(16th) of each month or as soon thereafter as is reasonably possible
and an accurate record of all readings shall be kept in the office
of the City Clerk. At the discretion of the Mayor and/or Board of
Aldermen, water meter readings may be estimated during severe weather
conditions.
B. After
the meters have been read as herein, the City Clerk shall as soon
after as reasonably possible after the end of each month send to each
user a written statement stating the amount of water used and the
charge therefore. Thereafter, all bills shall be payable at the office
of the City Clerk on or before the fifteenth (15th) day of the month
following the use of the services. All bills which are not paid by
8:00 A.M. on the twenty-fifth (25th) date of the month are considered
delinquent and subject to disconnection by the City.

Each new user where there has not previously been a water meter
installed shall pay to the City Collector before a meter is installed
a fee of two hundred dollars ($200.00) for residential and two hundred
fifty dollars ($250.00) for commercial plus the cost of the meter,
which fees shall not be refunded.

A. Before
being connected to City water and sewer utilities, each user shall
pay to the City Clerk or their designee a utility deposit.
1. Residentially zoned property users shall pay to the City Clerk or
their designee eighty-six dollars fifty cents ($86.50). This fee shall
be called a utility deposit. The utility deposit shall be refunded
to the user subject to the exceptions contained herein upon voluntary
disconnection.
2. Non-residentially zoned property users shall pay to the City Clerk
or their designee two hundred dollars ($200.00). If services accounts
become delinquent for non-payment, the deposit amount will be increased
one hundred dollars ($100.00) each time the service account becomes
delinquent. The additional deposit amount shall be due with the account
delinquent fee and outstanding charges prior to reconnection of services
The utility deposit shall be refunded to the user subject to the exceptions
contained herein upon voluntary disconnection.
3. Apartment (as defined in Section
405.080) users where one (1) meter provides services to a dwelling group (as defined in Section
405.080) shall pay to the City Clerk or their designee two hundred dollars ($200.00). If service accounts become delinquent for non-payment, the deposit amount will be increased one hundred dollars ($100.00) each time the service account becomes delinquent Any additional deposit amount shall be due with the account delinquent fee and outstanding charges prior to reconnection of services. The utility deposit shall be refunded to the user subject to the exceptions contained herein upon voluntary disconnection.

A. Upon any user being disconnected for any reason, the City may apply such of the meter deposit provided for in Section
705.040 as may be necessary to pay any delinquent bills of said user.
B. It
is hereby declared an unlawful offense for any person or persons to
knowingly use water from the said municipal system unless said water
is metered as provided herein.
C. All
water meters installed as herein provided are hereby declared to be
and to remain the exclusive property of the City of Rogersville, Missouri,
and it is hereby declared and unlawful and an offense for any person
or persons to damage, destroy, steal or tamper in any manner whatsoever
with any water meter or with any other part of said water system.

A. In
the event any water and sewer user fails to pay his or her bill for
monthly water and sewer charge after the same becomes due and payable,
the user will be assessed a penalty of ten percent (10%) of the amount
of such unpaid bill.
B. In the event any water and sewer account shall become considered delinquent in accordance with Section
705.030 hereof, water service shall be disconnected on the first (1st) business day of the month following the date of delinquency set forth in Section
705.030, except that in the event the first (1st) business day of such month shall be a Friday, then such services shall be disconnected on the second (2nd) business day of such month.
C. A delinquent
account fee of twenty-five dollars ($25.00) will be charged at the
time of late payment and before water service is restored to a user
whose water services have become delinquent as of 10:00 a.m. the first
business day of the month that is not a Friday pursuant to this Section.
Said account delinquent fee shall be in addition to any outstanding
balances and shall not be applied to any outstanding water or sewer
service balance.
D. A water
meter installation fee of fifty dollars ($50.00) will be charged,
in addition to any reconnection fee, before reinstallation of a water
meter of a user whose water meter has been removed due to delinquency
of an account.
E. All
fees, penalties and charges set forth herein shall be cumulative,
but may be waived by the Board of Aldermen for good cause shown.

A. Each
family unit and each business of any kind whatsoever shall have a
separate and individual meter; provided however, that whenever any
person has a business which he/she is actually, continuously and personally
operating and a residence for his/her family in which he/she is actually,
continuously and personally using as his/her chief place of dwelling
and said business and said dwelling is immediately adjacent to each
other, one (1) meter shall be sufficient for both the business and
the dwelling.
B. The
term "family unit", as herein used, shall have the
same meaning as that commonly applied to the word "family" and shall mean any number of persons more than one (1), living together
under the same roof with someone of their number as head who controls
the affairs of the household, and upon whom the others or some of
them are dependent by reason of some legal or moral obligation.

A. The paying of the fees and charges provided for in Section
705.030 hereof or the use of water supplied through said municipal system shall constitute a consent that any officer, servant or employee of said City may come on the premises and enter buildings on said premises for which water is being supplied for the purpose of carrying out the provisions of this Chapter or any other ordinance relating to said water system or for any cause reasonably necessary to the efficient and proper operation of said water systems.
B. Any
complaints about reading of water meters or computation of water bills
shall be made to the Board of Aldermen and shall be made in writing
signed by the user and state the nature of the complaint.

A. Punishment
for the violation of any of the provisions of this Chapter or for
the commission of any act declared herein to be unlawful and to be
an offense shall, upon conviction, be a fine of not less than ten
dollars ($10.00) and not more than five hundred dollars ($500.00)
for each offense, with costs, or by imprisonment up to but not more
than thirty (30) days, or both by such fine and imprisonment. Costs
to include court costs, as well as the costs to repair or replace
property that was stolen, damaged, destroyed or tampered with. Also,
whenever in the opinion of the Board of Aldermen as shown by its records
any person in not complying with or is violating any of the provisions
of this Chapter, the meter to such person shall be disconnected and
that person denied the further use of water from said system until
there has been compliance with all provisions of this Chapter.
B. Every
residence inside the City limits of Rogersville, Missouri, shall have
installed and be connected to its own individual water meter to allow
proper rates and charges for water and sewer.
