As used in this article, the following terms shall have the
meanings indicated:
The municipal swimming pool maintained and kept up by the
Borough within the Dormont Public Park, and shall include the swimming
pool, bathhouse, bathhouse equipment and grounds within the swimming
pool enclosure.[1]

A.
It shall
be unlawful for any person who is the purchaser of any Borough resident
swimming pool identification pass or resident swimming pool identification
tag to loan, assign or transfer the same to any other person.
B.
It shall
be unlawful for a person to enter the swimming pool by means of or
by presentation of a resident swimming pool identification pass or
tag which was, when purchased from the Borough, issued to a person
other than the person presenting the same.
C.
It shall
be unlawful for any person to enter the swimming pool without first
presenting a lawful swimming pool identification pass or tag or payment
of a fee.

Forfeiture;
penalties.
(1)
Any resident swimming pool identification pass or tag, when presented
by a person other than the purchaser thereof to whom the pass or identification
tag was issued, shall be forthwith forfeited, taken possession of
by the Borough officials and become the property of the Borough.
(2)
Any person violating the provisions of this article by loaning, assigning
or transferring to another his or her resident swimming pool identification
pass shall forfeit such pass or tag, and the Dormont Borough Manager
shall have the right to refuse the issuance of another tag to such
person during that year.

Any person, being the purchaser of an identification pass or tag
as referred to in this article, violating the provisions of this article
shall, in addition to the forfeiture of his or her identification
pass or tag and privileges, be subject to a fine.
(4)
Any person who enters the swimming pool without first presenting
a lawful swimming pool identification pass or tag or payment of a
fee shall be subject to a fine.

No person, other than those who have secured the prior written
approval of the Dormont Borough Manager and the authorized agents,
permittees and employees of the Borough of Dormont, shall swim in
or enter the water of the Dormont Borough swimming pool or be upon
the enclosed grounds of the swimming pool at any time for any reason
or purpose whatsoever except during the hours said Dormont Borough
swimming pool is open for use by the public.

Any person who violates or permits a violation of this article
shall, upon conviction in a summary proceeding under the Pennsylvania
Rules of Criminal Procedure, be guilty of a summary offense and shall
be punishable by a fine of not more than $1,000, plus court costs
and reasonable attorneys' fees incurred by the Borough in the enforcement
proceedings. Upon judgment against any person by summary conviction,
or by proceedings by summons on default of the payment of the fine
or penalty imposed and the costs, the defendant may be sentenced and
committed to the Borough correctional facility for a period not exceeding
10 days or to the county correctional facility for a period not exceeding
30 days. Each day that such violation exists shall constitute a separate
offense, and each section of this article that is violated shall also
constitute a separate offense. In addition to or in lieu of enforcement
under this section, the Borough may enforce this article in equity
in the Court of Common Pleas of Allegheny County.

The carrying of any kind of lighted pipe, cigar, cigarette,
electronic cigarette or any other lighted smoking equipment and any
other use of tobacco products is strictly prohibited in the Borough
of Dormont Public Parks and recreational areas.
