The Department shall be known as "The North East Borough Police Department."
The North East Borough Police Department shall consist of the following with the powers and duties commensurate with the said ranks; and, upon being so commissioned, shall have the authority to wear the appropriate designation denoting the said ranks:
A. 
Chief.
B. 
Captain.
C. 
Lieutenant.
D. 
Sergeant.
E. 
Patrolman First.
F. 
Patrolman Second.
G. 
Patrolman Third.
H. 
Patrolman Fourth.
I. 
Probationary patrolman.
J. 
Patrolman part-time.
K. 
Probationary patrolman part-time.
The Chief and the Lieutenant shall be those persons appointed to the North East Borough police force and commissioned with the aforesaid ranks by the Borough Council upon the request of the Mayor of the Borough of North East.
A. 
A Patrolman First shall be a person whose appointment to the North East Borough police force as a full-time patrolman is greater than 42 months; and commissioned with the aforesaid rank by the Borough Council upon the request of the Mayor of the Borough of North East.
B. 
A Patrolman Second shall be a person whose appointment to the North East Borough police force as a full-time patrolman is more than 30 months and less than 42 months; and commissioned with the aforesaid rank by the Borough Council upon the request of the Mayor of the Borough of North East.
C. 
A Patrolman Third shall be a person whose appointment to the North East Borough police force as a full-time patrolman is more than 18 months and less than 30 months; and commissioned with the aforesaid rank by the Borough Council upon the request of the Mayor of the Borough of North East.
D. 
A Patrolmen Fourth shall be a person whose appointment to the North East Borough police force as a full-time patrolman is more than 12 months and less than 18 months; and commissioned with the aforesaid rank by the Borough Council upon the request of the Mayor of the Borough of North East.
E. 
A probationary patrolman shall be a person whose appointment to the North East Borough police force as a full-time patrolman is less than 12 months; and commissioned with the aforesaid rank by the Borough Council upon the request of the Mayor of the Borough of North East.
F. 
A patrolman part-time shall be a person whose appointment to the North East Borough police force is for a part-time position, that is, a position requiring on the average 32 hours of service or less per week, and has worked more than 2,000 hours as a patrolman part-time; and commissioned with the aforesaid rank by the Borough Council upon the request of the Mayor of the Borough of North East.
G. 
A probationary patrolman part-time shall be a person whose appointment to the North East Borough police force is for a part-time position, that is, a position requiring on the average 32 hours of service or less per week, and has worked 2,000 hours or less as a patrolman part-time after the date of hire; and commissioned with the aforesaid rank by the Borough Council upon the request of the Mayor of the Borough of North East.
The Mayor of the Borough of North East shall have full charge and control of the Chief of Police and the police force; and he/she shall direct the time during which, the place where, and the manner in which the Chief of Police and the police force shall perform their duties.
The Borough Council shall fix and determine the compensation and the total weekly hours of employment that shall apply to the members of the police force.
The members of the police force of the Borough of North East shall have all the powers and duties available to said police officers under and pursuant to the laws of the Borough of North East; under and pursuant to the laws of the Commonwealth of Pennsylvania; and under and pursuant to the laws of the United States of America.
The members of the police force of the Borough of North East shall be subject to all civil service rules and regulations, now enacted or hereafter adopted, governing the North East Borough police force.
Words and phrases, when used in this chapter, shall have the meanings ascribed to them in the Vehicle Code of Pennsylvania,[1] as now in force or as hereafter amended, enacted or reenacted, except in those instances where the context clearly indicates a different meaning. The singular shall include the plural, and the masculine shall include the feminine.

The provisions of this chapter are severable, and, if any of its provisions shall be held invalid, the same shall not affect or impair any of the remaining provisions which would have been enacted had such invalid provision not been included herein.
