The Borough Council of the Borough of Sharon Hill hereby ordains and adopts this ordinance, hereby revoking all prior ordinances inconsistent herewith, and establishes maximum fines for violations of Borough ordinances and codes as follows.
The violation of all Borough ordinances and codes, including, but not limited to, the Zoning Ordinance, No. 1051, adopted March 25, 1976, as amended, and the Code of the Borough of Sharon Hill, adopted December 28, 1972, as amended, shall be subject to a maximum fine as provided from time to time by state statute. At present, those maximum fines are established in Act 18 of 1988 as enacted by the Pennsylvania Legislature, effective May 1, 1988. If and when Act 18 of 1988 is amended or otherwise modified to either increase or decrease the maximum fine for ordinance violations, it is the intent of Borough Council that the maximum fine authorized by the state statute shall be the maximum fine with regard to all ordinances or codes of the Borough of Sharon Hill.
Editor's Note: In accordance with the amended provisions of the Borough Code, Title 8, Part I, as recodified by Act 37 of 2014, the maximum penalties allowed by statute, except for subjects such as vehicles and traffic, earned income tax and zoning, for which specific penalties appear to be set by separate statutes, are: for civil enforcement, fines of not more than $600 per violation, plus court costs and reasonable attorneys' fees; for criminal enforcement (including for ordinances regulating building, housing, property maintenance, health, fire, public safety, parking, solicitation, curfew, or water, air or noise pollution) a fine of not more than $1,000 plus court costs and reasonable attorneys' fees and, on default of payment, imprisonment for not longer than 30 days.
